Hi Guys I have just spoken to a lady at the court who has recommended that in light of the issues I have been having with MCOL to email my defence. She provided me with the relevant email address. I assume that all I need to add is my name and claim reference to the email and to send the defence as a word document attached to the email. Thanks as always. -

Many many thanks Andy. I assume there is no need for me to mention the failure to respond to my CPR requests. Will i be able to fax this defence as it is not looking good for MCOL (can not use the phone as boss is in) and it needs to be in by the 9th (Monday) Thanks again Andy and everyone else, you are gems!! -
Is your claim for an overdraft then Knet? Only I never had a agreed overdraft with HSBC so I can not understand what mine is for.

If none of us are getting documents back from our CPR requests, would I be right to assume this could be because they simply do not have them? i assume if they did had sent them, it would be case closed from the defendents perspective?

What exactly they are trying to do with these letters they are sending, after people have put their defence in. Are they suggesting they will not go through with the CCJ as long as you agree a plan with them? If so, how can you agree a plan with them when they have not even sent proof or evidence of what it is they want you to repay?

When does yours have to be in by. It seems we are both in the same boat. Split claim, no reply to requests. If it is acceptable to you can I base my defence around yours as it looks really good and i am struggling to be honest.

Sorry Andy getting myself in knots:oops: As I could not see anything on MCOL I called the court to confirm they had received my AOS. they confirmed they had and that I had until 9th July to file my defence. I will call the court tomorrow and explain that I appear not to have the facility to submit my defence trhough MCOL, as i assume that this is how I will have to submit it? -

Thankyou for your reply Andy. My defence is due 9th July. I rang the court today and they did confirm that they had received my defence and that the deadline was 9th July. -
I have had nothing back either bh. Maybe they do not have anything to send after all! I am going to start doing my defence tonight. Can i ask when you log on to MCOL what options do you have and can you see any reference to your AOS? MIne has nothing on it!

Right guys I guess it is time to start putting together this defence. Andy you mentioned forcing compliance, how owuld I do this please? Aslo where do I begin to start with putting a defence together. I am totally clueless, does anyone have any suggested links please Thanks as always I also have an issue that when I log onto MCOL I have no reference to my defending this claim or even of the AOS. I understand i should be able to submit via MCOL but do not appear to have anything there when i log on.... nos history, no submission facilities... nothing! Marsh. -

The 31.14 was 14 days and the CPR 18 7 days. Both were sent be recorded delivery and one was signed for 12th June and the other 13th June. My defence is due 9th July. -

well one letter was received by them 12th July and one on the 13th. No idea which one was which though (CPR 31.4 AND CPR 18) In any case the CPR 31.14 stated I needed a reply within 7 days which has not been met yet. What is the next stage please? -
I have got one of these split claim jobbies from Sigma. So is the split claim perfectly acceptable in court?
