  1. glad to hear the outcome was an excellent result, we had the same experience two years ago just before xmas so know what you was going threw, time to relax an enjoy xmas an a new year x
  2. also keep copies off all the letters you send them to prove to the judge you are willing to clear the arrears, also when you ring write down the date an who you speak to each and every time.. its so frustrating when they will not let you speak to the referal team. . i wish you luck, if you keep on an on like i did proposing the same offer in writng also verbaly they did then accept the offer., in the new year i will be tryin to find another mortgage company, cant be dealing with kensington any longer.
  3. hi.. sorry 2 hear about you having trouble aslo with kensington, you need to ring them back up an ask if they are going for an eviction, if so you need to see if they will accept any offers you can make always special delivery the letters, if they wont accept any off your payment offers, you must fill in a n244 form an a brief statement on how you can afford to pay arrears plus monthly mortgage, plus up to date expenditure form, you then when you have recieved the eviction date you go to the court where the hearing is with all your paper work plus a fee of £40 to get an emergency hearing with the judge, put your side over the judge then will decide if you must leave your home not kensington, hope that helps.
  4. finally heard back from kensington they are going to withdraw the eviction notice, so relief"d.. if it wasnt for this site i dont know how we would of got threw tha past two weeks, people on here reading what they are going through, & the help & advice from who gave it much appreciated, hope everyone who is fighting to stay in their homes do so., kensington sending letter to confirm what they agreed, new year soon & hopefully new mortgage company, going to change companies.
  5. no i we have not received an eviction date as yet, i am going to a solicitor tomorrow with helping filling in the form, i have filled some in, & wrote out a statement why we need the courts to suspend the eviction, i have made 16 telephone calls plus 3 letters to kensington to except the offer we are offering, will ring them up once again in the morningm most of the arrears are to do their excessive fees, as soon as this is sorted i will be tryin to re-claim any charges back, this will be the 1st try in suspending the eviction do it all depend on the judge on the day or do most judges suspend on the 1st hearing ?, i have been making payments to them.
  6. so are kensington allowed to charge £50 for being in arrears,? as i rung them up & asked could we have a breakdown on the missed payments also the charges they have added on they said it will cost me £20 for the informatiion. i have spoken to 15 members of their staff over the period 23rd october to todays date 23rd november i am sure they just read off a screen in what to say as they all say the same thing "its with the referal team"
  7. yes i have added a income & expenditure form, i asked kensington for a list of what missed payments we missed, also how many £50 monthly fees they have added on to the arrears i was told i at to pay £20 for the information & wait up to ten working days, sinse 23rd of october untill today i have spoken to 15 members of staff i have tried and tried to get the plan back in place, i have paid the default amount up sinse the solicitors letter received in october, but kensington will not listen, my circumstances has changed with more coming in,i have also provided them with that information and still no, worrying isnt the word.
  8. what do you mean statements, i have got a letter for the judge asking him to look at the reason why we are in arrears, and also been trying for several weeks to get payment plan in place, also a income & expenditure form, plus the n244 form, is that all is required ? we are hoping that when we ring back on tuseday they will except the offer, so we will not need to attend court, if we get there will a duty solicitor be there ? if not do you think its worth getting one as got a meeting with one nex week who might be able to help, if we could get legal aid, i could cancel the appointment if you think its not worth it..
  9. thanx 4 ur info i rung tha f.s.a up today they said kensington could charge what they like, as we would of been fully aware of their fees when we took tha mortgage out, contacted kensington again today and offered to get the payment plan back in place, gotta ring up tuesday to see if head office will agree, adn paid £500 off today they finally let me pay that, which was strange as 2days ago wouldnt let me make a payment, we would never have these arrears amounting to what they are if they would stop adding their charges on, if they wont drop tha notice an allow us to get the payment plan back in place if not just wait 4 tha eviction date 2 arrive, then get down tha courts soon as.. keep u updated thanx both 4 ur advice.
  10. i have all day been on the phone with the mortgage company the default figure is £47 not over a thousand pound, also they have been adding on their monthly fees of £50 per month thats why they didnt put the payment plan back in place they always drag it out its with the referal team so obviously the arrears kept going up and up, i verbaly asked could i make the £2k payment they did note it as when i rung again today they mention it to me, saying if i paid that amount the head office could still go ahead with the eviction, even today the bloke from kensington said we can afford in what is asked of us, and do not know why thead office is being unreasonable, so yet again he has refererd to head office in what i proposed today so hopefully (wich doubtfully) they will come up with the answer before w have the dreaded notice threw the post.

  12. thank you for help. i just rung the mortage company and had a break down in what we have paid into the account since court in feb we did not default in august as stated in their solicitors letter 23rd of october, we paid the whole monthly payment plus £100 off the arrears, we have defaulted £732.31 sinse court but not the figure they come up with £1,155.69 start of the default was in september, i have offered a lump sum £2k yesterday they declined the offer an pay every four weeks as they would get 13 payments instead of 12 plus £100 amonth also declined, what paper work other than the n244 ? iam sorry on keepin on to you.
  13. sorry i prob havnt explained myself, we attented court in feb then they put a is it a possession order on the property,? was told to make £819 the actual monthly payments,plus an extra £100 per month of tha arrears, the arrears are £16,000 due to the fact 4years ago i was battling with cancer my partner had to take time off work to care for the children an myself, when we attended court we were ordered to maintain those payments, we defaulted in august just gone due to ( my partner ) did not have any work for the entire month of august we did pay the mortgage just not the arrears, i was short of £400 in september an £74 in october, for several weeks i was trying to get a payment plan in place, they kept sayin send bank statements in which done so twice, then rung up daily for 2 weeks. then on wednesday last week they said they have applied to the courts for an eviction date, what do i need to do ? have not received the eviction notice yet, they said it would be hand delivered .
  14. so could i take that form and all the supporting paper work to the courts today ? as when i rung the courts they said must wait for the eviction letter then ring back the courts to make an appointment to see the judge, also been told they might not have processed the warrant yet has kensington solicitor only summited the eviction friday 16th november, i hate waiting i like to get things done asap.
  15. i rung up the courts and they said that i must wait for the date of eviction and that will be hand delivered letter, they did not have any information they did say ring back before 10am tomorrow to speak to the bailliffs in my area, yes i have 3 dependent children 10.13.16. what other paper work do i need ? ive got the n244, i filled in a income & expenditure form, also a brief letter about why i shouldnt be evicted also a change of circumstances stated in the short letter, its the not knowing what date is the worse, i cant bear the waiting for the letter to arrive. thanks for you advice so far.
  16. so do i wait 4 tha eviction date then as soon as i receive that ring up tha courts 4 an emergency hearing go an attend court with the filled in n244 i can afford the monthly payments plus the £100 per month for the arrears, yes we are sending payments as much an as often as we can did pay £200 over last month in what they was asking for and still taken action to try and get an eviction date, thank you for advice.
  17. help with evictions want to stop tha eviction, awaiting the date what to do in the mean time, received the form n244 need help in how to fill it in what to put, kensington are having none of listening to any payment plan in place being sinse middle of october.
  18. yes making payments, we got in to difficulties back in august when my partner did not have any work, he is a self employed plasterer, tried to get the payment plan back in place kensington kept sayin send this send tha did so then we always had the referal team is dealing with it after 14days of constantly ringing kensington, they informed us they had taken action wednesday 14th november and gone to court to get an eviction date, our tax credits has gone up sinse being in default, sent tax award notice off to them, also my partners work as picked up an got so much work on, so sinse the 14th november i have tried an tried to get them to stop the eviction same answer no, this is a very stressful time so any information/advice would b greatly appreciated

  20. hi iam new to this site:oops: iam just in need of any advice will be very grateful for any information on suspending an eviction date, we defaulted on the court order in august we have been since they informed us early september on getting a payment plan back in place ive sent paper work after paper work off to them (kensington) and always has the same answer ring back tomorrow the referal team got to deal with it, when i finaly rung yesterday they said action has been taken and all paper work gone off to the local courts for an eviction. any help in how to aviod being evicted, i have heard got to fill a n244 form in do 1 of those come with the dreaded letter from the courts or have i got to obtain 1 from the courts in person, just a very worrying time i just want to get a plan in place an all they want is are home..
