  2. Mclibel Trial Ok i had a quick look at this. A couple of things immediately grab my attention Uhhmm you sure you have the right case? a Mr Morris and Ms Steel vs McDonalds and Mcdonalds won damages for £30,000 which Mr Morris and Ms Steel didnt pay (Mcdonalds did NOT seek to enforce it) But the consequent media storm surrounding it did untold damage to Mcdonalds reputation. The McLibel Trial So i dont see how this case strengthens your argument? ok. 2 people standing on street handing out leaflets containing pertinent information regarding uk banking charges. They arent attacking banks. They dont even need to mention any one bank at all. So tell me again how the bank can sue them?
  3. yes! im sending letters from scotland to HBOS england trinity road *then* using moneyclaim(and using address in england) to go through english court system however if you want to use english system without using english address i believe you need to fill out a N1 form? and send it manually. (moneyclaim only allows english address afaik)
  4. Hrmm interesting. I send all my correspondence using registered post (£4.10 for each letter) to make sure it gets there. (guaranteed next day) Can i add these costs to my claim?

Well ive been boycotting McDonalds for years i dont think they are too bothered about it. tricky issue because yes its true you might not have a direct financial link with their immoral practices but somewhere down the line you might. (2nd order, 3rd order etc. If you imagine 1st order connection being something like someone vocally and financially supporting something; A 2nd order connection would be supporting something behind the scenes through another, perhaps more ethical, company) Also sure it might give you peace of mind to know that you arent willingly supporting the banks but that doesnt stop them screwing over everyone else. If you see someone commiting a crime do you do what you can to assist? ; prevent them? or walk on by taking no part at all? The vast majority of society chooses to not engage at all (ie neutral stance: walk on by leaving to other authorities to sort out i.e. they abdicate their personal & ethical responsibility into the hands of state ethical authority. That is, the state authority acts on their behalf) but prefers to continue with their normal day to day lives. But im not judging you or anyone its hard enough trying to survive day to day without things like this. CJ
  6. You mean like they do when people claim charges back from them. Do you have a link to this? Or a reference to the case i can check when i go to the law library later today? or perhaps its on Westlaw or Lexisnexis? Ehh?? Could you explain how its possible a peaceful demonstration informing members of the public that their banks are unlawfully charging them extortionate fees could possibly be interpreted as bringing about NEGATIVE public opinion! :?

  8. aarggghh!!!!!!!!!! just realised ive started my letter with smt like i am very disappointed that you have failed to respond to my letter of the [XXDATEXX]. But they DID reply to my letter wirth usual blah blah will investigate in 4 weeks time. bugger! what do i do? ive already sent the lba. Or it doesnt matter?
  9. hrmm maybe. Note that it says this though "relating to charges applied to the aforementioned account up to and including the date hereof" So it is saying you cant claim again for any charges prior to this date. Therefore it is fine to raise action for any new future charges that the bank may inflict on your account. Or does it??? or maybe it is just legal waffle maybe see if someone else can comment In my case with HBOS. I will probably raise another action with them because i have only claimed up to 31/7/06 and im sure they have put charges on my account after this date.
  10. What kind of discharge is it? Confidentiality clause? Does it prevent you making any other future claims against Abbey? You could accept it only insofar as it relates to this action brought against them and it would have no bearing on separate claims being raised. Indeed why should it?

  13. The protest/demonstration would not attack specific banks. If it did then yes they might have cause. If all it was about was informing people then dont see what the bank could do really. Do you have an real world example or is this all conjecture? Because you have a lot of IFS and maybes in there. The bank can say whatever they like but it wont stop a legal demonstration, trust me. After ive done my case (if i win) i'm thinking about doing something close to (but not infringing upon) my local Bank. I'm a bit late to do something for university freshers week though hrmm. But no there wont be more than 12 maybe just 1 !! So i'll let you know how it goes when i get arrested in front of the bank ehh! (although i'm about 99% sure that the police wouldnt do a thing!)Obviously i wont make any mention of CAG in case you guys get sued or whatever. I'm quite surprised by CAGs reticence though and reluctance to take it to another level.

  16. a restraining order????? ehh??? on what basis?? Uhmm i dont think so. Unless the demonstration is unlawful then it has every right to peacably protest/inform. Bear in mind that the banks can already close accounts with utter impunity. Your response seems to be that it is not adviseable to hand out leaflets because this will enrage and annoy the banks yet further. I would suggest that we are already at war with the banks (asking for money back and issuing court proceedings against them kinda sends a signal to them dont you think?) and instead of passifying them we should be attacking them on all fronts (legal fronts of course ) cry havoc and let slip the dogs of war!!!! :D Yes i think the bank would be able to get the police/council representatives to remove the demonstration/reject the demonstration if it was literally on their doorstep but if its not anywhere near them then shouldnt be anything they can do about it. (provided the 'demonstration' itself has went through the proper setup procedural channels) not a chance in hell. Which law is this which allows the police to intervene and arrest peaceful protesters?   17. thanks. I have a relative in england who i may be able to use as a forwarding addresss so i should be able to use moneyclaim online yeah? I agree it seems a much preferable route to go through the english system. (£5000 small claims limit) Any chance a mod could put the pertinent information in the Scotland guidelines sticky for others who ask about this. Or put it in the relevant bank forum stickies e.g. Halifax and Bank of Scotland (as both have english and scottish headoffice ie HBOS group) Would save a lot of people severing claims no?
  18. ehh? vindictive about litter that is caused??? to who? but you dont target one bank specifically on the leaflets. If this kind of practice is good enough for political parties, charities, interest groups, promoting any kind of event at all! then i'm surprised and puzzled why it would suddenly fail in this case.
  19. cheers dudes. im starting in scotland but going to court via english system (moneyclaim) as it seems a bit more straightforward and its also possible to claim the 8% interest. ie send LBA wait 14 days fill out online moneyclaim form and submit wait to see if bank defends WIN!WOOO!

  21. congratulations!!! :-D I thought they had decided to defend it? Did they send any letter, send you a cheque or just credit your account with the full amount (inc interest) and it only took a few days from when they decided to defend from when they decided to surrender? :grin:
  22. how about a marketing day near a popular bank? during rush hour.. would need a group of volunteers to hand out leaflets and t-shirts and explain how the banks are acting unlawfully etc (with appropriately witty slogans on t-shirts etc ) t-shirts banner A3, A4 posters guidance leaflets on what to do to e.g. Mobile Billboard Advertising UK - Posters On Wheels (very expensive though!) Could maybe generate enough publicity to get a mention in the local papers. Either that or phone/email a couple of local reporters to get them to come along. Sometimes sheer persistance and nagging at local mps and newspapers might get them to pay some attention.
