  1. It's possible the seller has had a VAT check and this has come up and they've had to pay it and are now trying to recover it from you.

Right, I spoke to the VAT inspector and she says that if a bailiff is employed by a VAT registered company, VAT is chargeable on the supply of services i.e fees etc However, if they charge bogus or phantom fees on the alleged debtor along with VAT but DO NOT pay the VAT to HMRC then they have committed VAT fraud. So, the moral of this tale ladies and gents is that if a bailiff charges bogus fees and VAT on them, it is not beyond the realms of possibility that the bailiff could be pocketing the VAT If you think this has happened then you would be quite within your rights to report the possible fraud/evasion to HMRC. You can find the tel no to do this on HMRC website

Hi VAT on the sale of a going concern If the business you're taking over is a transfer of a going concern and is VAT-registered, and you are already VAT-registered or you need to be registered on the day of the transfer, you won't be charged VAT on the sale and there won't be any for you to reclaim. If the business you're taking over is VAT-registered, but you aren't VAT-registered on the day of the transfer and don't need to be and you don't chose to register voluntarily, you will be charged VAT on the sale.

  5. Hi Go to HMRC website and put COP 26 in the search box. This will give you information regarding recovery of tax credit overpayments. As HMRC failed to make proper and timely use of the information they were provided with they should remit the overpayment
  6. Go for it! As a previous poster said get together all your paperwork and estimate the costs incurred for everything, telephone calls, letters, internet research etc etc Their error has had far reaching consequences for you and you should be compensated.
  7. I get where you're coming from but if they offer you some derisory compensation you can put your complaint to the adjudicator, but you can only do this once you have exhausted the internal complaints procedure.
  8. Might be worthwhile complaining to HMRC and telling them you want compensation for the loss/damage caused for which they are wholly responsible.. in my opinion.   11. Thanks for posting up the letter. Right they're saying you have submitted an incorrect return (which technically is correct) however you provided the employer name and PAYE reference so as you say it's not as if you were trying to evade tax. Your letter is fine; succinct and to the point. I wouldn't mention about any time to pay arrangement at the moment, I still can't reconcile the figure of £670. It looks as if there is a fixed automatic penalty of £100 (for the incorrect return) and some accrued intrest, but in reality I don't think either should apply. See what they come back with in response to your letter and depending on what they say, we will consider making an appeal to an independent review officer.

  13. I don't understand why you're not getting holidays etc. I only work one day a week in a supermarket (in addition to my main job) and I get 5 days leave a year. I'm also entitled to sick pay, although I wouldnt get any unless I was sick for 4 weeks as I'd have to do 3 waiting days (3 weeks) before I got anything. Do you have a contract or written terms/conditions of your employment?

  15. I work for a large well known supermarket chain on a Saturday. In the staff areas there are signs stating that you may be subjected to random searches. These searches consist of removing your shoes and turning out your pockets in the presence of a supervisor and the security guard. One if those carrying out the search must be the same gender as the one being searched. What you have said sounds really odd.. I felt uncomfortable reading it so I can imagine how your wife must feel! How would they deal with a Muslim woman who doesn't even show bare flesh to her own father. Would your wife consider ringing head office to run this past them and also tell her to have a word with the USDAW rep

For an opinion on your employment status, go to the HMRC website and enter employment status indicator in the search box and then answer the questions and you will be presented with an opinion of your status (sorry can't seem to post a link for you on the IPod)

Hi From a tax/NI point of view, if you are provided with company fuel by the employer, there is deemed to be private use because you don't siphon off the company fuel at the end of your working day, put it in a Gerry can and put it back in the next working day. If you are provided with a company car, the company fuel is accounted for by way of a fuel scale charge; this is calculated by using a generic figure (I think it's about £18k) multiplied by a percentage equivalent to the CO2 % ;see appendix 2 of booklet 480 (expenses and benefits) for details. The fuel scale charge is declared on form P11D and us included in your PAYE tax code as a deduction, the employer has to pay Class 1a nic on it From what you say, it appears as if the employer is in breach of the PAYE regulations

I notice the company are only doing it for the vans; HMRC regulations state that as long as any private use is insignificant or merely incidental to the business use then they will accept that the van is not available for private use. So if the company are putting trackers on all the vans then I'd say that was OK and is just the company making sure they don't get slapped with a bill for private use by HMRC If the trackers are not in all the vans then why would this be? Are any of the vans used exclusively by any one person or are they pool vans? Does the employer think that certain individuals are using the vans for private journeys and has put a tracker in those vans?
  19. NI is deducted once your income exceeds the earnings threshold. The rate at which it is deducted depends upon which category of NI applies. If you go on the HMRC website and enter National Insurance calculations in the search box, this should take you to an NI calculator
  20. Yes, may be best to let us give it the once over before you send it; remember to redact any personal details beforehand. Also, were you given a breakdown as to how the underpayment of £670 arose?
  21. The child minded should have been registered with the local authority and would have had a registered number. I don't know if it's the same where you are, but my local authority has all registered childminders listed. Try going onto your council website and putting childminders in the search box and if the childminder was registered it should come up
