      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How do mods now it was not Perky or anyone associated with him who made the complaint? He has more identities than you can shake a stick at - female, Scottish, you name it.Are mods really saying publicly available information cannot be posted on this site? If that is so 90% of posts would have to be censored.Perky has alleged that an insider provides him with personal details of members. I hope that is not true. It is a little disconcerting that the site apparently rushes to his aid even though he has alleged dishonesty by its staff and is currently running a sponsored ad slagging it off.

Firstly, NO ONE gives out personal details, this is a bizarre statement to make especially since we do not have access to your personal details

 

when you register with the site are you asked for your name and address? NO . do you give us your telephone number ? NO all you give on the registration is user name password and email address!! so how the heck can someone seriously believe that we are giving out personal information , its ridiculous to suggest and more ridiculous if you believe it !!!

 

For the record, we do not solely rush to perky s aid when something goes wrong,we uphold the site rules, which as a member im sure you will have read;) so you will know with some degree of certainty that the posting of commercial links for example is prohibited

 

on the issue of how do we know it wasnt perky that made the complaint, i dont need to disclose how but trust me we do!!

it is in everyones interest to have advice given on the forum, there have been instances where our members have been duped into giving out their details via private message to the very people they are fighting against and this has caused them problems

 

Furthermore, i would like to point out that if the advice is given via private means then how can it be checked for its accuracy? the main strong point of this forum is the advice given is able to be checked by a broad array of knowledgeable people and corrected where necessary

Does anyone know what is happening with Perky's latest would-be victims that have come on here looking for help? I assume they are being helped? Obviously do not reveal too much as enemy eyes are no doubt still watching.

 

Rest assured they are being helped off forum for their own protection.

I must stress that said advice has not been given via this site.

 

well from my reading of the first two comments above, it seem clear to me that members of this forum are being given advice in private which is what we actively discourage and was my point

So you will ban people offering genuine helpful advice albeit in a private setting?

 

 

Please refrain from trying to put words into my posts which simply arent there

 

at no time did i suggest that at all, however we would like to know if this is happening as in the past (as i previously posted) our members have been approached by people under the cloak of being kind helpful souls, offering advice by private medium and it turned out that the person was an employee of a private parking company

 

Now how exactly do we know that you are not one of the same? my point is before you misconstrue what i am saying is, that when you register on this and many other forums, all the info you need to provide is a user name, password and email then you can post professing to be an expert in this,that and the other and you may or may not know what the hell you are on about, unless the post is in the open forum how will we know.

 

Granted , itis not ideal to post your defence on here in some circumstances , however, i dont see why everything needs to be kept off forum there is a wealth of useful info that can be given which does not need to remain private

well, back to Pepipoo, this forum is overly moderated for my liking, and my post count has been moderated as well, FFS I thought big brother was on telly.
i can confirm that your post count hasnt been moderated per se,what has happened is that when the off topic posts were moved into the bear garden, the posts were deducted from everyones post count mine included as bear garden posts do not add to your post count
