Hi Andyorch, i think you missing some points the whole case messed due to Parking fine ltd i received N1SDT form on 11th March then i contacted the parking fine ltd straight away and sent the picture of N1SDT form then they sent me the defence which i filed via email on 13th march 2021 Because i was completely unaware of this kind of case but when i got some advice from here then i tried to AOS on MCOL but it did not let me to login. Most likely parking fine ltd already done the AOS without my knowledge.

Of...... will state as follows: I am the defendant in this case and I make this WITNESS STATEMENT in support of my application to set aside the judgement which was heard at COUNTY COURT BUSINESS CENTRE on 9th June 2021. I make this WITNESS STATEMENT from information and facts within my own knowledge and which I believe to be true. I am requesting to reinstate my case because a third party changed my address and did AOS without my knowledge and permission. I received parking charge notice in August 2020 then i found a website called Parking Fines ltd, who claimed that they deal with these cases for £18 and they have a very high win rate. I paid to the company, then the company filed appeal which was rejected since then this company advised me that only contact the company when i received N1SDT claim form. In early March 2021 i received N1SDT claim form and then i contacted Parking Fine Ltd for the help, I also sent the picture of my N1SDT Form but they asked me for more money which I refused but they agreed to provide me a written defence. After few days the Parking Fine Ltd company dissolved and their WhatsApp . As I was communicating with them through WhatsApp and they never mentioned that they will change the address or do any unauthorized activity without my permission or my knowledge. I submitted the defence on 13th March 2021 via email since then i did not hear anything from the court. I recently rang COUNTY COURT BUSINESS CENTRE to find out any update on my case and i been told that the address is not the same which i told for security, also they told me that the decision has been made against me because I didn’t reply to the Court. The fact is that I couldn’t reply because i never received any correspondence from court to my address till March 2021, I was receiving all correspondence to my address but after submitting the defence on 13th March 2021 via email, I have not received anything. I am attaching my WhatsApp chat screen shots with this witness statement, also refer you to 13.3 of the CPRs which provide in CPR13.3 for set asides where there is 'good reason'. I hope you will consider my request and reinstate my case so i can contest it again the defence is already been filed on 13th March 2021 which is struck due to this error. Statement of Truth I believe the facts stated within this Witness Statement to be true and Exhibits comprising of 2 pages.

Its for the judgement to be set aside which has been made against me without my knowledge as Parking fine ltd changed my address without my knowledge. The judgement made on 9th Jun 2021

Hi FTMDave, i prepared the covering letter and WS but struggling with consent order, it seems like this is the consent order which already been agreed by claimant and asking defendant to sign. But i need consent order sample , which i can ask the claimant to agree and sign. Thanks

Thanks FTMDave for making things easier to taking next step . So for now i have to submit WS PS. i already Emailed my preferred contact number to the Court. Also when you say emailing fleecers do you mean Gladstone solicitor? or the company HX parking ltd? What shall i write to them would that be like a covering letter or like a draft order? I remember when i submitted N244 the court said they will send the copy to fleecers also, so my understanding is that fleecers got the N244 already? Thanks

Thanks for the reply i have read that thread from post 63# but i am still little bit confused. Do i have to write a WS if yes then do i have to write similar stuff which i wrote in section 10 in N244 form. The Court says if appropriate both parties exchange the draft order it means i have to send the draft order to hx parking ltd to agree to set aside?

Hi i have sent evidence with the N244 when i applied to set the order aside and i wrote on the form that why i didn't reply to their letter because third party Changed my address. I did not contact hx parking ltd regarding set the order aside . I will provide them my phone number, do i have to file the defence to set the order aside as well? I filed defence in March 2021 for PCN. Also witness statement - where do i get the template and do i have to send to CCBC or the email they provided in the N244A form? Thanks

I have contacted planning permission several times they dont answer on the phone sent emails but still no reply so now i rely on my defense Can anyone give good witness statement template so i can edit and send the one on sticky threads is not very similar so its difficult to edit that one

Okay now i need to gather evidence from the car park where the pcn is issued. It was night time when i went there for the meal around 12am i think. You can hardly see any visible things i will go to the same car park same time to make a video then you guys will get better understanding

Yes the court acknowledged that they received the defence in March. One thing is confusing as i ticked in n244 without hearing, the case should be set aside? But it means they rejected and allocated the case for hearing?

Defence was filed in march but struck due to no response from the defendant now because everything going the way we wanted so wana be prepared properly

As i mentioned in my N244 i told them that why i could no5 defend due to third party changed my address without my knowledge or consent

I did not pay anything as i am on low income so they did not charge anything there is a form i filled in i think n160

Ok lets see what happens next, but with n244 i also sent n180 form which i was advised by ccbc it was more like a statement of truth.

Any advice ? Its bit relief that my case reinstated but now i need to focus on witness statement and gather evidence night time cos it was night time when the alleged pcn was issued
