  1. Hi, I'm new to this forum. I need some advise. I sold a car two months ago and have received the new owners traffic offence fine they committed. I have return the paper work stating I sold they car but its been rejected, stating I have not supplied any evidence for proof of sale. I have appeal it this and my appeal is next month. When I sold the car I signed the V5 log book but gave it to the new owner to sign,it was a present of this wife and so she couldn't sign it for me to post it off there are then. Unfortunately they signed and sent off the V5 2 weeks later, stating it was sold then, after the fine was issued. I have written to the DVLA stating the date of sale is incorrect and asked for it to be changed. Technically I have no other proof I didn't own the car when the offence was committed. The new owner has refused to accept liability, has not paid the fine even though I have contacted them and sent them the paper work. All I have is a letter from the DVLA with a copy of the V5 with my signature backing my version of events, and a few txt messages from the new owner agreeing the price of sale. The car was advertise on Ebay, he didn't win but contacted me within 5 minutes of the end asking to buy it, so i have a record of this, just no actual receipt on the day. What are my chances of winning this case if the DVLA do not update they records to prove I was not the owner? Should I cut my losses and pay the **** bags £130 fine, I am so :mad2: ****ed off about this!!!
  2. Hi all, In August 2010 I took out a new phone contract for my then boyfriend in my name as he wasn't working. (Stupid I know!) We broke up in March/April 2011 and he had just got a new job. So together (when things were still amicable) we decided to change the phone contract into his name, address and debit card details. Orange said this was all fine and very quickly changed it all over. By the next billing date, only the statement for my phone showed on my online account with Orange. Only DD payments were taken for my phone. IT had all been transferred over to his name, address and DD details - that was all fine. However, unknown to me, in November 2011 my ex stopped paying his bills. Racked up a debt of £160.92. I never received any phone calls or letters to my address regarding this. Then in September of this year I had voicemails from Moorcroft Debt Recovery. I have been with them before for debt management but not for a good couple of years. They said I owe money for unpaid Orange contract bills - I explained that my phone had never been cut off in the 5 years I had been with them and all DD came out as usual. They then read out a mobile number that I recognised then my ex's address. I explained what we had done with Orange when we broke up and no correspondance had been sent to my address. Moorcroft were happy with this and raised this query with Orange. Yesterday I received through a letter stating possible litigation. This panicked me. I rang back Moorcroft and they explained that Orange had taken so long getting back to them, the account automatically became unfrozen, so they put it on hold again and said they would go back to Orange. I decided to ring Orange myself. I explained all of the above. According to the Orange advisor, letters have been sent to his address but with my name on them since this time last year and the account is still in my name (despite being told in March/April 2011) that it wasn't so I was liable to pay. I explained that when we transferred the account to his name, address and DD details I thought it wasn't anything to do with me anymore as the bills for that phone aren't on my statements etc. He couldn't answer me but he did say my ex was sly about ignoring the letters in my name that have gone to his address - he must have known he wouldn't get chased for payments. He advised me to go to Citizens Advice Bureau etc. But what else can I do? I do not want to go to court over a debt that isn't my fault. I do not qualify for legal aid. Hi, I am looking for some help please, I applied for remortgage a while back to be told that I was not accepted due to my credit history but I have never had bad debt and always cleared anything I have had. I got a copy of my credit report to see a default from Studio catalogue that I have never had and subsequently found out that this was taken out at my old address 6 years after I moved out! The name on the catalouge is mine but spelt incorrectly and with a completely different DOB, I told Studio this wasnt mine but they asked me to send my mortgage paperwork for my new address which I was not happy to do considering the way they do not seem to hold accurate information. The police advised this is not a crime in Scotland so told me there is nothing they can do. I then left things as I ddint hear anything for a while. About 6 months ago a debt collector showed up at my door and I again advised this is not my debt. Another debt collection agency are now chasing me and calling me at home, I have again told them the debt is not mine and asked them to remove my details from their system but they just do not believe me and keep calling me. What can I do from here? I know I shouldnt have left it so long but I am now completely stressed out and upset and hope someone can help. Thanks for taking the time to read this!
  4. Hello, I hope someone can help me please. I have lived in my flat for over 6 years and pay Council Tax and all other bills there. A few months ago i received 2 letters from a debt collection agency chasing a debt of over £1600 for my cousin who has the same surname as me, they don't seem to have his first name hence we are both Mr...... I used to live with him at the address up until 2006, the £1600+ relates to bills for August 2010-September 2011, when i certainly never lived with him. I rang up the company told them it wasn't me and they said that was the end of the matter. Oh no it's not! It's been passed to some other debt collection agency called GB Debt Recovery. I've rang them and they told me the debt is for my address. It is not. I said i would send them a council tax bill for this period to show i didn't live there. They are not interested and want my utility company EDF to email them! Of course i ask EDF and they won't. They are not interested in seeing my Council Tax bills which logically i thought would prove where i live. Please help i feel so depressed and don't know who to turn to for help. They are threatening me with court. They haven't even asked who the person the bill is actually for as they believe i am lying. I AM NOT. Thanks in advance. Jay (on my sister Sal's account) I
