  1. As my a/c is well overdrawn, Customer Care Collections & Recoveries are dealing with my claim, is this likely to affect the process?
  2. yes, because they haven't refunded the interest. But there's no guarantee they will, but as far as I know, it would go your way in court- in the cases I've read

I don't think they will pay out to be honest, If you've read my posts on other threads, you'll know I worked for HBoS until earlier this year, they rarely pay compensation, unless they think if reported to the Ombudsman/FSA they will get wooped- so It's like a deterrant. Not really sure what to suggest, but you could tell them you'd like to refer this to the Ombudsman, they will arrange that, possibly then accept the offer, as the charges, and your complaint are 2 different issues, and although linked, you may be best going to the Ombudsman about their Data Control/Potential DPA Breaches (where's the missing letters?!') But I'd see what the other guys on her say first?

  6. yes, definitely. You can claim back upto 6 years on an account in your name/joint with your name on. (My account was passed to Blaire, Oliver & Scott- they passed it to wescot, who passed it to someone else.) mine is going through fine!

  8. no, its not 8% on each charge, its 8% Interest on the charge(s), if you use the spreadsheets, it should calculate itself for you?

  10. ah right, no, it won't touch the Halifax, it will be BACS themselves, or the company bank if they are quick enough, don't worry- there is tens if not huindreads of thousands of recalls a day. I worked for the Halifax & BoS side, and there was 90 people doing recalls alone. and calls queueing for 25 mins, they do work, and there really really isnt anything to worry about!
  11. depending on how nice your payroll are, it may be that they want to get the money back (upto 3 days) and then send it to your Alli a/c, (3 days), or they might just call to check it was recalled, then they can pay you straight away. does that make sense? sorry I feel like im going blah blah blah!! lol
  12. They have just given me a script load of **** on the phone, Halifax reserve the right to blah blah blah................ HBoS disagree with the OFT statement, however have blah blah blah, refer it to ombudsman. WE SHALL SEE ABOUT THAT THEN!

I worked in BACS recalls @ Halifax and as long as HR give correct details, they CAN'T touch that money- there is no manual intervention- except that they key the expected details in, and this is 'picked' out as soon as the credit comes in- if they touch it, blame pay roll, because it means they provided inaccurate details!
  14. So...... It appears that the mysterious mailman at Halifax H.O. is losing the post again!!! I have just spoke to them to confirm reciept of my prelim and no, not recieved. So, instead of posting it to go through the weekly rigmarole again, it's been e-mailed. We will sit, and wait, and wait, and wait. Oh yeah, I reminded them that their 14 days- much to her disagreement, would still stand from last week.

  16. The Halifax's Automated system should stop calling once an agreement to pay has been made. My mum has complained because one company use asks you to enter your date of birth, house number, post code. and account number/card number! chuff me, fraud prevention? oh dear!

  19. Evening all! I've just been thinking..... When you file a claim, are you able to claim for: 1) Time- based on the minimum wage, the time CAG members spend claiming is worth a fortune. 2) Stress- goes back to opening the sodding account, then the charges go on, then you can't afford them, so they ring you, and keep ringing, and ringing, and then ringing at work, etc! anyone any Idea's, or shall I be a guinnee pig?!
