  4. Contacted kelly duffy as suggested by AD. Unfortunately still nothing. I think my only option now is to start an action for failure to comply with SAR, which i originally sent on september the 12th!!!!

  7. Hi Kev, you can still claim back charges even if the account is closed. As long as the charges occured within the last 6 years then no problem. good luck kev
  8. Received a letter from the AA. They have agreed to repay the £60 in late payment charges they have taken from me. paraphrasing the letter... "our technical department (would think this means legal dept) have advised me that the earlier letter they sent to me had incoreect information in it...next year the law is changing in regards to charges applied by the financial industry....OFT have asked the credit card industry to reconsider charges they apply....OFT will be approaching other areas of the financial industry in respect to their charges.... because we provided incorrect information we will this time refund your money...etc etc.... So loosely translated...the laws and regulations already exist and because you have challenged our charges under the unfair terms and conditions regulations we have no choice but to pay up...but we wont admit that!
  9. Hi Jo & Mick, i wouldn't worry about the fact they have ticked no in the request to delay any further action for one month. Although they more often than not tick yes, there a plenty of examples when they have not done this, and they have still had to settle in the end, as they will with yours!
  10. Hi Moose, my date was the 19th but they settled before that. Must just be pot luck. In the end it just appeared in my account not even a phone call or letters to let me know. Im sure yours will be this week. Hang in there !!
  11. Hi Hollydoll, congratulations !!! just send a letter to the court quoting your refernce number stating that the claim has been settled in full....after you get the cheque of course!!!
  12. As the others say. dont worry. LLoyds are following what now appears to be there standard tactics and will drag it out to the 11th hour ... but you WILL win. Expect them to tick yes to the request for a 1 month delay before further action to allow both sides to negotiate, followed by a formal stay. Follow the examples in other threads when this happens and keep firing off letters to sc&m asking them to carry out the stated intent of entering discussions to settle. keep the pressure on and follow the advice on the site.

  14. YEEEEEESSSSSSSSSSSSSSSSS!!!! can't believe it....just checked my account and the money is in there. No condtitions and paid in full. so relieved. Now i can pay off a few debts and hopefully have a good amount left for crimbo. thanks all for your help and advice, and for the inspiration from everybody else who has won recently. donation to follow!!!! ps now for round 2!!!

  16. Sent off the letter to the AA quoting unfair terms and conditions acts etc and ........nothing ! The silence is deafening! so guess i will start the moneyclaim online process. Anyone have any ideas on the wording. would i use pretty much the same as for the bank charges?

I had a letter from the courst last week granting a stay until 19th December (although 5 weeks + had already passed since the AQ date!, AQ went back 10th october) Anyway, received a conditional offer from SC&M last week, accepted offer rejected condtions..so still waiting so keep at it, your nearly there now...the end is in sight kevin

  23. Hi Derek, result!!! well done and congratulations, a long hard slug but worth it in the end. I had a settlement offer yesterday with conditions. I will accept the offer but reject the conditions. I need to go for round two with them!
  24. surpise surprise!.. got home last night to a conditional settlement offer from SC&M. they have offered the full amount £4464! The offer is marked headed without prejudice, confidential and privileged Basically they still admit no liability and insist there client would defend the claim but its just not worth the cost...yeah whatever! will send back a letter accepting the offer but rejecting the terms. I know this may delay it but i have waited this long now so another few weeks is neither here nor there really.

Hi Moose, well done you, thats brilliant news....hopefully you can get it before christmas which would be great especially in view of the farepak issue. i got exactly the same letter last night when i got home!!! offer of the full refund of £4464!!!, so i'll be sending the same letter michael posted accepting offer and rejecting terms. so maybe i'll get a good christmas too and pays off some debts..heres hoping
