      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI

Im behind with my payments by onre month so i contacted nbna and told them i couldnt mamage my payments anymore things have snowballed after my operation tpo save my sight . i can nolonger do the job i used to because of the severity of my eyesight i am registered as severly sight impared .they told me to make a token payment and to try and take out another credit card and transfer the debt to another card . this i fins is useless . today i find that i have a card delivered saying that a AEGIS REP WILL CALL ROUND ON SATURDAY and discuss things . who are they ? do i have to deal with them ?i am now on income support and recieve a carers allowance for my mother who i live with and care for .it is rented property in my mothers name .i have very little as struggled for years in a repare shop which barely paid its way . so i do not have savings or any capital . what can i do .do i tell the AEGIS REP TO GO AWAY ? ANY HELP

I have had a similar postcard from AEGIS.

 

Do not panic.

 

These cards are sent out to harrass people - and this tactic is not allowed by the Office of Fair Trading who are supposed the licensing authority for debt collection agents.

 

They are NOT allowed to call without an appointment. IF they do turn up - just shut the door. Do not be frightened by these people.

 

I am submitting a complaint to the Office of Fair Trading and Consumer Direct about this company.

 

Just continue with your token payments if that is the arrangement you have come to.

Don't panic.

 

As Pathway rightly says, it is a scare tactic and they more often than not do not send anyone out, but if they do, just tell them that you are not prepared to discuss the account with them and that any correspondence must be in writing.

 

It's a bit much sending you a calling like that when you are only one payment behind. Do you have any charges on the account that you could claim back??

 

If not then you could send them a CCA agreement request to see that they have the necessary paperwork in order to collect on the debt.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Hi thanks

but the postcard aegis sent didnt have a uk postal address all it had was a phone number to call, ive just phoned them and red out the draft letter to them . trhey promptly apoligised for the letter but still asked me to make a payment . i told them that i will sort things out after i had consulted with my consumer advice centre next week .and put the phone down on them .
