  1. my mother was recently charged £25 for an "unpaid bill" (hsbcs make a payment in their online banking!!!) from her instant access savings account i asked to refund it to which they said it was fair as she had clicked the make a payment when there wasnt enough funds in it on 25th june there is no payments noted either paid or returned on the statements for the 25th june, it is a savings accont and does not have "overdrafts d/debits etc" and obviously does not allow to overdraw on it therefore i fail to see how they can make a charge on a savings account please advise

I spoke to d & g (god i am priviliged!!!) said they would look into it and call me back so not holding my breath and said i would be applying to have stay lifted on the grounds of their claims in the letter to which they replied i had no chance on those grounds!!!! Spoke to my lawyer relative and been told have every chance on getting it lifted as letter is legal response and makes legal claims of settlement will keep informed ta-ta

Hi I got a letter on friday 30/5 from dg saying as follows: We act for HSBC in relation to your claim etc In this respect we are pleased to note that settlement has been agreed direct with our client and settlement funds have now been paid to you If you have not already notified the court we shall be pleased if you will write blah blah that matter has been settled we shall be pleased in relation of conclusion to this matter if you will sign and return the enclosed copy for our records I CONFIRM THAT AGREED SETTLEMEN ETC SIGNED DATED Wow how cheeky is that, I contacted HSBC on the chance that they may have settled to be told they have no idea about it, as usual cant contact dg - they dont answer phones but it looks like a con job to get me to sign away my court rights as i received my second stay after the oft hearing on 19th april after previously being stayed in august last year Anyone else had one of these? I thought i should bring it to peoples attention as they may end up signing away any possibilities of refunds cheers

Hi, I got a CJJ lnovember 2006 via lloyds on an account i was paying at an agreed rate, i was snowed under so just agreed with it but on checking found that I had been paying at the agreed rate via standing order, When i contacted their solcitors scmitchell they agreed that i had been paying allied international and thet ai had been slow in sending the payments on they removed all the courts costs from the account and said they would get the CCJ removed, I got my experian in dec 2007 only to see the CCJ still on there, when i contacted scm they told me to do it myself, I have bank statements etc which all show payments were made at correct amount and at agreed time so wondering how i go about removing CCJ and can i bill scm for the costs thanks in advance

Thanks everyone I have been told by HSBC's Heidi Daniels Manager Customer Credit Services that is is being dealt with by the relevant department after first giving me the usual "charges fair etc" spiel I have given my mother £200 in order that she can eat and pay bills this month so she is okay at present but stil await a decent response for her
  9. thanks, the bank have just fobbed her off today - charges are fair etc no mention of hardship or fact that this week she has paid her entire £108 state pension off her charges and left with 0p for the rest of the week - no heating food etc thanks for the help

  11. my mother is a widow on basic state pension aged 64 she has no other form of income yet has been charged over £300 this year by HSBC does this not fall under the BBA code of practice as she has the minimum amount allowed by the government to survive yet the bank take a chunk from this, if she was unable to pay water rates heating etc and was to die of hyperthermia would the bank to be to blame? Anyone can help let me know as she is due another £50 charges on 11th Sept out of her whopping £106 weekly state pension cheers
  12. Liverpool County Court is staying all cases although they still make you turn up and put you through the heartache - evil b######s so anybody with a hearing dont hold your breath they also seem uninterested in hardship cases as well

Recieved DG letter of intent to apply for a stay had already responded with human rights and hardship letters as payments from child benefit and tax credits taken from my account to both judge and DG does anybody have a link to the patricia hewitt letters on hardship cases as in court on monday thanks

  16. what i mean is do D&G have to inform me prior to the hearing if they are going to apply for a stay at the hearing as i was of the opinion that this was the case cheers
  17. Do DG have to inform me before the trial date that they intend to apply for a stay and if they dont what are my legal grounds? thanks
  18. i would not contact them, it is up to them to contact you, as far as i am aware if they are going to apply for a stay at the actual hearing they have to inform you beforehand, obviously they can apply to court before the hearing date and then its up to the court but from my knowledge they have to let you know prior if they are going to ask at the hearing so why give them reminders of when your hearing is, just carry on as normal

Called the court today case is to be heard and proceed as normal I had my AQ dispensed with but still had to pay the £100 so thought they would also but apparently only the claimant has to pay (thought if they hadnt i might get them this way!!!) ,I have to have my bundle in by Friday so assume they do also, do they have to send me a copy and if they dont submit their bundle can i request judgement for abuse of court process? regardless of of the OFT nonsense, I am aware that if a stay is to be requested (which i will obviously apply to have removed) at the hearing they have to inform me beforehand, anyone aware of any timescale for this as court is very soon. cheers
  20. hi, i have been in touch with Liverpool county court where my case will be heard on 20th August and been told to continue as normal as the judges there are viewing cases on individual merit and not allowing blanket stays also any stays can be applied to be removed so carry on as per your local courts requests
  21. I would contact the court on Monday and see what they say, but if the case had enough evidence to be heard before the OFT nad FSA stepped in whats the difference now? I am continuing as i would have as I dont really see this making all the difference to people as far in as us.
  22. also just got this from yahoo news copied and pasted:- The Financial Services Authority has agreed to suspend all refunds paid by banks until the court decision is made, although the BBA said claims for refunds can still be made and would be paid out if the court says they should be refunded. In reality the FSA actually has no bearing on the legal system and these are matters for the judges of each individual case to decide (thats my opinion anyway!!!!)
