  2. Right an update - have filed the n244 today and hope i haven't cocked it up! Did it all in a bit of a rush at work today and realised after i'd filed in court that on one page of an attachment, i have repeated a paragraph 3 times on the same page but in different parts of the page! Do you think that will be ok? Lisa
  3. Hi All, just rec'd the 'agreement' back from a cca request i made on behalf of OH's hsbc cc. I will scan it up from work tomorrow. The thing is, this agreement (if it is that)! is for the gold card he took out from them in 2003. They uprgraded it a few years after that to a premier one which he never requested. There's no mention of that but should there have been a new agreement with that one also? Many thanks Lisa

  5. Sorry to be a lame brain Von but do i submit this defence to Court the 7 days before thearing or sooner or does it get included on the n244? Lisa
  6. Sorry Von - what defence did you do for the forthwith and interim CO? Is that to be kept separate from the the n244? Bit confuddled!

  9. Hi Cosalt - I get days like yours also (bad post/calls etc etc), had one of those yesterday and felt really overwhelmed by all my financial woes! Today i'm back on my game and empowered once again thanks to this site. The good days now are few and far between and the difference is knowing it will pass.   11. So just to clarify LFI - I sent the request to them early dec and gave them 14 days to comply - they haven't. At the end of that request i say that i will report them to the court if they don't comply. Now, should i just do the set-aside now then? I also read on another thread about a letter of 'discontinuation' from a company regarding something similar. Could that possibly happen to my case? Would be great if it did but i know it's wishful thinking! Lisa x

  18. Hi LFI - thanks so much for that. Now do i add that the haven't issued DN onto the end of question 3? And also any advice on question 10? Sorry! - just want to get it all done proper so the slippery so and so's can't wriggle out of anything! Also do i send them a reminder that they haven't yet sent anything and if so is there a suitable template to use? Thanks so much again - i really am learning new things here every day! Lisa x

  20. Hi All, hope i'm posting in the correct forum! Basically i purchased a car in 2004 from peugeot fin. For quite some time, i made payments on time and even overpayments for quite a while. Anyway, i have struggled over the past 2 years and my payments have been very erratic to say the least. The agreement ended (or was supposed to) in Agust 2008. At that stage, i was still confused as to what i owed but it was in the region of about 700/800 (only going by what little info they would give me). They passed it over to crystal collection who said my balance was 1100.00 and still ongoing! Peugeot still hadn't told them abouth the agreement being up in august! So i agreed to 100 per week as the collector came to the door. Paid 6 payments and then decided to sar peugeot and crystal. Crystal said as far as they were concerned, the account with them was now finished and it was back to peugeot. Today peaugeot sent me all my statements (showing nil balance by the way)! but over 700 quid of charges! So that is more or less the amount that crystal collected from me! So, can i claim these back like normal bank charges as they are written on the statements as 'penalty fees'. And isn't it a bit of a coincidence that as soon as i sar them my account is showing nil? Any help very very much appreciated and hope it all makes sense! Lisa x

Being a litigant in person and unfamiliar with court protocol i was unaware i could apply for a stay in proceedings and apologise to the court. However, as i have received no reponse at all from the claimant regarding my cpr request which is required under the consumer credit act 1974 and that therefore i would request that the court accepts these reasons for a set aside of the original judgement and provides judgement as follows: 1/ The claimant's claim is without substance and being unsupported by anagreement is declared void. 2/ The claimant, having not provided a copy of the original agreement is instructed to remove any reference to this agreement with all third party credit reference agencies. Supa would this suffice? Do you think i need/should add anything else? Lisa x
  22. Hi Supa - no i haven't applied yet for the set aside but i want to asap (as per my post 66). I have part filled the n244 i need some help with filling the rest in and whether what i have done already is good enough? Would someone be able to advise as i want to get this done this week if poss? Many many thanks Lisa x
