  2. It is impending court case with alegations of £7000 amounts outstanding under a deemed contract after an existing contract was cancelled by the utility company who stated they no longer wished to supply but continued to do so as the incumbent supplier for gas supplied to premises

HI Under a rolling contract that is not renewed y the company, what are the points that the utility company has to prove at court action for outstanding bills that have not been paid Please help as the utility companies are now exhibiting powerfull anti-social tendencies reminiscent of ---------------- its fairly clear that these companies are using their huge financial muscle to manipulate the laws of this land and offer limited fightback opportunities for the common decent hardworking man as they employ frankly ruthlessly sharp business practises. This is an example of the driving force and money muscles behind their decision to cancell contracts but utilise the out of contract legislation to bolster their profits http://www.bailii.org/uk/cases/UKHL/1998/22.html ------------------------------------ i.e Does a deemed contract have any circumstances that would make it an unfair contract, who is it enforceable against in respect of tenancies or partnerships when and if they decide to go for court action or bankruptcy can they pick and choose who they decide to default- does the utility company have to prove the existing contract was lawfully terminated and what constitutes proof Is there any case law that has worked against the utility providers under similar circs

Tied into a business broadband contract and three months later got throttled by fair usgae policy as had gone over the limit - apprently hit 300gb in Jan and 250gb every other month My gripe is their sales staff are so keen to make a sale they failed to advize on the best option and sold a product that was not fit for purpose- ie should not have been sold the crappy option2 in the first place as given our circumstances it was guaranteed to fail. I realise that business contrcats are sometimes not afforded the same level of protection as domestic consumers. Anybody got any standard defence that would stand up in court or make them back down from their now pretty well rehearsed "we will charge you for the remainder of the contract" Thank you in advance

  6. Bumping your thread We were held to ransom by BG continually applying standing charges to a property that we purchased but totally gutted out with a renovation and they were told about and told to cap off the supply as the property had been vandalised and all copper etc stripped out

Who are this company and having read through their portfoloio it appears they are set up to circumvent the regulations as best possible as they state "increase the amounts of water meter connections" and to manage a recovery field force with intimate knowledge of recovery practices within the highly regulated Water Industry. Can also carry out disconnections where appropriate" From their website schpeel sound like they are procatively going out to see if there are any legal loopholes they can utilise to increase the water companies revenue, Has anybody got any information on how and where their authority comes from? ie is it statutory or a huge offshoot company from the water industry but set up separately thereby avoiding the water industry regulatory practises their parent company is indicated as spice industries

I believe recently there was abit of a scandal where these companie were cold calling customers out of the phone books to estalish who they were before pursuing their "investigations" My name is a fairly common name and i was cold called and the person asked if they could speak to a Mr xxxx xxxxx . I refused and instead asked who they were what the nature of their query was and where they had got the details of the person they were seeking from and where they had got my details The caller made some excuses and hung off

I know what you mean, I went through exactly the same problem because half a dozen of our social tenants were ripped off for amounts ranging from 1 pound to ten pounds and the utility company telephone merry go rounds kept them spinning for literally hours on end Bumping up the thread hoping somebody with expertise will respond-
  11. :D and just when we all thought the utility company SNITCHES AND GRASSES had all but taken over the forums slowly but surely rendering them useless with flaming etc etc Along comes a pearl and changes the direction yet again I for sure will be making full use of this for the benefits of the 60 odd flats that come under our directorship, all of whom are on PREPAY meters and all of whom are struggling financially (HE...HE.....HE.... rolls off the floor ......rubbing hands in glee)

Hi Has anybody got a SAR request letter that relates to Gas and Electricity companies requesting information from their unique filing systems for instance any voice recordings or hand written notes or computer records etc I am shortly going to make a few requests and dont want to miss out on information that they may withold because I dont know about their unique filing systems and/or they cant be bothered to manually dig it out

Hey I had a similar problem except the underground wiring was on my property and guess what, It transpires they did not have any wayleave agreement so i wrote back giving them 3 months to remove all their apparatus Guess what they sent a surveyor and an offer to negotiate on a wayleave, although the wayleave was for pennies (carried over quite conveniently from when the utility companies operated for the benefit of the general public as opposed to now when they operate for the benefit of the shareholder) Ask to see the wayleaves

Make the bar stewards work for their money Giving up is too dead easy for em, learn the system and make em work, they are only civil servants and as human beings we all sometimes make mistakes, play sneaky, use tape recorders hidden, in briefcases etc to get them on record. arrange personal meetings in order to do this Its too easy to fob you off or tell lies over the telephone
