    I have had a reply to my sole account this morning offering £650 when I am claiming £746.50. I have not had anything back from my joint account. What shall I do what to hear about the joint account and see if they offer anything? It was such a buzz getting this letter - no mention of closing the account either. Thanks guys xx
  3. CONGRATULATIONS - how dod they offer you full refund - I too got the standard 28 day letter you received - then I sent the LBA earlier this week. Did they phone you after you sent the LBA or write to you withthe offer. Yes I think the letter above sounds fine in accepting their offer.

So I sent my LBA on the 4th and onthe 5th I got a letter offering my full claim but not the interest so £220 - I am going to accept this and a dontion will be on the way when I receive the cheque - Thanks guys - just waiting to hear about OH's jobs which should be in the next day or so so I can pursue his claim.

    So no reply to my prelim letter - can someone look at this LBA for me as I have combined the 2 accounts to see if it sounds ok - also where do I send this one is it to Leeds again? LETTER BEFORE ACTION Dear Sir/Madam, ACCOUNT NUMBER: xxxxxx and xxxxxx I am very disappointed that you have failed to respond satisfactorily to my letter of the 20th June 2006. I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken from account number xxxx is £xxx, and from account number xxx £xxx plus £xxx you have charged me in overdraft interest for the sum which you have taken. Total £xxxxx. I am enclosing a copy of the schedule of the charges which I am claiming which I have already sent you a copy of this in my original letter of the 20 June 2006. I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.
  7. i understand what you are saying but if he gets the job at capital one and then takes them to court he will be finished in his probationary period if you see what I mean - thats why we will wait to hear if he gets the job or not - if he gets it accept it and be quiet if not then LBA and court action here we come!!!
  8. LBA is going off today for my account with capital one - I think we are going to accept the offer on OH's account just waiting to hear about his job.

So I finally get my letter but its notthe same as OH's it is the one you know how it goes thank you for your enquiry blah blah its going to take us a while to look into your enquirywith a detailed response we will do everything to get back to you in four weeks. Well charming. my chrges were less than OH's and he got an offer. LBA will be going off next week - dependant on OH's interview on monday!!

OH got a letter this am offering £163 bsasically saying that he signed the contract etc so knew the t&c's and they are refunding the £8 difference of their charge and £12... so not too sure whatto do now as oh has a second interview withthem on monday so might wait to see what happens there - if he doesn't get the post the LBA will be sent straight away. OH is claiming £358 - so do people normally accept here or go on to the LBA and to court before C1 give in? Strange i didn't get a letter as we sent them off at the same time.

    I got a reply from MBNA today sayingthat they have receive my complaint and I should hear something in 28 days from the receipt of the complaint....what do i do now - shall i sent the LBA off straight away or wait until the 30th when the 14 days is up to send it?
  12. I wouldn't worry too much - I have had rec dels just shoved thropugh my door when the postie couldn't be bothered to ring the bell - just carry on as if they have received it and send out the LBA on time.

  14. Only till wednesday now then I can post of the LBA. The only thing is my OH went for an interview withthem today - do you think i should not claim nothis oppurtunity has cme up will it cloud their judgment of him?

    BEEN THROUGH 2 ACCOUNTS WORTH OF STATEMENTS THIS AM AND FOUND Joint account £1700 worth of charges Sole account £750 worth of charges Prelim letters sent today.

    I have currently sent a DPA to smile my current account but I also have an account with HSBC with I got peeved with becase of the charges and moved about 2 years ago but it is still open - I am worried about account closures should I wait until I have sorted Smile beofre I tackle HSBC - as I want one of them to remain open and not have them bioth shut down on me. I shoudl imagine I have more to claim back from HSBC than smile. What is the success rate with HSBC anyone aware? I have seen alot of v's but not many WON on here. Please advise
  23. I am not sure if the 14 days is from when you send it or from the date of the letter? I'd give it a couple more days I think before sending the LBA Good luck

Going through my box of old statements I found my capital one statemnts for me and OH so I have totted up the charges and sent the letter LPV today with a list of all chrges using the excel spreadsheet on the templates ( not the 8% one) so fingers crossed I amay have a reply in 14 days. These 2 accounts are now closed but that shoulcn't make any difference shoudl it? Mine is for £255.71 and oh £363.90:-D hope all goes well on this.

    Right i have the bug now - I have printed of the DPA letter for my statemenst - i have a fair bit to claimas it tots up to £400 + for the years statemenst I can see. Lets hope i am one of the lucky ones. Good luck to everyone out there - I will now check my credit card charges whilst I still hve to fever!!!
