  1. Thanks for the reply - pretty much what I thought. I have demanded that all communications from them must be in email form as I do not have a permanent address so have a nice "paper" trail so to speak. I also sent them a copy of the doorstep letter - and pointed out I have paid all my legally owed costs to them and the council and the fact that I have in writing that the liability order does not exist any more in the eyes of council. They are relentless though, wish theyd just F**K off and stop causing me stress
  2. Sorry to revive an old thread but - I have over the last two months had rossendales hassling me for the charges related to this account that I believe are not valid. I have paid the council in full and they have confirmed that the liability order has now ceased - I have this in writing from them. Rossendales are claiming they can still act on this liability order to recover there costs which I believe is false? Am I correct. I have paid rossendales the first and second visit fees but refuse to pay for a levy they claim to have made. They claim to have levied a bike from my fathers address, which i do no live at. I have not owned a bike for roughly ten years so I know for sure it was not bike, further more my father does not own a bike so it was not his. In written communications they have provided different dates for the levi and also have not provided any proof what so ever this levy ever took place, even though I have repeatedly asked them to provide some. Am I correct in thinking that, 1) they cant act on the liability order that the council say is now void - 2) iv paid all fees im legally obliged to pay?

  4. Hows this as a complaints letter to Wescots? To whom it may concern. In regards to your previous letter asking me to provide details of my previous address and Date Of Birth for prevention of breaching the data protection act, with all due respect I refuse to disclose any further information to your company for a number of reasons. 1) In the first communication from you dated - you stated "no reply will result in assumption you are Mr X" This is in breach of the OFT guidelines. "sending demands for payment to an individual when it is uncertain that they are the debtor in question, for example, threatening debt recovery action to 'the occupier' or sending a payment demand to all people sharing the same name/date of birth as a debtor in the hope that contact with the correct debtor will be made." 2) In the letter dated - you disclosed personal information, namely, Account number, Reference Number, Account balance, without being fully confident I am the debtor. This is in breach of the OFT guidelines - "disclosing debt details to an individual when it is uncertain that they are the debtor in question, for example, disclosing details to 'the occupier' of an address." This may also be breach of the data protection act. 3) You confirmed in writing, by way of asking for further information to ascertain whom you are communicating with, after you have disclosed personal information to the person you are communicating with. This is again in breach of the OFT guidelines. 4) I am under no obligation to provide proof of the debt, your company however are. This unacceptable behaviour has lead me to issue a formal complaint to the OFT and Lloyds TSB respectively. I refuse to disclose any further personal information for fear of mishandling and distribution on the grounds your company have already exhibited a lack of respect for these rules. Regards. Mr X
  5. Thanks BRIGADIER2JCS - just as I thought. Im about to head to work but will post up scans of the letters when I get back, or in the morning depending what time I finish. Funny how they still have not provided any proof of ownership of the debt but they are more than willing to send their letters full of demands on that pretty red headed paper.
  6. I have received another letter today from Westcots - have checked the dates to make sure its not a letter that got delayed in the post and it is indeed their most recent communication with me. They are now demanding I send them a list of my previous addresses and D.O.B to confirm I am who I am, so they dont breach the data protection act. What I find funny about this is, 1) They told me in their first letter that if I didnt respond they would assume the address correct and carry on proceedings using the address. 2) They have already disclosed account number - reference number - account balance and demanded money from me. Should they not have asked for this information before releasing this information then if they are so concerned that I am not who I say I am?

  8. Ok thank you for your advice - I am waiting for the return of my SAR request I issued last week.
  9. Ok - it says Issued by Wescots credit services ltd - On behalf of Lloyds TSB Plc - then a recovery department number - wescots reference and client reference. It then tells me the outstanding balance. They then state they are a specialist debt collection agency and have been instructed by our client to collect the above outstanding balance on their behalf. To avoid wescot taking further action I must - Pay the debt in full - If I cant do this to phone them
  10. I have received a reply from Westcots. They have provided the details of the debt and whom it is owed to - they have asked me to provide full payment within 7 working days. and state that if I can not do this I must phone them immediately. I have just started a new job this week - which they I assume are unaware of. This is in the hope to fund myself through the last year of uni due to start in september, but I obviously have my debt responsibilities to deal with as well. With my other debts I can not afford to pay them a great deal of money per month. How do you suggest I respond to their letter? Im waiting to receive SAR back from Lloyds.

  12. May I ask if the Prove it letter is the letter regarding "a copy of your credit agreement" ?
  13. Im not entitled to benefits due to being in full time education. How do I find out where to pay the money to if Lloyds will not tell (as is the case so far) and my account is effectively inactive?
  14. I havnt SAR'd them - as Im unaware of what it truly fair charges and what are not. What did you put in the doorstep and telephone letters may I ask?
  15. Oh I owe well bellow that - about £2000 / £2500 in total - about half of that to lloyds. Asset wise my laptop is worth alot but macs are essential to the course (as I can not afford to travel to uni every single day on the off chance of getting to use one of their computers) - again my speakers are worth alot but are vital to the course. Would these things be taken into consideration when applying for a DRO? I was looking at that earlier - not sure how f****d my credit is (probably quite badly anyway) so not sure what the best way to go about things would be. Would it look better if I carry on attempting to pay off the debts I owe rather than opting for that? I would like to be able to get a mortgage later in life
  16. Thank you harrassed senior - I just dont want my poor mother to be hassled over things that are my responsibility. I had this problem with rossendales acting on behalf of forest heath district council - hassling my father who had recently suffered a stroke. even after being informed in writting and over the phone and face to face with the bailiff that I did not live at his address. I will inform them that it is a temporary contact address only. Thanks for the advice
  17. Thank you Undercover-Elsa - il have a read through. Rossendales are indeed nasty people to deal with and I do feel much better after conquering that hurdle. Now to sort out the rest of my debts and hopefully have a slightly less stressful life!

The last time I made payment to lloyds was about three months ago now and the last time I received contact from lloyds was about two months ago - I did indeed send the letters to lloyds recorded delivery but I have lost a folder of correspondence that contained the receipts whilst moving for the summer. The letter was addressed to me but the name was obscured by the envelope so my mother opened it - I was going to be moving to hers for the summer but now I weary as I dont want my mothers address being hassled for me, especially as I am only staying a few months in order to better my financial situation

First of all Id like to say I received great help with my council tax and rossendales debt here - and have paid that off and am continuing my complaints procedure against the council and rossendales. Now I want to focus on paying off my non priority debts. The biggest is with Lloyds TSB - I feel I was enticed to take a rather large overdraft from them at quite a young age and have been struggling to pay it back ever since. Foolish of me I know but I know have to try and pay off this debt. I asked them to close my account and sent them a form detailing my other debts - and offered to pay £1 every one or two weeks (cant remember exactly and Im away from where my letters are kept at the moment). I also requested they inform me as to where I should pay the money as my account is inactive. I received no reply - after sending two or three more letters asking where I should pay my debt off still no reply. My mother has now received a letter at her address from Wescots asking me to call and confirm it is me living there and if they hear nothing they will assume the information they hold is correct and will proceed with their process. I have just (one week ago) moved to my mothers for the summer months in the hope of finding employment to earn some money before going back to uni in september. I usually live the other side of the country with no fixed abode - just a postal address at my fathers where I can get mail. I was wondering how to approach this situation? I have no money as of yet - would they use bailiffs? or court action? I own nothing of value apart from course vital equipment (a laptop and speakers as im on a music degree) Is it legal for them just to assume its the correct address if I don't reply? What if they had sent it to an empty house?!?! Also can anybody recommend a (preferably) free company that will help sort out debt payment plans with my creditors so I can start getting myself out of this mess? Regards - Elliot
