Thank you for all the kind thoughts!! I still haven't had an offer so am waiting for time to tick down on my MCOL claim!! My partner got an offer yesterday (& he started his claim 2 weeks AFTER mine) by phone which at 1st he accepted, but today he phoned back & haggled until he got the amount he was claiming...£601.00...not bad eh??!! My claim is for MUCH more so maybe they do draw it out longer, I'll keep you posted!!

Hi Star2544, The LBA is the Letter Before Action which gives them another 14 days before you file your claim at Court.

Hi ajd01 I phoned the Halifax twice last week + sent 2 e-mails as my LBA was due to expire on the Friday (16/02)...nice people on phone but didn't get anywhere, no replies to e-mails so my claim was filed for Court using MCOL on Monday 19th Feb. Some people seem to strile lucky & get it all sorted with a phone call, I suppose it can't hurt!! Good Luck!!

Hi barbershop0, I filed my MCOL on Monday gone & when checking my online account today I too noticed that my overdraft limit is showing as "N/A". I phoned up the general number to be told that I do still have an overdraft but I don't know why it says "N/A"...has yours altered or stayed the same?? & Good Luck...hopefully we're almost there now!!

Hi confolensdream, I filed my claim with MCOL on Monday...it does seem a bit scary doesn't it?? I believe you can add on charges right up to entering the case to Court & Yes, you now need to send 2 copies of your charges spreadssheet including the 8% interest added on. There is a covering letter to send with your spreadheets, I think it's with the template letters. If it's not there give another shout!! -
Hi mr&mrs, I phoned twice & e-mailed 2 times the Halifax last week as my LBA was due to expire on Fri. 16/02...very polite people on phone but no joy!! So, I filed my MCOL claim on Monday 19/02...they were given the chance to settle before interest was added on but didn't seem to want to!! More money for me then!! Let me know how you get on!!

Well, I entered my claim to Court today using MCOL!! Just have to wait & see now.

Thanks for your replies & help...I submitted my S.A.R. on the 11th Dec. 2006...so I guess my claim should start from 2000?? However, I only have 1 charge in 1999 which is the 31/12/1999 one & I've already included it on my spreadsheet to the Halifax...I'm getting all confused & jittery now that it's time to enter the claim to Court...HELP!!:o

Hi, My bank charges are from 31/12/1999 to 05/12/2005 but of course I'm only submitting a Court claim NOW in Feb.2007...does that take me over the 6 year limit?? Since 05/12/2005 I haven't had any charges & from 31/12/1999 to 05/12/2005 is 6 years but how will the Court view it?? Many thanks for any help!!

Hi aceabo, Am going to file claim via MCOL on Monday, I was hoping I might just hear something before then, but I haven't!! I did phone again on Friday (spoke to a nice man, Ray) who told me my case is still being reviewed but it "looks like" I'll hear something in next 2 weeks!! I'm sticking to MY time limits & so court it is on Monday!! Thanks for asking about my claim.

Hi diablo, I'd accept the amount they've offered as a partial payment but tell them that you'll still pursue the outstanding amount, via the courts if necessary!! I'm sending my claim to court on Monday as I haven't yet received an offer from the halifax, we could also do with the money NOW but I want the full amount!! Good Luck!! -
