  1. I've had nothing from the Halifax regarding the court case, just notification from the court that they intend to defend. Hopefully the only thing I get now will be a fat cheque! Good luck with your case, Julie.
  2. Congratulations - I'm still waiting for the postman after Halifax acknowledged and said they'll defend. it's definitely giving me hope reading that so many people are getting their money back! now enjoy your beer

Oops, sorry Bluecloud, i sent the letter yesterday. i am really angry about what they have done recently, especially as they offered to rescind further charges as a goodwill gesture (I have it in writing) yet still added more on. Hopefully like with most organisations one hand doesn't know what the other is doing and those deciding whether to pay up won't get wind of my complaint! Sthurley and jackboy, good luck!

  5. Just before I went to the Post Office I found another statement that must have fallen off the table, with another £20 charge on it - so I'm now going for £412.
  6. i can remember coming across an excellent email on here that you could send to friends to alert them to the whole scandal of bank fees and the wonderful place that is this site I was going to send it to a community forum I'm a member of - but can't find the email now. Can anyone help please? Also, could someone please let me know how you change the subject line of posts? I've got two claims going on and changed my subject line to include HELP PLEASE! as i needed some advice - but the changes don't show up in the list of threads. Thanks!
  7. I filed the claim with MoneyClaim on the 17th Oct and it was acknowledged by Halifax on 20th. received the notification that they plan to defend it all on Tues 24th. Not had my money back yet but fingers crossed it comes through soon

  9. Well I've been through my statements today and they owe me £392!! That'll clear half the balance and take it back below the limit, which will make a big difference. I did fill in a spreadsheet that calculated the interest paid on the penalty charges but i wasn't sure if I was going about it correctly - I only have the monthly interest charged to each statement, and from the spreadsheet it looked like they owed me £1.05 interest for a charge applied last month and only 7p for one from 2004!! So something must have gone wrong there. Does anyone have any advice please? I've just written a preliminary letter and have put: "I calculate that you have taken £392 plus any interest you have charged me for these penalties." If I can work out how to do it and it's worth claiming, I'll add in the actual amount when i send the LBA. Okay, it's going in the post today!!
  10. I'm not planning on paying, I'm more than happy for them to take the charges from the returned charges but can't afford to clear it in the meantime. Are there any templates that I could send to let them know the situation? I had a look in the library but couldn't see anything suitable.

  12. Just had a letter from the Halifax: I've checked my account and they haven't paid up yet, and there's still ten days to go till the deadline. This overdraft is made almost entirely of their fees which is why I haven't done anything about it - I'm planning on clearing it when they pay up, then transferring the rest of the money to my new account (as I haven't used this one since the end of July). Is this just a scare tactic? Should I be worried? is this actually a Default Notice as they hint at, even though it doesn't say at the top that it is? What should I do, anyone??!
  13. Good luck with everything. I got a similar letter offering to rescind charges at the end of September - all very nice, except that the left hand didn't tell the right and they still added another £39 at the end of the month, and emailed to say they'll be charging more at the end of Oct and Nov! Don't believe a word they say Just keep well informed on your account and remember that you can add charges to your claim right up to the moment you submit your court order. Don't be scared - looks like thousands of people here have got their money back and they're all really friendly and helpful.
  14. Good luck. I'm in the same boat though I haven't had any phone calls, just lots of threatening letters. Considering I have the kind of account that they're not allowed to let go overdrawn, they were very kind to let a cheque clear when there was £5 insufficient funds, and then to add over £200 charges on in the following three months! Sad that when they do pay up, £200 will be instantly swallowed up by their costs, but I'm determined to get it all back from them. Bar stewards!!
  15. Just got home to find a letter from the court saying that Halifax intend to defend the whole claim. This is getting a bit nerve wracking now - I know from reading posts here that they always say they'll defend and then pay up anyway, but i don't really fancy going to court if I can help it. Oh well, I guess it's just a case of wait and see now.
  16. Just checked on the MoneyClaim site and the Halifax acknowledged my claim on Friday despite the summons not being deemed served till today. Fingers crossed I'll have some money within the next few days!! This is exciting

  18. I'm really hoping it doesn't come to it but I would if i had to, no point in going through with everything else if I'm not prepared to go all the way. Just about to read BookWorm's thread but have any of the bankds (or Halifax, to be specific) actually taken it that far? I'm hoping that their partial offers are actually an admission of guilt!
  19. Congratulations on getting full settlement. Can I ask you how long it was between the summons being served and you getting the moeny/ I put in my MCOL claim on Monday, it was issued on the 17th and the site says it's been "accepted" - what happens next?!
  20. Hi Wicky, I'm at the same stage as you, the court summons went in Tuesday morning. No idea what happens next, from what I've heard they say they're going to defend but then pay up anyway. Good luck, hope you get some news soon.
  21. Good luck, hope you get somewhere with them. I don't think multiple accounts is a problem, I'm taking action over 3 accoutns and they seem happy to deal with them and made me an offer acros the three - turned down, of course!

  24. had a letter from Halifax yesterday making me an offer of £439, which is a very reasonable 50% of my claim - but of course I won't be taking it! I've got a couple of questions now though, can someone help me out please!! 1. Do I need to contact Halifax re: the offer or do I just go ahead and put in my MoneyClaim papers/ The deadline is tomorrow. 2. I've already had letters telling me that Halifax will be adding charges at the end of October and the end of November - do I add these to my claim on the grounds that they are definitely going to be added whatever, or do I have to either pay up or claim these separately?
