  1. Hi Spam, I had a look through the templates but nothing seems appropriate for this - any ideas? I have put this off for this long but the hearing is on the 18th and i really need to get my finger out! Lisa x
  2. Hi Gladstanes, I too have a SPO with them and have fallen into arrears with it. To be honest, so far they have been ok as we were paying about £600 over the mortgage payment to clear the arrears but this became very unrealistic and now we just about cover the mortgage. But as the interest rate cut has been passed onto us we can cover the mortgage and pay extra off (hopefully)! They have been ok so far but i do keep them up to date with what's happening and i pay what i can each week so they know they're getting something. We also have arrears on a secured loan of theirs which we're also trying to sort. Lisa x

  4. Oh I see! Thanks so much CB - i am soo interested to see what they have on me as it incorporated 2 overdrafts and OH's credit card. He is also self-employed which would make any ppi invalid! Lisa x

  6. Hi CitizenB - I know you're right. I think i was just panicking a bit as it's for such a high amount. I suppose what i'm trying to do is look for some peace of mind to know i'm doing the right thing and that i have a good chance of fighting this! I really appreciate your help. Lisa x

  8. Just an update. Hoping to file the N244 this week when i get paid but have today rec'd from Northampton a letter to say it's being transferred to Watford cc for 'enforcement'. What happens now? Can i still try the set-aside? Lisa x

  11. Hi Guys, my sis checked her credit file on-line today (she has not checked for about 5 years)! Anyway, she had a ccj previously from about 4/5 years ago but it's not showing up and a default (now satisfied). The rest is all up to date. Her score is 709 but showing as 'poor' - i thought that was a high score? Although i know that the default isn't helping. So my questions are: why has the ccj dropped off (all good obviously)! and why the score? Many thanks for any help! Lisa x

    Hi italy - i wouldn't touch it with a bargepole! Just my opinion of course but it was given to us by hsbc as a 'this is all we can do for you and we're doing YOU a big favour'! We were desperate at the time and just trusted them. The interest rate is unbelievable (much much higher than a 'normal' loan) - so how they thought that would help i don't know! I am currently querying the loan agreement and have cca'd them so i'm just awaiting their next move. Don't think it does your credit rating much good either but not 100% sure. Lisa x

  16. Hi Supasnooper - thanks so much for your comments. It's weird because it's just one of the things that the good bods on here aren't very sure of and I know they only want to give me the correct info. Yes, I do have a letter from them stating that they don't actually have my agreement so I would have assumed that this would have been enough to set it aside but possibly not! I was planning to do it asap although probably won't have the fees until next week. Again, thankyou for all your help so far and if anyone else has a plan? ....x
  17. Hi Supasnooper - yes it's a set-aside on the ccj that i'm after. I know that this will be a particularly difficult task but surely worth a try? This is what i have been trying to find out since last week but no-one was too sure. Many thanks for your response Lisax
  18. Okay Guys, i have the n244 printed off and need some help please? Question 3: What order are you asking the court to make and why? Question 4: Have you attached a draft of the order you are applying for? Question 5: How do you want this app. dealth with? At a hearing etc. (although i would rather not a hearing - as i'm such a coward)! Question 6: How long do you think the hearing will last? Question 8: Level of judge? Question 9: Who should be served this application? Question 10: What info will you be relying on, in supportof your appl? . The attached witness statement . the statement of case . The evidence set out in the box below... I know I know! That's practically the whole form but i just do NOT want to mess it up at this point especially after re-reading the letter they sent admitting they DIDN'T have my agreement! Thankyou so much in advance - please don't have a go for me not being able to fill this in as well as you Guys! Lisa x
  19. Hi Adamski, will send off SAR today (know i should have done it a lot sooner). We have missed one payment - about 3 months ago and the last one (November's) we tried to cancel and couldn't and although we had changed OH's wages so they were going into a different account/different bank etc, they didn't do it in time and took the loan money out as soon as his wages went in a few days later! Pretty sure we didn't have ppi but you never know with this lot, we could have been coerced into anything at that time! Lisa x
  20. Hi Guys - there weren't any charges on the loan and i don't think any ppi, but not 100% certain. Thanks for all your replies - always appreciated. Citizen - I sent off the letter to them a few weeks ago telling them they hadn't complied fully but haven't heard anything back as yet. Lisa x
