What is the legal position regarding Bailiffs and steel security gates? The area im living in is not the best of places, though not the worst in the city, and the house came with a heavy steel or some such black gate/grill that covers the front door, so steel gate THEN front door, do they have the lawful right to carry out what presumably would be a pretty expensive job and remove the gate first THEN the front door lock? When our landlord had the gate locks changed on moving in, the gate had to be open, and was basically a welding job to get the lock out, change it then weld the lock back into place, so pretty secure. Or is there a nice loophole that they couldnt break through at large expense through 2 doors?

Perhaps we should send a copy of the Diss Express article to Vera Baird and a couple of national newspapers.
Not sure if Ms Baird remains interested though, now that she has been promoted.

maybe all the people who have complained to bailiff/bailiff companies should send a copy of their complaints to Ms Baird, Maybe she will see the 'real' picture of what is happening

I get the feeling that the councils are just as bad as the bailiffs, either that or they just arnt trained fully to deal with the public, and if thats the case then councils should start getting the training as this is going to get worse

UPDATE ***
I am fuming now!! Just recieved a letter from the council and they are refusing to comment further on the complaint against Drakes Group. Not even a reason why they are not commenting or what they are doing about it. My questions have gone unanswered etc. so Im now filing a complaint with the council ombudsman. Seems to me they are just going to sit back and hope it will just go away.

surely there should be a time limit for bailiffs to cough up the money when they have received it from the debtor, my boyfriend paid the bailiff a hundred pounds in June last year and the council still havnt received it, thats over a year ago,

no it is not My mum is registered disabled so I use her blue badge when I take her shopping

I found this a little disturbing and quite confusing;
I am in dispute with a bailiff company over its charges. If I pay the original outstanding debt directly to the council do I still have to pay the bailiff charges to the bailiff company?
their answer was;
Yes. If bailiff fees have been legitimately incurred they can be pursued by the bailiff in just the same way as the original debt and additional charges will accrue for any further bailiff actions that are needed to be taken to recover those outstanding charges. Once the matter has been placed into the hands of the bailiff any payment directly to the council will normally result in the payment being returned to you and the debt, plus charges, still remaining outstanding.

I would write to the head of the council tax department out lining what you have said here and ask for a full explanation to why this has happened and that you are not responsible for the charges that have occurred

If your car is registered as a disabled vehicle they cannot clamp it or take it away. I suggest you phone the council and have a word with them.

Well - tomorrow I will be telling said director about my conversations with the OFT and their thoughts on the contravention of Section 25 2d of the CCA 1974 and they will get their first sight of my Form 4 - golly gosh are those two things that they value the most!!!!!!
I really think that this guy is thinking that tomorrow is going to be a walk in the park, their is very little I dont know about this company or its directors!!! or the law for that matter! I just cant wait to see his face, their description of me is mid length brown hair and of average height, I am 6ft and blond!!!!!

Having watched the whistleblower programme something that did occur to me was, what if the householder had pushed the ladder away from the window (because quite rightly she could assume this was a burglar trying to break in) and the bailiff had hurt himself LOL. Where do you you stand in the eyes of the law.
if it was me i wouldnt be standing in the eyes of the law I would be standing on the bailiff waving a victory sign.. if he is dumb enough to use a ladder to try and break in then he should bare the consequences..
going back to bailiffs using a cat flap wouldnt it be funny if they poked their head through and came face to face with a snarling dog:D

Just saying that Herbie may prefer to work one way - and I prefer to work another, that's all ! (There's more than one way to skin a bailiff !)

****UPDATE*****
Received a letter from drakes this morning and boy am I not surprised at what they have written. They are now telling me that a letter was hand delivered to my address 7 days before the incident, well I can assure them that I did not receive any such letter, but they say they have the proof to back this up, which I would like to see, and will ask them for this proof. I wont be surprised if i dont get it though. Mr ***** is still denying that any assault took place, but lucky I have this proof in way of hospital records and photographs of my injuries. Drakes still claim that Mr ***** gained peaceful entry because I opened the door, and this sentence I really dont understand.
Im a bit cross that the form 4 I have sent has been sent all over the place and not to the correct court, it has been sent to my LC and to drakes and now has come back to me, I sent it to the magrastrtes court by mistake, seems to me no one knows where the county court is in ipswich, so I will be sending that off later today again lol, but here is some thing interesting, Drakes has told my LC that mr ***** was certified in January 07 when infact he was certified in march 07, I will certainly be passing that information on. its nice when you get proof handed to you like this
any way back to the letter writing, I dont know how my sanity is going to cope with all this. But they arnt going to get away with this an assault is an assault full stop.
