      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well you have managed to do it it only took one day . Google in Lyons Davidson now & it is top of the list(:D

 

I think maybe you got confused emzy. It's the CAG link (through googling in Lyons Davidson & Plymouth College of Art) that needs to be top of the list so that other students who may have/had/ problems with claims instigated by Lyons Davidson or Plymouth College of Art will find this forum easily.

My initial thoughts would be to start with queries re. the list of Standing Suppliers

 

'Where standing supply arrangements exist the Budget Holder should use

SUPC or CPC websites to determine the most appropriate supplier. The

method is set out in Appendix 1'

 

You have established that repairs & maintenance have been necessary with the car park barriers over a considerable period (i.e. it was routine) so if there was no standing supplier for such, why had the Finance Director not made appropriate arrangements prior to this incidence to ensure a supplier was appointed to the lists? i.e. why wasn't he doing his job as in:

 

C Principle - The Director of Finance is responsible for developing appropriate standing supply arrangements on behalf of the College

Universal Security may presumably have been appointed by the finance director to supply and maintain their barriers and if so I guess there should be a contract between them which should be on file.

 

I don't think I would expect to see a contract unless the supplier was responsible for routine maintenance & the council or the college maintained an account with him so that invoices could be submitted on a regular basis. I can only speak with knowledge of how consultants are appointed to 'approved' lists or panels with authorities, where usually the consultant applies to the authority to join the list & has to provide references etc., sometimes an interview takes place & then the consultant is told whether he has been accepted onto the panel from which he could be chosen by various depts. to carry out work for the authority. Sometimes authorities/organisations advertise for businesses to apply for consideration for the panel. But I would hae thought that there must be a paper trail somewhere of any application made, refused or granted. Maybe another FOI request would hustle it out?

they've included all except one in their court bundle and the one they've left out says that the incident happened in working time.

Now that's interesting because they've gone to great lengths, including making false statements under a statement of truth, to make it appear that the incident happened outside working time.

I'm not really clear why a person in an important position in the college would make false witness statements about this. Any ideas anyone?

 

Could it be because the barrier wasn't 'manned' (or at least no security guard was on the premises) to raise it at Fred's request? If it was working time, that would be the college being negligent, if outside working hours, presumably you park at your own risk?

Patma - don't go public too early. The judicial system (& the police) may not prove too co-operative if you blast it all over the press at this stage. Plus if you wait for the whole story, Fred might be able to make a bob or two for his version ;)

Lyons Davidson have gone very quiet and haven't responded to our last two letters, reminding them amongst other things that they still haven't properly complied with the judge's disclosure order of 3rd July.:eek:

 

Hmm...discontinuance coming? :rolleyes: Maybe the penny's dropped?

Fred allegedly received a Simple Caution, but the conditions were certainly not complied with by the police.

 

 

Hmm- is this why the police are dragging their feet over the info. you are currently awaiting I wonder.

...The defendant's application relating to striking out and the police caution to be listed on the first open date, after 6 weeks, namely on 9th February 2010 at 11am.

Yup! AIUI they went into voluntary liquidation not b/k although IMO Hell, Fire & Damnation might have been a more fitting title. :D

They've taken over the same phone number. Does that count?

 

Only if they've 'taken over' the actual phone system I think but in any case, they would probably claim they had paid the old company/liquidators for the stock (probably 1p!! :mad:)

 

We'll go along and investigate whether they're in the same premises hopefully tomorrow.

Same thing applies & the premises could well be rented.

:confused: Well the latest letter from them has done a U turn and they're urging him to contact the College directly for the information he wants :confused::rolleyes:
