      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

That's the whole point of discussion on this thread

 

Some of us think they would win some of us don't. Usually we are all agreed on what to do and what is likely to happen if it went to Court but this is not the usual scenario due to your actions.

 

Personally I think if it went to Court, you would lose and it would get paid.

Gosh, this is awful lot of work for £10.

 

Q - If they just pursue the £10, dropping their claim for the hundred, all the way, would they win.

 

A - I still don't think they would but accept this is a moot point.

 

This is all hypothetical because of excel's actions. They have shot themselves in the foot because of own bullying ways - all helpfully recorded in print.

 

Try mistyping something in google - you get the helpfull message "did you mean .....". Excels system is highly automated, it would be quite easy to insert fuzzy logic into the programme so that typing one letter wrong in the reg is not the end of the world. Why don't they do it, they are a big enough company after all. The reason is of course that this system suits them just "fine". If 1 in 100 people pay but type in their reg incorrectly then that becomes a fantastic extra earner.

 

I accept excel have incurred costs, however these are largely self inflicted. I do accept that m'lud might just, on a bad day, see it differently.

£10 is not a lot of money, round of drinks for yourself and partner. I definately would not pay it, I wouldn't give them the steam from my morning micturation.

I think this is the important thing. They will do NOTHING - effectively any further conversation(in particular from Mossy and myself) is just the theory behind it.

BB - fuzzy logic would not work in this situation, as you would be including almost every vehicle in the world in your car park by introducing fuzzy logic.

Barnsley Boy, you have to be in the health profession to use the word micturation!! Surely we havent stopped all the overseas doctors etc from coming into this country so that we are now having to rely on Barnsley? :D:D:D

Seriously though as I said earlier today this is ludicrous for £10 and of corse it is not about that at all but about what excel are squeezing out of people by very dubious methods. Before I came on here I had looked on the internet and without making any connection until today I now notice that you were on this forum in Feb abou the same company. Checking further around he internet there are an awful number of PCNs going missing in the post so that people have to pay £100 instead of £60 but if they have misentered as I did but not had the fortune to find the original ticket they have no chance and I have a feelin this could be a fairly common occurence

Yes I agree it's a lot of typing for £10, but I never cared about the amount.

 

I love this forum because I have learnt and learn so much from it, I will only ever give advice when I know that what I am saying is factually correct and if I don't understand the rationale behind something I will ask.

 

OK this was over £10, but one day it may be over a bigger amount or then again it may never come up again (these circumstances), but I think I know what I would answer should it ever do so.

 

What I really like about this forum is that everybody with different views took the time to reply and fully state why they felt what they wrote, no bickering, no falling out, just acceptance of different viewpoints, if Excel or any other PPC reading this was expecting us to all fall out big style and be at each others throats then they were wrong (and for that I am really glad).

 

OK BarnsleyBoy has drawn me a map of where my white hat was hiding and how to find it so normal service will be resumed tomorrow.
