Thanks Brigadier2jcs I am not really contesting the acceptance of the agreements per se. what I'd like to achieve is a freeze on the interests , claim back any unreasonable charges , agree an affordable repayment plan and remove the defaults from credit file. I know you don't approach these credit companies begging or else they will take me to the slaughterhouse. is it ok if I CCA all of them and SAR JD and Capquest?

I discovered that my partner's credit history is in serious problem with several defaults from mail order companies when we opened an equifax credit report for her. all of these debts are from mail order companies. I think the late penalty charges all started very small but increased exponentially and she got scared and stopped paying for them . I would like suggestions please on how to clear the defaults from her record. The mail order companies are listed below. Mail Order Agency from Capquest Investments Limited.   4. thanks DX for merging the threads. the cooling off period was 14 days but i was on holiday then so i did not return back their renewal schedule till 3 weeks after, but I have already renewed elsewhere even before I went on holiday. I have my CRA file , and the only entry there is a Trace enquiry under "other searches" by Clarity which Equifax has assured me will not affect my credit.
  5. Hi all, I need some advice please. I CCA'd a debt collection agency called CLARITY but to my surprise they sent the letter back together with my postal order. They advised me to make the postal order payable to some new name Laser UK(but they share same address). Are they under their rights to direct me to make payment to another "company" since it is Clarity company that has been disturbing me with default notice for a debt I don't own in the first place? thanks

The bill was dated 29th , and it is my very FIRST bill , I ordered BT broadband and phone November 16 last year , I only got connected 26th Jan.I have checked their terms online below is excerpts 25. You agree to pay the charges as soon as you receive your bill unless otherwise agreed by us. You may also need to pay a deposit or a payment upfront before you can receive the service or goods. If you think that the charges on your bill are incorrect and wish to dispute those charges, you must tell us straight away. You must pay any charges that are not disputed. We will not suspend or end a service while we investigate any dispute. 26. If you do not pay your bill, we will send you a reminder or call you. If we do not receive payment within 10 calendar days of the date of that reminder (seven days if you pay monthly), we may add a late payment charge of £7.50 to your next bill by way of compensation to us for breaking the terms of this agreement. We may also charge you £10 by way of compensation to us for any direct debit or cheque payments which are returned to us because you do not have enough funds in your account. The charges set out in this paragraph are not subject to VAT. 27. We will generally not suspend or end the service or the agreement for non-payment of your bill until 28 days after your payment was due (21 days if you pay monthly). If however you have failed to pay on time a recent bill or have failed to pay a bill on many occasions we may end the service earlier than 28 days (or 21 days if you pay monthly). 28. If you do not pay your bill, we may ask a debt-collection agency to collect the payment on our behalf. If we do, you will have to pay us an extra amount by way of compensation to us for breaking the terms of this agreement. This will not be more than the reasonable costs we have to pay the agency, who will add the amount to your debt on our behalf (this will depend on the amount you owe us). Any extra amount added to your bill will not be subject to VAT. This paragraph applies even if your agreement with us has ended or 21 days if you pay monthly.
  7. I was going to post a fresh thread before I saw this one. Basically I got my very first bill from BT on 29th Jan, 2013 , I paid the bill on the 10th Feb. I got a shocker when I got an alert from Equifax that BT has put late payment notice on my account.I had to do a double check on the BT bill and I noticed it says "please pay by 8th Feb". Ok technically I am 2 days late with the payment , but isn't that harsh of BT to put arrears alert into my credit for being 2 days late? It is not like they have sent out a payment reminder or warning letter .
  8. I have looked at the original insurance schedule but I can't find anywhere it says it will be automatically renewed, could be in the small prints on internet. I think there is a legislation that says they must make it very bold if insurance will be auto-renewed?
  9. Hi, I had car insurance 2 years ago with a company called Octagon Insurance, I did it online. when it came to renewal last year , I went somewhere else. Octagon in their infinite knowledge assumed i would renew with them anyway , so they sent me a renewal quote and promptly advised their financing arm - Creation.co.uk to deduct money from my account and set up a direct debit. I got my bank to refund the unauthorised DD, returned the insurance renewal sent by Octagon , but they have been chasing me for about £200 ever since then. I wrote to them to send me the agreement schedule I had with them , but they ignored my mails. Now they have passed my name to Clarity debt collections , and I found out that Clarity did a Credit check on me without my permissions. They also wrote to me that with their usual threats about putting a default against my credit. any advice on how to tackle this cowboys please? thanks James.
