      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was just wondering if anyone has had dealings with this company?

Ive received the letters/phone calls that ive ignored and now they are threating to come to my house.

What is the likelyhood of this happening?

 

all this is over a private carpark ticket that i refused to pay as the signs stated a customer carpark but didnt state to which business.

 

any help would be grate as i dont want to put my family in danger.

It won't happen.

 

Remember they are just a private, limited company like any other. They have no powers whatsoever.

 

They don't do house visits, unless you literally live around the corner. It's a waste of time and petrol and the chances are you won't be in. And once they go there they can't do a thing anyway.

 

Rossendales just write letters, with maybe the odd phonecall. If they ring, just put them on hold and go and watch TV.

See how their hollow threats work - you're now thinking of skinhead thugs! All part of the [problem].

 

They're just a couple of blokes in an office doing paperwork.

thanks for replying.

someone rang up asking for me on saturday but we have caller id and i didnt recognise the number so i just said he had the wrong number and he hung up - i left it an hour then witheld my number and rang them back and it was rossendales.

then this letter arrived this morning saying they will visit in the next few days to my home as they fully intend to obtain the full £135 for the parking ticket.

As the other posters have noted Rossendales are just another DCA working for a PPC and have very little power (except to threaten via letter). They certainly have absolutley no power to enter your home by law. If they do turn up (they wont-ive yet to see one that does) you can treat them as you would anyone else you wouldnt want on your property;) (or call the police!).

well its now 7th april, just over a week and still no sign of the apparent people coming to collect the money that i apparently owe them. they rang again tonight but ive got caller id in so i just let it ring, surprise surprise they didnt leave an answerphone message.

Take pity on them. They make a living from making phonecalls than people won't answer and no doubt they always get hung up on.

 

Nobody will come round. It's not financially worthwhile.

Lol, you'll be waiting a long time - as Al27 points out it simply isn't worth the effort. This is particularly in view of the fact that they might travel to see you and then you just send them packing. Just part of their threat tactics - expert Santa down your chimney before these clowns.

They very very rarely turn up due to costs and the (ill)legalities of it all (although one or two do surface as noted on the DCA forum)-and if they do are politely told to go forth and multiply....:p They have no standing whatsoever to 'visit' you.
