  1. dont worry all windows and doors will be locked at all times, what about the garden can they jump the gate or garden fence? can they break a padlock open to gain entry to my garden shed? will they take my daughters climbing frame its only about £50 worth but do you think they might take that?

    They cannot take anything that belongs to your children.

    There are a number of things you can do.. phone the CAB and get some debt advice from them etc

    if and when this bailiff comes round don't let him in.. talk to him from either an upstairs window or go outside and close the door behind you, they are not allowed to force their way in.. but they do believe me Ive been in that situation and they don't give a dam about what they can and cant do, don't listen to his threats and try and stay calm. Get his name and try and find out first if he is certified, PM Herbie and she can find this out for you, ask about the charges that he has put on the bill .. try and get a witness to be with you just in case he does break their rules ie by trying to gain entry by forcible means, if he does then call the police and tell him you are calling the police.. he may even makes threats to call them if you don't let him in, but there is nothing they can do unless there is a breach of the peace.

    Tell him straight that all you have is £300 and that you will make arrangements to pay £100 a month and if he does not take that offer then tell him you will ask the council to take it back and he wont get anything. he wont like that so he may take the offer. call your council again and plead your case, tell them that this bailiff has threatened you and you are worried that he may scare your children if he tries to break in ..

  2. Hi. Thank you, I will look into the disability rebate today, and yes, I do get disability living allowance for my daughter. Am now going to take her to school then ring tne LA will post with an update. xlindyx

    I'm not 100% sure of this but well worth looking into and finding out. The council have a duty to tell the bailiff company that you are a vulnerable case..If you are entitled to rebates due to having a disabled child which Im sure you are then the council will have to back date the rebate from when you were entitled to it, so they may have to take back the debt from the bailiffs and have to recalculate the amount you owe.. dont be fobbed off .. make an appointment with someone in the council tax benefit section and tell them everything better still have a chat with CAB and get them to write a letter on your behalf .. hope this helps

  3. Hi, I do get 25% off my council tax for being single, but that is all I get. When my Tax credits stop next month I think I will get some Benefit paid. At the moment they are saying I get too much money to qualify as tax credits still pay your working tax for the first 6 months of sickness, but I dont get any sick pay which is how I got into this mess in the first place.

    I would look into this lindy as you are looking after a disable child you should be able to get a disabled rebate as well as a carers rebate

    His reply as follows;

     

    Thank you very much for contacting me recently about the bailiff industry.

     

    As your member of parliament, I believe that those people who have a debt owed to them have the right to have that debt enforced, however there must be a balance between this right and fair enforcement of debts.

     

    I welcome some of the new rules in relation to seizure and control of goods that are contained in the Tribunals, Courts and Enforcement Bill and it is all welcome that the different rules that used to apply to different debts are being removed in favour of a single system. However, given the new powers in this Bill, and the increased powers that were contained in the Domestic Violence, Crime and Victim Act 2004, I believe that it is time for a proper system of certification and we think that there should be a clear regulatory system for bailiffs.

     

    I welcome the fact, that following pressure from Conservatives, the Government have agreed not to implement the powers to apply for reasonable force until the regulatory system that they have promised is in place. However, I still have great concerns about other elements of the Bill, including the changes being made to the ancient common law right of resisting entry to your home.

     

    Conservatives will be pressing the Government to secure safeguards to protect vulnerable people, including single women and those with children. If these safeguards are not secured we will vote against this Bill.

  6. As some of you are aware I am in a dispute with bailiffs and my council over a parking fine that was sent to another address etc, RE, Bailiff assaulted me. in the bailiff section {sorry didnt link it}

    The parking fine was issued because there was no Visiting permit displayed for the sunday, it was early in the morning and hadnt had the chance to change it from the day before, I hadnt got my residents permit as I had just moved in the day before. I called the council who deal with the permits etc and fines and told them the situation,They told me to write and explain the situation so I did. They replied stating that they was not going to uphold the PCN for the Sunday as they felt that I had a valid reason for not getting a V permit, but they were going to uphold the PCN because I had not correctly filled in the V permit for the saturday, these are daily permits by the way, you have to have a fresh one every day. I forgot to fill in the date, I filled in the month and the day but not the date ie 9th. Can they uphold this PCN for a mistake on a V permit the day before the PCN was issued ? Ive explain that this was a genuine mistake and I got my Residents permit the following week, and wasnt there the week before so its not as if i was trying to beat any system. any help on this would really help me out of this situation that has become a never ending nightmare for me
