MMF Date of issue – 04/10/17 What is the claim for – 1.The defendant owes the claimant £260 under a regulated agreement with curo transatlantic t/a wagedayadvance dated 28/05/2012 and which was assigned to the claimant on 16/10/2012 and notice of which was given to the defendant on 16/10/2012 (debt). 2.Despite the formal demand for payment of the debt the defendant has failed to pay 3.and the claimant claims £260 and further claims the interest thereon pursuant to section 69 of the country court act 1984 limited to one year to the date hereof at the rate of 8% per annum amounting to £21. What is the value of the claim? 359.32 Is the claim for - Payday loan When did you enter into the original agreement before or after 2007? after Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. mmf Were you aware the account had been assigned – did you receive a Notice of Assignment? Yes, but I couldn't be sure one way or another if notice received Did you receive a Default Notice from the original creditor? Possibly, but I no longer had it Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? I don't believe so Why did you cease payments? could no longer afford payments on my part time wage, then started full time university What was the date of your last payment? 27/07/2012 Was there a dispute with the original creditor that remains unresolved? yes. Unaffordability complaint made and declined. Has been with the ombudsman for several weeks. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? I believe so, I tried to keep up payment on just the interest for a while, but was unable. I have received a claim form from the court in relation to an old payday loan debt with wagedayadvance/mmf I made an affordability complaint and shortly after they decided I didn't have a case, have made a court claim. Before I received the claim, I took the case to the ombudsman, so have ask moriarty law to stay the case until this is complete. Ive attached my statement of account if it helps at all. What else can I do Thank you
  2. Hi Will keep this brief. I have been with Payplan since 2005. Made a huge mistake and took out two more payday loans. Could not pay them so entered an arrangement with both. They accepted a much smaller payment - about £50 each. I owe about £700 on WageDayAdvance. However due to more financial issues I find I cannot keep up the payments so I called Paypaln who agred to add them to my DMP. Wagedayadvance have now rresponded thus: DEBT MANAGEMENT ACKNOWLEDGEMENT Dear Customer ID: We have recently received a notification from Payplan which advises you have applied for a Debt Management Plan. Although we acknowledge receipt of this correspondence, we will not be accepting the terms of the Debt Management Plan, as we do not consider ourselves to be bound by its terms. It appears that you entered the arrangement with Payplan on 27/11/2005; this is before you applied for funds with WageDayAdvance Ltd on 26/04/2013. Within the loan agreement, which is legally binding and enforceable, amongst other conditions, you agreed that: 1. the information you have given is true and complete; 2. all sums owed under the loan agreement, including interest shall become due and payable immediately if, WageDayAdvance Ltd believes that you have provided false and information when you entered into the loan agreement; and 3. You would immediately inform us of circumstances relating to your ability to discharge your liabilities under the loan agreement. At no stage during your application for the loan did you indicate that you were subject to a Debt Management Plan. Given the Debt Management Plan pre-dates the application for credit, we are concerned that you applied for a loan in the knowledge that (i) you had instructed a debt management company and (ii) you would not be able to make the repayments in accordance with your contractual obligations under the loan agreement. Providing false or misleading information in a credit application could amount to fraud on WageDayAdvance Ltd. If, you have any further information that you would like to bring to our attention, or, if you have any other questions, please contact our Debt Management Department on 01756 707306 or e-mail collections@wagedayadvance.co.uk. I am trouble with a lot of payday loans and am going to cancel my card and try to send them all letters offering payment terms, but I think Wagedayadvance have setup a direct debit on my account, if i cancel the DD will they still be able to get my money or setup another DD? I'm getting paid on monday so need to sort it this week PS i was also considering a debt management company and have seen that Bridgewood Financial Solutions have not setup fee, are they any good?
