  1. SOrry to bring an older post back up, after looking into my credit file I too have 3 accounts that Lowell have registered at my old address. Do you simply write to them stating you don’t acknowledge the debts shown on your credit file however you’d like them to correct your address? All of mine are due to go SB this year/early next so need to know any letters will go to correct address. Thanks.
  2. So should I fill in form requesting more information so the time passes as they are meant to reply with the info?
  3. 19th January saying if they don’t hear back by 22nd February they’ve been instructed to issue a claim. How does the statute barred date work with the dates on this letter? Do I need to send them anything ? Should I say I disputed it and my reason being I don’t recognise it? By time they reply it’ll be after the 28th Feb?

  5. The saga with Vanquis continues... Told this morning that they don’t have the information or are able access it! Told them about fraud and data protection and making a complaint to information commissioners office. Some manager has gone off to look into it... Why have I got a feeling he’ll ring back still claiming they can’t get the information. Then what do I do?

Hi, After going round in circles with Vanquis I spoke to them today and they are apparently unable to see the information and were trying to get us to send a SAR request but obviously we don’t have time seen as BW Legals letter says payment or response by 22nd Feb before they issue court proceedings. A supervisor is requesting the Information from a back office team and claims this will take upto 7 working days As that’ll take us upto 8/9th Feb I guess that’s ok? Do you recommend to wait until we find this info out before returning the reply form asking for more info? Thanks.
  7. My wife rang Vanquis this morning to be told they are apparently unable to see any information on the account as it’s over 4 years old? They could see the account but not access anything on it? Should I just proceed completing the form as previously mentioned and send the CCA request to BW Legal? Thanks.

Hi all, Today my wife received rather thick envelope containing letters from Lowell and BW Legal, containg a reply form, which after looking about online seems like a new thing (pre action Protocol?). My wife hasnt heard anything about this debt in a very long time, plus we moved home last year so that possibly hasnt helped matters. The debt is for Vanquis Bank (Credit Card) and was defaulted on 31/10/2012 - no payments have been made since before this date and its approaching being statute barred. Whats the best way to proceed WITHOUT acknowledging the debt? Do I tick boxes D to dispute the debt and tick box I and ask for more information? If so what information? Should I also sent a normal CCA letter with the reply form? Do I now just deal with BW Legal seen as all this has come from them as Lowel say it has been sent BW Legal? Many thanks Martyn
  10. Thanks for your help Which prove it letter is it I need to send to 1st credit? Is that a cca request or is it different being a bank account? What is the benefit of sending a sar to Halifax? Sorry I'm not clued up on all the dealings with creditors. Many thanks
  11. Spoke to the bank... Bank account was closed and defaulted 28th Augustus 2012 Last account transaction before being closed was a transfer on 4th May 2012 However, after it's been closed a mistaken payment was made on 23rd June 2014, which was then reclaimed and sent back to the correct person? Don't know if this would affect anything as has nothing to do with me. Also a payment for 1p was made on 29th October 2013, they couldn't see where this was from as it was after the bank account t had been closed. I'm guessing possibly a savings account I held with them that they closed and transferred the balance as I have never sent 1p anywhere. Where do I stand now and when does the statute barred clock start from as my real last usage was 4th may but obviously other things have happened after. What do I do now, is there anything I can send 1st credit? Many thanks.

  16. I honestly couldn't say. I switched bank accounts as I'd lost my job at the time and couldn't afford the charges going on the account each month.
  17. Hi all, Recently moved home and started receiving letters from 1st credit regarding an old bank account that had an overdraft and now with charges etc £3000 is owed. I've never acknowledged this debt and it was defaulted in august 2012 and don't particularly want to acknowledge it either, however I don't want a ccj as just starting to get sorted out with debts until this arrived. As the title says, a letter arrived today saying they are considering making a county court claim, maybe they are maybe they are trying to push me I dont know. Is there any letters I can send them like a cca for a credit card where I can get them to send me proof they own the debt and that I do actually owe it and proof a default notice was issued as I've never had anything that I remember but it was a long time ago. Good evening, Well it hasn't taken them long to issue the Letter of Claim which arrived today. ive got until 10/10/16 to respond to them or they'll take me to court. where do I go from here, I really can't have a ccj on my file with wanting to apply for a mortgage early next year. should I a: send them a CCA request? Does this stops them taking me to court until the documents are provided, is this correct? b: tell them it's statute barred and that as a gesture of goodwill I could pay 10%? Or is this just acknowledging the debt and a stupid idea? how do I defend a claim, I've got no idea what I would write. also could you tell me, if I did go to court and lost, if I paid the balance within 30 days does the ccj not get added to your credit file therefore it would not show on future credit applications? Not that I have that sort of money spare at the same time! many thanks from a very stressed me. Martyn If I send a CCA request do I also send them a statute barred letter at the same time? thanks
  19. So do I tell them it's statute barred and hope that's an end to it (them taking court action) or not? Do I have to go to court if they issue papers and how complicated is it to defend it saying it's statute barred? I feel very lost with this.

  21. Hi, I haven't contacted Lowell yet and reading around on the internet it looks like someone once told them their debt was statute barred and they said it's 6 years from the default date? Is that Lowell just putting pressure on people saying that or is it correct? Thanks martyn.
  22. As long as they can't issue a ccj against me that'll be good,if they send letters but I know they can't do anything I'll be able to relax a little more. Sorry what's the CONC rules, and what letter do I send? Your help is greatly appreciated. Martyn.
