    • Thank you. We like to see also the exchange between you and the mechanic/garage telling about the gearbox. Also, send an email to the garage whose mechanic called you:   Get this email to them as soon as possible. Hopefully it will draw a response which will confirm what they say – but even if it doesn't draw response – as long as there is no denial then it is fine. Even if there is a denial, it won't be too important but it would certainly be nice to get a paper trail which supports what you say. Please send this off and come back here and confirm that you've done it

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

it will have been 14 days on the 18th so I would send it. that way u r nearer to claiming in court and getting your money back when u come home :)

Posted lba by recorded delivery on 2/10 with another £60 of charges added. This was received 3/10. However received a letter from HSBC dated 2/10 on 4/10 giving the usual derisory offer of £2000, which I will reject as my claim is for £3464. Should I reply to this letter or wait until 17/10 which is 14 days after my lba letter was received. They have given me 10 days to accept the offer of £2000. A little guidance would be greatly appreciated.

Hi

 

I am going to send the rejection letter, the one that accepts the offer but states that it is only in part settlement, and that i will do the mcol on 17/10 which is 14 days from receipt of the lba I sent. Is this the correct thing to do?

Well I have heard nothing since rejecting their offer or since sending the lba, so here goes with moneyclaim. I have read the forums and have the template and interest calculator but any other tips would be greatly appreciated.

ooh good luck. I only sent my LBA today but im still well excited!

25th spetember - Sent off S.A.R - (Subject Access Request)

10th October - Received all statements

11th October - Calculated all charges

Drafted prelim letter

Did spreadsheets

16th October - Sent prelim letter to Ian Shepherd

17th October - Letter delivered. 14 days starts today!

31st October - LBA sent first class recorded!

2nd November - Confirmation LBA received

18th November - Filed my MCOL for £1278. Bosh!

20th November - MCOL acknowledged

24th November - Acknowledgement of service

24th November - Received offer of £900. Rejected

30th November - Received offer of £1023. Rejected

13/11 Received letter from DG Solicitors requesting charges breakdown.

13/11 Sent breakdown of charges

14/11 DG received breakdown of charges

16/11 Received letter from DG......I've WON. They will settle in full!!!!

 

Just need to know abaout the "confidentiality" clause. Do I need to sign it? Will it prejudice any payment or the amount of time it will take for them to pay me?
