Hiya Thanks for the replies The £60.00 bills are contract bills, for 2 months, I should explain, I had to go away, due to a couple of personal probs, which Im still having to deal with, I rang Orange to cancel, 10th June this is the only call they have from me, this call was made from my mobile, this was to give 30 days notice to cancel, I have proof of all phone calls made to Orange, on my land-line bill, Only yesterday Orange disconnected my phone, The mast has been removed from the area, as with the damage from the fire, I was without signal from 16th June, & Im not the only one, But Orange called today, on my land-line, saying they will send me a letter in the post, with the new balance of £30.00. plus to say my phone has been disconnected as of yesterday, I asked if I would have any more to pay, the nice man, said No, only the total on the bill that was in the post.. So Im going to see what the bill says & take it from there Many Thanks Again,
  2. I'm just wondering if someone cane help me out, I'm or should I say, I was with Orange, until June this year. I rang to give 30 days notice of cancellation as my contract was just about up, & I was offered a Pay as You Go Sim card, (which never arrived) which I said ok too. Now what happened next was beyond anyones control, A fire near where I live, damaged the Mast that I use for my phone, I was one of many who had no signal, I rang Orange & they did try to patch me with another mast, but it wouldn't work. So I opt for another server, Now whats happened I am still being billed for my Orange phone, I have rang theme mast & told them that due to the mast being damaged & now being removed, that I have had No signal since 16th June, my bill is just over £60.00, but I canceled my contract before the fire 10th June, so I just thought, I would only have one more bill, to pay, the final one, What Orange are now saying it wasn't their fault the fire happened, but it wasn't mine either. & I have to pay the bill, which I feel is a little unfair. Im not sure what to do about it, Ive just rang them & they are willing as a gesture of good will(where I heard that before) are going to credit my account with half of what is owed, but I feel I should ask for the full amount due to no service, what I need to know is can I do this, & could someone kindly give me a nice, but firm helping hand in drafting a letter to Orange...I am having to ring them from my land-line, which is costing me too. Hiya Thanks for your reply Slick I sent lba 19th Feb, got reply from bank saying final offer etc £500.00, for the second time, Ive already had a claim with hsbc put on stay this week, which is a lot more than this claim, so I thought maybe accept this offer, & was just wondering how long it takes the banks to pay up, before making up my mind, as this claim could well go on stay to...I'd rather have a bit money to be honest...I know that sort of means the bank had won in their eyes, but if I look at it through my eyes, I thought the money was gone forever..if that makes sense.   6. Just an update Judge has put my claim on Stay, pending the outcome of the applications made to the High Court... So going to sit back on this one, as Im working on a claim with the Abbey & want to get it as far as possible, I keep you all updated if theres anything to report. Angi xxx
  7. Hiya I find all this so annoying, how the bailiffs can charge such high amounts for knocking on a door. Anyway I just wanted to add my bit Few years ago I was in trouble with debts, mainly council tax, 18 months worth I paid what I could but never on time, which I admit was my fault, so the bailiffs came knocking at my door, I managed to borrow the money to pay them off & the debt was gone, about a year later, the council sent 2 cheques to my hubby refunds for over payment of council tax...the same ones I had paid to the bailiff, I wanted to find out about it all, but they sent refunds to hubby...when the debt was in my name... strange one....you bet...   8. My business account has had an offer on it, so looks like they are still making offers, I wrote a LBA letter last week, waiting to see if they up the offer, if they dont, well its Court next stage. Slick, dont worry about the hijacks, Im guilty of that too lol
  9. Hiya In A/Q - G - other info, can I put this? I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is An issue of fact and not of law. The issue is only whether the Money levied by the Defendant in respect of its customer’s Contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would Have paid them without argument. However, the continuing Problem is, (in common with the 100s of other cases currently Being brought by other bank customers), that the banks refuse To reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, They have a duty to deal straightforwardly and in utmost Good faith. Accordingly, I would respectfully ask that the court In this case, not withstanding allocation to the small claims track, Order standard disclosure. I understand that it is in the Courts discretion to do so. This would bring a rapid end, Not only to this litigation, but would also likely bring an End too much of the litigation in progress against other High-street banks. I believe the case will last no longer than 1 hour and can I also add a Draft Directions? this has got my head all over the place, lol

  11. update my claim is for £975.00 Barclays have offered me £500.00. as an ex gratia payment of full & final settlement of my claim with this offer they have also sent a lengthly letter, making me aware of a court case pending between a number of financial institutions on the one hand & the Office of Fair Trading on the other( Im very aware) The case deals with unauthorised o/d charges on personal account (as opposed to business accounts). One of the issues that will be considered in the test case is wheather these charges on personal current accounts are penalties at common law. In the circumstances it it possible that this case may inform the approach to be taken by banks in how they deal with business claims such as yours.... it does go on a bit, so are they now trying to tell me that, my claim would be just like personal accounts? Im already in the middle of a claim with the HSBC with is at A/Q stage, does anyone think this claim is looking to go the same way? Any help would be welcome Thanks so Much

  14. what you need to do is open a dispute on paypal, its in the Resolution Centre, if you have any emails from the seller saying return & you will get your refund, let paypal know this. Also let the seller know what you are doing...sometimes they pay up...sometimes they dont. when you returned the item, did you use Recorded Delivery? if so check to see if the seller has the item by going to royalmail website. if they have it back, let paypal know this also, the more info you give to paypal the more chance you have of getting your money back. would like to know who the seller is..but I know we cannot put any names on here...(shame lol) Good Luck with Your Claim Angi x If I have been of any help, please click the Scales of 'Justice' in the botton left corner.   16. Update My friend has just handed me, some papers from the Court. Notice of Defence Has Been Filed There is an Allocation Questionnaire, to be filled in, & once again Im stuck, as I did not have to do this with my claims (2006) So if anyone would like to help me out, I would be most grateful. I honestly thought this claim would have been put on Stay, as I have read most are. With this not happening before with my claims & there are AQ papers to fill in, where do we stand? could this still be put on Stay? Also there is yet another fee, this time £35.00p can I claim this back? So sorry if Im asking lots of questions, but Ive not been at this stage before.   18. Ok here goes, this is going to make good reading I sent DPA letter on 19/11/2007 asking for my statements list of charges enclosed £10.00 which they have cashed. Abbey replied 8th/12/2007 list of charges but only monthly ones So I sent a LBA Section 7 DPA letter, on 8th/01/2008 asking for my statements as they had sent a list of charges on a monthly rather than giving me dates for each charge. Abbey replied 21/01/2008 list of charges but monthly YET again, infact its the same list & letter signed by the same person, but with a different date So today, I rang the Abbey, I didnt get the persons name, he told me, they had already send my statements, I explained, that they had send my statements but Monthly ones & that I really needed statements showing dates the charges were imposed, he asked was it to make a claim against the bank for the Bank Charges on my account, I said Yes...he hung up on me... Now I ask you, is this Normal for the Abbey? I was shocked but had to laugh about what had happened, I thought about ringing them back, but changed my mind as we all know we never get the same person. So my next step is to write to them once more, tell them how I have been treated, & tell them also, that I am going to apply to the County Court for an order to enforce compliance, I cant prove who I spoke to, but I can prove I rang them today. What I need to know is...Am I doing the right thing Any help would be lovely Thanks Angi x

  20. Just another update...The Bank has till tomorrow to reply, as yet there has been no word. If by some strange reason they dont reply by tomorrow, so if this happens, am I ok to fill in the request for judgment part of the court form & take it back? any help would be lovely Angi x

    Jean vs Abbey

    Hiya Jean Im waiting for a response from HSBC the papers where served with them last week ( at court stage) its my friends claim, so he/we are just going to sit back, as the test case is on now. And from what Ive been reading most if not all of the banks are opposing the stay. So I think just wait and see what happens with the test case.
  23. Hiya My statements have just arrived, after sending a second letter into Barclays, as they didnt sent any statements just a year by year list of charges. Now on these statements I have noticed the charges are Unpaids Out I've not seen this before, does it matter if they dont say what they are for? & I just write them on the spreadsheet as they are... Next question, there are charges for Interest Charged can I claim this back? Im pretty sure the Commission Charges I Can Not Claim. Would someone just check my thread please.... Thanks So Much Angi x

I had much the same fone call, they charge 30% Im not sure how/where they got my number, Im still waiting for a fone call back from them, as I didnt have time to chat ( my excuse) as I told them, I had claimed my bank charges bank with the help of this site...anyway no fone call..think they are BEST ignored....
  25. Good Morning Just a little update Court papers were issued on 11th Jan 2008, papers sent to the defendant by first class post on 10th Jan 2008 & it will be deemed to be served on 13th Jan 2008. Th defendant has until 28th Jan 2008 to reply..... So the waiting game begins Angi x
