  1. I don't remember ever having a DN from ge my SAR is up shortly nothing has arrived to date. The account has been sold, and they have sent letter saying they are going after a CO nice of them to tell me. Am I right in thinking a CO cannot be taken out to a CCJ is broken ie missed payment on one. The account still doesn't show up on the cra's as defaulted it has charges and is less than 10% of my total debt, my home has no equity either. A few facts I bet they are blissfully unaware. Whats my best tact the DCA hasn't fully fulfilled my CCa in my opinion as no full T&C and no reverse of CCA? Any advice will be gratefully taken. Pumpytums
  2. Hi M&M, I found a thread on CAG this weekend they change the account numbers when the account is basically sold off "Charge off" . Not sure why. When I spoke to MBNA they did mention something about the new number. Give them a ring on 0800 062062 get through to customer account services and ask them when it was sold. My date was very interesting as I would imagine yours will be. Can't wait for my SAR info. Pumpytums
  3. Just a quick observation, where is the credit limit on the so called credit agreement/application form ? Have I missed it? Welcome to the MBNA cart before horse club they did the same to me but sold it a few weeks before their DN was up. oops Pumpytums
  4. Thanks Bazaar, I think they are pretty stuffed all info is back from SAR (40days is up) and nothing about account upgrade. I've never used the "advantages" I think I tried a few times but nothing ever came of it eg phone insurance (no certificate of insurance received) warranty upgrade (item not eligible) blah blah blah etc. Cheers again Pumpytums
  5. Can somebody give me the address to send the preliminary charges letter please I'm trying for the hardship route which is true? Should I also use the same address for my advantage gold miss-sell? Thanks for the tip Bazaar on the Advantage Gold miss-sell over £1000 paid for nothing, I will have that back too thank you very much. As predicted SAR showed nothing I think it was a telephone sell job, so no signature or record exists just the change in fees on the account. Would it be OK to put them in separate letters in the same envelope? I know its tight but its an extra £1.14. Thanks in advance Pumpytums
  6. Cheers again vint I phoned mb today to find out date of sale lets just say it was well short of 24 and more than the initial date on the dn. So you were right I took the name directly off the dn on cra site i have screen shots and pdfs i can tell you. Not sure if i mentioned this the dn shown on cra is dated before the start of dn from mbna Pumpytums

  8. Thanks again Vint, ok the following now begs belief I have checked my credit file the last month nothing from MBNA. Now out of the blue pops up a default from Viil - Experto Credite Ltd How the hell can they file a default the original debt was not with them. A debt cannot be sold until defaulted am I right? And only the original company can file a default. The last digits match the original MBNA agreement shown on the default. The default from MBNA and the original letter from Experto do not. Further more the setup date is wrong should it be the one on my so called CCA? The default date is the end of last month I have a letter clearly stating the default date was the 23rd. The date the file was updated was shown as the start of this month. I only signed upto Equifax the middle of the month and it wasnt there its just appeared in the last week. Double checked this I have saved reports from 14 19 and 30th of this month it shows up only on the 30th one. Its not on experion. What the hell are they playing at??? Are MBNA actually Experto, but Varde Ireland bought the debt allegedly. I have a feeling some back pedalling is going on maybe Experto/varde have realised they bought it before the default expired and have now adjusted it to suit there own needs. So to sum up Mbna defaulted me on the 24th (no default on CRA) Varde bought it on the 23rd (from letter from experto) Experto defaults on the 31st (how???) It looks like it was sold, defaulted ( not registered) then defaulted again. What an absolute mess.:eek: I cannot believe these companies can deal in such a manner. Your comments are very much appreciated. It looks to me like I need to approach a solicitor, there are some serious breaches going on here. Pumpytums
  9. Thanks silver, I actually thought it might be, the overleaf bit was a grain of hope. Do you thing that the CCA has been fulfilled though? I'm still waiting for my SAR so I will be claiming charges I may be able to come to a F&F with DCA using those. What the general selling price for debts? 10% I will put my monthly offer in writing and hint at a final offer. Probably worth me giving them a rough I&E they can go whistle though for my statements/payslips. Pumpytums

    Hi ltc, I have exactly the same dates on my default as you and the same purchase date by the DCA. If you look at my thread the general consensus is the Default is junk, no clear 14days (it was sent 2nd class) and also no arrears. (keep your envelopes they are marked with company address) Also the account number on my agreement is completely wrong. Can you check your credit file? My default is not showing or the original account. Have you SAR'ed MBNA yet as many CAG's have found out the account was sold way before the 23rd. I hope this helps. Pumpytums

  13. Good point Andrew. I have no equity in home so Charging order would be pointless and very little free cash. Ok can I have some comments on my CCA please? http://i227.photobucket.com/albums/dd74/pumpytums/ge.jpg I can see a few flaws :- 1. there are a few references to "see condition 6.xx" where are these? 2. In the paragraph between the signature boxes it clearly states "Use of personal information" in the terms and conditions enclosed and overleaf. I have not been supplied with these and certainly not the other side of the document. So minimum that have not fulfilled my CCA so the account is in dispute (it has been sold on) 3. APR's are listed but no monthly interest rates nothing about additional costs for cash withdrawals etc. Is this agreement enforceable its from 2006? Pumpytums

Shame they sold it on while in dispute and before DN expired, and fluffing up their DN. The coffin has more nails than wood I feel. Very happy about the lack of PPI, I certainly don't remember asking for it over 5 years. Pumpytums

  16. Found an unopened letter in the porch today its my CCA, which oddly came from Experto. I CCA'ed MBNA direct well over a month ago. The CCA is almost identical to Weirdbeards this is his I will add my link tomorrow. http://www.incarnis.com/MBNA.jpgs It's spookly similar but mines from 2004. One a plus point their is no PPI shown which they have charged me for years, so I'm going to try to get that back plus all the charges. Pumpytums

Just a word of warning I have just removed my DN and letter from DCA looking at mine and another DCA letter to a recent member, I noticed that a line in the address at the bottom is subtly different. Could this be a tracking measure for posted letters? I could be being very paranoid but it is different and with no reason for it Who knows?? Pumpytums
  18. Hi M&M, just read your thread, amazing similar to mine (as you said on my thread). Out of interest the date on the Varde letter was it before the default was up? MB*A are a piece of work, if its any consolation I have heard nothing from credite Exponential or whatever they call themselves since the one letter last month. Don't worry your with friends here.   19. Hi everyone, I have finished filling in the complex bank charge spreadsheet thanks very much for creating that. However I have noticed something (please ignore if this has been mentioned before) Basically the spreadsheet uses the cumulative charges takes them off the current balance and uses a ratio of (corrected balance/actual balance) * months interest to calculate the proportion of the months interest thats owed to you. This is great however I feel that this proportion of interest should be fed back into the calculation so its cumulative so we get (corrected balance+cumulative charges interest)/actual balance * months interest This will give more interest on the charges as the calculation will take into account the cumulative charges. I will try and modify the spreadsheet to do this. Thanks Pumpytums Please ignore the above, I have just realised that the method would be compound interest which is a can of worms.
  20. Glad to have you aboard M&M.:D My CCA went September-ish NO response, but confirmed received py Post Office. The SAR was sent October-ish also confirmed by Post Office. To date nothing, just a letter from DCA of new owner. Its a shame really because myself and MB*A used to be such friends the calls the letters the postcards, I do miss them. With regards to the SAR is it 40 Working days or just days? Because if its the latter time is running out. Pumpytums
  21. Thanks again bazaar, so far my SAR has yielded a mountain of statements, but not much else. I havent received my termination or default notice from the SAR, In fact I don't ever remember getting them but I did go through the denial and bin it phase. Something I'm glad to say I'm very much over:D:D. The 8% makes it a very healthy £2k+ unfortunately my OD amount is £5k+ As the account is now terminated/defaulted do they have to send my the charges or does it get knocked of the default? Pumpytums
  22. Hi Bazaar, thanks for the reply, I don't really remember signing anything I think it was done over the phone. I believe it was the old well you use your overdraft every month so have all these extra shiny things that you won't use (Which I never have), I think they used to reduce OD interest a long time ago. (they used to charge £6 to use your overdraft for the privilege of charging interest on it) I will have a look at your thread, thanks :) Pumpytums
  23. Hi, I have now calculated my charges going back to 1995 which is £1k+, I have also used the complex interest spreadsheet to calculate the interest charged on the penalties £500+. Where do I go from here do I contact Natwest asking for the £1500+ I should qualify for the hardship track? As I understand it the 8% cannot be added until a court claim is started is this correct?   25. Thanks for the advice Vint, A CCA was sent to MBNA and received before the default notice was up. A SAR was sent and received early this month. As the request for CCA did not expire until after the default notice expired was the MBNA account still in dispute when it was sold? I have the envelope from Experto (I put the DN from MBNA and the letter from Experto in it to scan at work) I'm almost 100% I will have the MBNA one too. The Experto has no postmark its 2nd class however, it does have the orange franking lines on though, the envelope even has their return address on which is nice of them. On another note the company they refer too Varde has never contacted me. Just to get things clear by selling the account before their own default notice had expired, what does this mean? As you have pointed out the DN is junk, I thought that the DN was a one shot deal get it right or its just the arrears you owe which then have not mentioned. I have a DN from Cahoot which is fully itemised with dates and exact infringements, they have charged £30 per item however this will be picked up a a new thread shortly.
