Hi Fleur I'm sure somebody could show you the thread where the spreadsheets are placed but my friend used the ones that didn't update and she just included a note with her spreadsheet giving the amount that was added in interest everyday: i.e. £2,155 plus 0.57p per day so just work out up until today how much extra needs to be added and put it in a line at the bottom of the spreadsheet. Meanwhile I would definitely contact Barclays. If you email Krysta who is the head of the lit dept on '[email protected]' and ask her who is dealing with your case, someone should then contact you and ask for your schedule of charges and it will go from there. Her tel no is 020 7116 4753 and if you don't hear from her within a few hours give a call and ask to be referred to the person dealing with your claim. Make sure to tell them that the bundles of info are due and when can you expect yours and they will probably say they want to settle straight away. Good luck and let us know how you get on. Karenann

The number is 020 7116 4753 but I would try emailing her straight away her email is : '[email protected]' and if you don't hear back by say 2.00pm give her a call to chase on the number above. Just say that you have a court date and would like to know which member is dealing with your claim.   3. Hi Orca Please don't give up. Send an email - that way you don't have to talk to them. Krysta's email address is '[email protected]' If you just send her an email asking her to let you know the name of the person dealing with your claim she will come back to you and let you know who it is and they will then ask for your schedule of charges. That way you don't have to go through customer services just straight through to the litigation team. I bet you will have a settlment by the end of the week as they seem to be settling quite quickly if they know you have a date now. let us know how you get on
  4. Thanks Dar£n. You don't think I should worry about trying to lift the Stay then. Won't Barclays just tell me to go away if they know I don't have a court date. I just think that they have it written on my file that this case has been stayed and therefore they don't need to settle with me. One minute I was being contacted every 1/2 an hour to send over my schedules because they couldn't answer them then by Tuesday it was go away. It was the comment about going to court that got me. As far as I know they haven't got any cases going to court!! I thought she might be trying scare tactics with me. has anyone else out there been stayed for no reason.
  5. Well I took the bull by the horns on Friday morning and sent another email to Kate Ashton asking her to confirm that she was dealing with my claim? Well she came back and asked me to send over my schedule of charges which I did. She then said she would get it confirmed with her accounts department and revert then. I didn't hear anything after that on Friday so (trying not to get too excited) I waited until Tuesday and asked for an update and this is the response I got: I have a a number of cases in court this week I will have a look at your claim as soon as I get the chance thanks So it seems that I am being fobbed off again. My case has been stayed (no reason given) until 27 June so I suppose this means that the bank have noticed this and are now basically telling me to go away until I get a date yet other people have had the same and the bank have settled straight away. I am quite sure that I have done nothing wrong because I have done everything from this site so it looks as though my next step will be trying to remove the stay.

  7. I am so sorry I do know you are a she not a he following the incident with your husbands blow out!!!! Obviously not thinking straight. Have you booked yourself a holiday yet? don't spend it all you will need to treat yourself to some new clothes as well! I have still had no response from my email whatsoever and I sent a chaser at 10 this morning. When I called I was asked the date and the case no etc and then was told that it was Kate dealing with it and if I wanted anything I should write to her at the office as she was not available at present. They didn't even ask me to email - it just seemed a bit strange considering the responses everyone else has been getting. I am hoping that I am not the only one that this is happening to! Will update later.
  8. Hi all Thanks for your posts. I am sorry not to have posted earlier but very busy at work. I sent an email yesterday lunchtime to Krysta but had no response so at 4.30 yesterday I tried to call. I finally got answered just after 5pm and asked to speak with whoever is dealing with my case. I was asked for my name and case no. which I supplied. I was then told that Kate Ashton was dealing with my case but she was unavailable at present it might be quicker to write to her at the Head Office address where the previous correspondence had been sent. Now this has really got me a bit panicked - does this mean that I have done something wrong and they are not going to offer me a settlement or is just that they have a note on my file that the case has been stayed and are quite happy to leave me waiting. Woodentop contacted them on Monday and they settled with him straight away and he has been stayed with the exact some judge. Should I do anything else or just wait now.

I am currently sitting here with a big grin on my face and getting some very funny looks off of my workmates! I bet your husband has forgotten all about that blow-out now. Make sure to have a really, really good holiday and the satisfaction of knowing that you took the bank on and WON!! Anyway, i am now thinking that perhaps I should give them a call myself. In between your many celebrations(!) could you please let me have the details of who you first contacted and did you say that you had a court date? Enjoy spending all that lovely dosh!!

  11. Oh no, don't turn that machine off! I wish I could do the same. I don't have a pc at home, (it broke and we have not yet been able to buy a new one!) so once I finish work I won't be able to check. I don't work Tuesdays so will have to go and log on somewhere else tomorrow. Will be thinking of you and keeping everything crossed!
  12. Oh my god! Good luck - I am keeping all my fingers and toes crossed for you!!! The only thing that worries me is if they look at your file and it says that the case has been stayed - actually let's not go there. Oh god I'm getting excited for you - let me know as soon as you hear anything. If you don't hear by tomorrow afternoon give them another call - from a lot of the threads I have been reading they tend to say they will come back to you and sometimes you get forgotten about due to the amount of calls they are taken. GOOD LUCK!!!!!
  13. Hi all. Have finally received the letter from the Court. Basically it states: IT IS ORDERED THAT the claim is stayed until 27 June 2007 to be referred to District Judge Dudley in paperwork on 27 June 2007. I have just spoken to the lady at the County Court and basically he has not ordered a settlement be negotiated or in order to see the outcome of another case, he has just decided not to deal with any more of these cases at the moment due to the large volume and once he has them he will bundle them up and listen to more than one case at a time. Once it has been referred back to him he will then either order further time for negotiation or will set dates - at the moment it is 6-8 weeks waiting time so she said by the time it goes back to him I am looking at Aug/Sept before the case goes to Court. She did say that there was a note attached when it came over to say that this had been lost and could it be put before the Judge asap which I thought was quite nice but unfortunately the Judge it seems is getting a bit p****d off with these cases and is now not looking at them until 27 June when he will go through all of the ones that have been collected for the last six weeks. I wish I could choose to defer the work I didn't like for six weeks! Sorry to be a pain but is there anything i can do. The lifting of the Stay letter doesn't seem to relate to this situation and apart from Woodentop I don't know anybody else that has had this happen. Are they really allowed to just order a Stay because they can't be bothered to look at any for a while? Any comments received gratefully!
  14. Hi I haven't actually received the notice as yet. I had to ring the Court to be told this. Apparently the Judge ordered this last week but they are so far behind that it hasn't been typed up yet and then it will be a further few days until they send it out! From what they told me it is just the one Judge dealing with these claims so I would imagine Dudley must be the one. Your defence should have been sent by MCOL or the court to which Barclays sent it before it was transferred. The Judge must be saving all these cases up until after another case on 27 June which just annoys me because we all know that the bank will settle one week before and then we will all have to be given dates and this of course means that we will just be pushed further back. I would love to call Barclays if I thought it would work but they are not settling anything that is over a week away from court as they are being bombarded at the moment. I can't remember who's thread it was on now but basically they are not interested until the court date is imminent so they are certainly not going to want to talk to us about a case that has been stayed. How long has it taken you to get to this point, I started at the beginning of December and thought it would finish in June/July!! Still I am not prepared to take this lying down I am going to apply to have this lifted. I don't see why I should have to wait for somebody elses case to be heard which has absolutely nothing to do with my claim. Anyway I am getting carried away again.   15. Hi Thanks for all the posts but I am a bit confused. I have been looking at the link that Jonni2bad has posted for me regarding the lifting of the stay. This seems to date back to Feb 2006 and seems very out of date. It also refers to Lloyds cases and how none of them have gone to court but I don't think that this is now the case. It also includes a spreadsheet but again this will only relate to cases well over a year ago and things have moved on. Sorry to be a pain but I am supposed to update this with all the new cases and information (i.e. Lloyds recent success) and should I be changing this to list Barclays cases. I also do not yet know the reason for the Stay. All I know is that the Judge ordered a Stay until 27 June last week and that this was not at the request of the bank. Unfortunately the courts are running so far behind I still haven't received this through the post (the latest estimate is that once it is typed up it will be sent out about 5 days later!!!). I would just like to receive a date - the courts have really mucked me about. First it got transferred to Basildon where they lost my claim and took over a week to decide they couldn't locate the originals so would use copies. They then ignored my letter of request to transfer it to my nearest court and transferred it to Southend which is over an hours journey away from me. To top it all, having now waited six weeks just to be transferred the Judge has now stayed it for a further six weeks, after which I might finally get a date three months later. Therefore my court date will probably be six months after Barclays have filed their defence! is there nothing I can do to complain about the way I have been treated i.e. having files lost and being ignored? Sorry for the rant but even three days after finding out I am still raging. Any help would be greatly appreciated. good luck to everyone else on the site with their claims.

  17. I am absolutely gutted. I have just spoken to the Court and the Judge has Stayed this case until 27 June. This is not as a result of a request from Barclays. I am ready to burst into tears - I have really had enough now. My claim was transferred with no AQ on 3 April to Basildon who then promptly lost the paperwork and had to use copies! I was then told that all claims were being sent to Southend which is not my local court (in fact I have 3 closer!). The lady then told me to write a letter requesting it to be tranferred to my nearest court. This was ignored and then sent to Southend anyway where three weeks later I have still heard nothing. I gave them a ring today and have been told that the case has been stayed - I'm really sorry but I have absolutely no idea what I am supposed to do now but I can't believe this Judge is playing right into the Bank's hands. I am really not sure I can keep on with this it feels like not only am I fighting the bank but the Court has joined in to kick me in the teeth as well. Does anyone have any idea what steps I should be taking now? Thank you in advance.
  18. hello all, Well I received a notice of Transfer of Proceedings on 4 april with a waiver of allocation fee and have heard nothing further since then. I rang the court today and they said that I should have heard something because they were not that far behind! They had a look everywhere but can't seem to locate anything - what am I supposed to do now, it is one thing that Barclays are trying to take everything as slowly as possible but now I have the Courts mucking me about as well. They have told me that they are looking for the file and will come back to me once they have located it. I am not at all happy but I don't know what this means and what I can really demand from the Court. Please help
  19. Hi all Just a quick update. I have finally received Barclays Defence back and also a letter from Basildon Combined Court saying that it has been transferred here and no allocation questionnaire is needed. I rang the court and they said to ring back later in the week to see whether a fee would be payable and they said probably not and that they are no longer worrying about the AQ stage. Anyhow the question I have is re Barclays defence which I assume is the standard one, it states that they put the claimant to strict proof of the charges i.e. where from and when. However I have included an updated schedule of charges with every letter I have sent to them and also another copy to the court and to Barclays when i filed the claim. It was even attached to the defence that was filed! This lists my name, account number, sort code, the date the charge was taken and how much and what it was for so what further proof do they need? Do I just leave it now and wait for a date to file my court bundle or do I reply with yet another schedule listing all the charges which both the court and Barclays have. Many thanks for any help.
  20. Hi Lindylou You don't add the interest on your LBA Letter but when you put your claim in online at MCOL. You then send a copy to the Court and to the bank's solicitors with the interest included. You can only claim the 8% statutory interest once you start making a claim via the court system. I am just about to file online tomorrow and will now include my interest. Hope this helps and good luck will check back and see how you are going on since you are only a couple of weeks behind me.
