  1. Thanks Spam. Do you know of any templates I could send off to their sols by any chance? Just realised one of our creditors is a secured loan (for about £20k) so equity would be at most £70k (even when the market is back to 'normal') - still a fair amount in their name I 'spose!   2. Hi Scab, to be honest i really can't remember much about this one - will have to try and dig out the paperwork (sharpish)! If they did order payments, we obviously didn't keep them up (wish i'd known about cca's before then)! Would it be worth contacting the solicitors now and arranging an agreement to show the court we're serious? Long shot I know but here's hoping! Lisax I bumped up my other thread SH (as per PM) x
  3. Hi Spam, Yes it's jointly owned (debt is in OH's name only) Yes - loads of other creditors! Have 2 kids and no medical conditions CCJ is for £3265.67 Honestly can't remember whether we have or not since the ccj Yes, there is about £90k in equity Lisa x

    Right an update! - Still no further on with OH hsbc cc cca (which is the one in court at the moment) but I also cca'd my own hsbc cc. They firstly sent back the usual 'phishing' letter asking for a copy of my sig - which i obviously refused. Then today I got a this: Thankyou for your recent correspondence. 'I regret that I am unable to provide you with a copy of the original application in respect of the account. Section 78 (1) of the Consumer Credit Act 1974 requires us to provide a copy of the executed agreement if any. regulation 3 (2) of the Consumer Credit (cancellation Notices and Copies of Documents) Regulations 1983 allows that certain items maybe omitted from such copies, including the signature box and signature. Therefore, the copy of the executed agreement we must supply is a copy but need not be a photocopy of the signed agreement. Regulation 7 of those regulations also requires us to provide a copy of the executed agreement, as varied, where there is a power to vary the terms of the agreement, which there is with your card agreement and that power has been exercised to vary the agreement, which again is the case with your agreement. We have therefore enclosed an up to date copy of the terms and conditions applicable to your account, a copy of the latest variation notice issued in respect of your account and a blank copy of the agreement form. The agreement form contains the original terms and conditions that you accepted when you entered into the agreement. Clause 6 gives the Bank the right to vary the terms and conditions. The variation notice shows that the terms have ben varied and therefore in accordance with this legislation the up to date terms and conditions are the appropriate information to produce. I have returned your £1.00 fee as there is no charge for provision of the above details. Should you require any further information or assistance please telephone one of our representatives on ....... Now this card was taken out exactly the same time as OH's so i'm assuming they haven't got his either so that's why i'm very keen to stop this court claim of theirs before it's too late.   8. Hi All, today I rec'd an interim charging order (first time for one of these)! for an outstanding store card amount which was ccj'd in March 08. The application is to be held on 18th December at Bradford CC (I'm at the other end of the country)! Now I'm panicking! - We must have agreed an amount with them some time ago but in all honesty, I have so many creditors to deal with, and i hadn't heard from them in ages, i completely forgot about it. We can afford to pay them a small amount each month but is that too late now? Many thanks in advance for any advice Lisa x

  13. Hi Citizen, i did blank out the account number which was on the top left (i think) of each page. Not sure what a 'demands needs and recommendation statement for the managed loan' is but pretty sure i haven't got one! When i'm on internet banking, i can cancel any other DD or SO but NOT that ML. Will defo report them to the FSA for that. Thanks again Lisa x

  15. Thanks SH - will get that off to them first thing in the morning. They attempted to take a loan payment yesterday but as we were overdrawn it got knocked. We have tried to cancel it but it doesn't let you do it - shock! We have now started having (finally) our wages paid into another bank so that they can't get any more from us. Fred - i didn't notice the dates of the payments, another cock-up of theirs! Many thanks again Lisa x
  16. Found my 'phishing' letter from them - panicked and thought i'd chucked it! But got it firmly in file now. Is there anything I should be doing now? Or do i just sit tight and wait? Any letters I should be sending? many thanks in advance Lisa x

    Hi All, just updating my thread with a cca for a hsbc cc I sent off recently. The thing is, it is already at court stage (i acknowledged it some weeks back). It was when they sent me the court claim that I cca'd them. So my question is, what do I do now regarding the claim? When I go onto mcol, it's a bit confusing (not that it takes much)! I don't want to mess it up at this stage. many thanks in advance Lisax
  19. Thanks SH - well that's certainly given me a glimmer of hope! You're right it was 5 separate sheets of paper. With all the support on here, I'm sure I can stick it out and go the course. Funny enough they have today sent another phishing letter for my credit card cca! Many thanks again Lisa x
