  2. hi dx. thank you for the info, the ppi was proved by hamilton insurance, who are part of hfc, but a third party as i have found out. does this make any difference. regards. pt
  3. hi dx + marmaris. i have found all paperwork the ppi was sold by hamilton insurance, part of HFC. i need to get this matter sorted, i know that it was dealt with by the BR. but as the debt is no longer there, and if it was it would be statute barred. i really need to know how to go about this, what i should put in my response letter. i now realise that hfc are playing a game with me, as i am doing this without the help of any ppi claims company. i think they are waiting for me to fold and sign there offer form. regards pt.
  4. hi marmaris. i have been getting conflicting messages, i have been out of bankruptcy over 6yrs, so the debts have been discharged and no longer exist, the ppi was on a discharged debt, but the bank have upheld my complaint, and have offered me an amount of money, but they want to offset it from the amount owed, at bankruptcy. the ppi was mis-sold, an offence in consumer law, so if they are allowed to offset the monies then there is no redress for comitting this offence. any help or advice as what to do next. regards pt.
  5. hi dx. i have now got my BK notice, it is dated 2nd February 2006. i came out of BK 12th September 2006. so it is over 6yrs. HFC was one of my creditors. their letter says it is there final response. they have a form which they want me to sign, " I ACCEPT THE OFFER OF £-------- In Full And Final Settlement Of My Payment Protection Insurance Complaint With Regard To Account No;-------------, Against HFC Bank. I Agree For This Amount To Be Offset Against My Liability To HFC Bank In Order To Reduce My Overall Indebtedness. Is This Something They Can Do, I Have Not Had Contact With This Company Since The Day Of BK, Even If It Was Not Included In The BK, (i know it was.) Then Wouldnt The Debt Be Statute Barred. all help and info would be gratefully accepted. regards. pt.

  7. hi i applied to hfc for the refund of ppi on my account before i went bancrupt (7 years ago.), i have had a reply, but they want to offset the payment against monies owed to them. is this right. pt.
  8. hi, i have read a lot about brighthouse, my partner has had many things over the years, and has paid ocs on everything, the question i have is, the ocs is sold to customers as a must have, but for the first year most goods are covered by the manufacturers guarantee/warrantee, which the workers in the shop fail to inform you. is this not deception. the legal definition of deception is as follows. The Act Of Misleading Another, Through Intentionally False Statements Or Fraudulent Actions. Can I Claim The OCS Monies Paid During The First 12 Months, Of These Agreements, Or Parts Of Agreements Where The Products Where Sent Back. pt.
  9. hi dx. more ppi. british credit trust another arnold clark provider, i wrote to them about a ppi claim. there answer has me baffled. firstly they say that they have no paperwork for my agreement as it has been destroyed after the statutory time limit. but if i was looking for the paperwork for a ppi claim, they can advise that i didn't take out any ppi. how do they know, they have destroyed all paperwork. pt.
  10. hi dx. thanks for the info. one more. if the ppi was taken out as a monthly payment to the 3rd party, would the payments stop when i traded the car in for a new one, or would they claim it all as part of the ppi contract. pt
  11. hi dx, yes that is what i thought, surely if a company takes over another they also take over there responsibilities. another question if you dont mind. ppi i have read that if a claim is more than six years old, these companies do not have to sort it out. but if a claimant has only just realised that they may have a claim, then they can claim within 3yrs of realising there was a problem. i ask this as i am doing this with my o/h who has had mental health problems for the last 6-7yrs. but who is now coming out the other end, and we are trying to sort out his financial mess. all advice in this matter would be greatly appreciated. pt
  12. hi i sent psa finance t/a citreon finance, a ppi request, with the original agreement and ppi paperwork. i got a reply from santander saying they have no paperwork in my name, dont know what i am on about and that they only supply car finance, not ppi. any ideas out there, it seems i have got a fight on my hands. all help would be much appreciated. pt.
  13. hi, i recieved one after i recieved the goods, never sent it back. on the back of my statement i received today, it states that kandco have assigned and transferred my account to Shop Direct Finance Company, dont know where they came from, but i would expect the same treatment some day soon. pt

  16. hi dx, thanks for the fast response. i have read it through, yes your are right, there is a lot of will and buts, in the letter. it is not the threats that have caused this catastrophe. it is the blatant disregard for an agreement made and backed up by 1 e-mail and two letters. do you think that i should get in touch with alan white ceo again. regards. pt
  17. hi silverfox & dx, may i return to the problem of my husband and jd williams, reliable collections, and now moorcroft. i have two letters from mr.glenn taylor of reliable collections, one in his role as account management team, and one which is on jd williams headed paper in his role as account management team, which i recieved after an e-mail was sent to alan white. now we start again, this morning in a plain white envolope came a letter of "Intended Litigation" from Moorcroft, this letter was opened by my husband as it had no real identity, he likes to open his mail, and make small decisions which is his right as a human being. what he has gone through today has done untold damage to his confidence, he has and still is in a dark place, he thinks that i have lied to him over these matters, he is unconsolable, my children have been to our home today after i called them, but he now thinks that we are all conspiring against him, and we have all lied to him. he has not spoken to me since the children went home. i fear that he has now lost all faith in this life, and i can't do anything to help him. i am at my wits end, i do not want to involve the mental health crisis team, as he would never forgive me. what can i do, i have written to these people, it seems that they say one thing but mean another. sorry for going on, but i am desperate. all help appreciated. regards, pt

  20. hi silverfox & dx. just a quick question, in the last letter from reliable, dated 20th march 2010, it gave me 8 weeks to get in touch with them with my intentions, which i did. i sent them a letter saying i would give them 10 days to supply me with my request. so i have complied with there request, but they didnt contact me until 26th january 2012. well out of my time scale. what do you think guys. regards pt
  21. hi silverfox.& dx. Thank you for your help in the matter concerning my husband. i have six accounts with the same companies, (reliable collections.). I was in dispute with all six of them over different things. ( no cca, charges and interest.) the outcome was i received a letter from reliable giving me 8 weeks to sort out the problems, i had with them. i considered that i had tried and exhausted all my options, so i replied giving them 10 days to respond to my request's. that was on the 01/05/2010, i heard nothing until the 26/01/2012, not from reliable but one of the catalogues, i have a second letter off them now, which has 2x£12, Admin fees, and a credit charge of £4.39. where do i stand on this legally. regards pt .
  22. Hi. I Have Been Charged £12.00 For A Late Payment, I Have Payed My Payment. To Date I Have Received 3 Phone Calls From Vanquis And 3 From Impact. I Have Sent An Email To Vanquis Gillian Street, Vanquis Debt Collection Team Administrator, Raising My Concerns. I Will Speak To Nobody By Phone And They Know This. Can I Put This Account In Dispute. I Have A Payment Plan, ( My Own.) With Vanquis And Never Missed A Payment. Please Hlp. Thanks pt.
