Hiya Thank you to everyone who has replied My daughter & my Grandson have only lived in the house for 6 weeks, For the past 4 weeks I have phoned (5 times) the landlord to ask about the hot water, he promised me that this would be sorted out. I have been away for a week, when I came back nothing has been done, & I am now as mad about this as I dont know anything about private landlords. The house is an old terraced house, the smoke alarm is no longer a problem as my hubby has sorted this out. Its the hot water thats the main problem, my daughter will be here tomorrow, so I think the advice that we have been given is the action we will take. The landlord has had more than enough time to sort this out. my only worry will be, if he decides to end the tenancy with my daughter, but we will cross that one if or when it comes.   2. Anyone with any advice to this one? Quick details- Daughter rents a house, from a private landlord, the boiler for the hot water was not working, so she has No hot water, plumber came needed a part, 5 weeks down the line still without hot water, plumber still waiting for part. many excuses not to call her back. Smoke alarms? not working when she moved in Who is responsible? Daughter also has a 2 years old child. So if anyone can give me some advice on this one, I would be grateful

Hiya Just sit back & try to relax, (well try too) they have 14 days to reply, most say they going to defend to give them another 28 days. they seem to settle up around day 24-27 of these 28 days. Most courts close later today till 2nd Jan. then it will be full on battle lol. you will be fine, I never bothered them once it got to court stage, but I have read some people have, but thats mainly due to the banks not getting back to them when it was near the 26/27 day of the claim. The Claimant contends that these charges were legally unenforceable. and the Claimant is demanding the repayment of this money Repayment of unenforceable penalty charges: £xxxxx Interest on the sum due of: £xxxxx ------Page 2 Human Rights – No Particulars of claim The Claimant has an account (account number) with the Defendant, opened year xxxx. 2. Since xxxx, the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details, as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Hiya I have just spoke to someone, whos claim for more than six years is at court now, BUT the lady from the court has rang her to tell her she is only allowed to claim 6 years at this moment in time, I know there are more people trying to claim more than the 6 years, good luck to them, I'm happy with what I got so not going to bother claiming anything else.

  13. If you are out of work & claiming a benefit: sick/unemployment/job seekers there might be others, worth checking, but you dont have to pay your court fees, you do need to take up to date proof that you are claiming a benefit.

  20. Hiya IF you have paid your court fees then the Banks should refund them as long as you make sure it shows up on your court claim. Hope you know what I mean.

  22. Hiya Bill little mistakes can be costly!!! not to worry, you noticed it before it went to Court. Have You have sent your LBA off? Did you send another LBA off with the amended charge? If you did they I cannot see any reason why to send it again, Just stick to your time-table, why confuss them even more than they are already. I know if I am wrong someone will jump in & tell you otherwise, but if Im reading yuor thread right (makes a change for me lol) You have put your little mistake right. I would say as long as the Court claim is spot on they all should be ok.

  24. ohh its easy done, I know I did the same when I did my claim lol I think this bit is the one that needs to be done with more care than any other part of the claim, coz this is the final bit that has to be spot on, we dont what to see any little mistakes now, But hey thats what the great people on this site are here for, to give a helping hand.
