  1. Just a quick comment on this. I am also no fan of Atos and what it has done to me and other people on this site. I heard a news item on the radio earlier that said the number of claimants for JSA, I think it was, has gone up. I wasn't following the report in great detail, but my immediate thought was 'Are these new claimants for that benefit the ones who've been taken off IB and other benefits?' I hope something can be done to change the system.
  2. Hello there. As you know, many of us have been in the same position as you. I went to appeal against the Atos medical and won, with a lot of help from my husband. As to what to do, if you have time, read other threads about this. You need a copy of what Atos said about you in their report. Then find the DWP website or one of the charities that publish the assessment system on their website. We went through the report with a fine tooth comb and pointed out all the discrepancies. The tribunal were very fair and believed us. At the end of the document, which I think we handed to them, we put how many points we thought I should have scored and what for. It worked for us, and I think Brighton Gal did something similar. You might have a look at her thread. I hope you get a good result. There will be plenty of help here. My best, HB
  3. Hi there. I hope I'm not the only one on the forum saying this, but your post is a bit confusing for me. I understand why, no doubt you feel incensed abou this, but it makes it hard for us to advise you. Could you maybe do a timeline with the dates when changes happened and what the rules were changed to? Could you also explain how sales people and agents fit into it all please? Sorry if I'm thick.
  4. Hi MsJ. I really feel for you, but please don't give up now. Any independent person with half a brain will see through what this guy is doing; it's just that you're too close to it. And he's probably hoping to do your head in and win by evil means. Listen to your uncle Elpulpo, I'm sure he will guide you through it. And any other nice people who reply.
  5. It's a long time since I had a season ticket loan, but I have a vague recollection that if a ticket was cashed in, it had a residual value. In my case, I think I would have been liable to pay the difference between the outstanding loan and the value of the ticket. Of course, things may have moved on. Does anyone know please?
  6. Hi there. I don't know about the vouchers exactly, but I think I've heard about them being called a gift. I can't think they were worth very much, but maybe other people will comment? I was also told to do voluntary work by a counsellor, declared it when I was on IB and it wasn't a problem. It was intended to ease me back into work and of course, it wasn't paid. Try not to worry too much. I'm sure someone will be along soon. My best.
  7. Yeah, right. We believe that, don't we? Stick with it MsJ. HB x
  8. I can't remember and my searches aren't working. Hopefully, people will remember what was said before and repost it. Fred, from memory, the caggers thought the employer was on dodgy ground the last time. Fingers crossed for you.
  9. Hi guys. Sorry to hear about your aggro, Fred. Elpulpo, wasn't there a similar case about paying for vehicle damage on this forum? I can't remember the name of the thread offhand, will do a quick search. But do you remember it?
  10. Hello there Tigga. If you do need to go to appeal, and I hope you don't, you should ask for a copy of your medical assessment. Other people on this forum have done that and proved that their score was wrong. It takes a while to plough through it, but it worked for me. Good luck, keep us posted.
  11. Just a thought. Do you have a copy of your contract or anything about your ex-employer's grievance procedures? It's possible that's where you're heading.
  12. Hi, that's a horrible thing to happen. I can't advise you what to do myself, but I'm sure some people in the know will be along soon. We'll do what we can.
  13. That's good news, hopefully your friend can move on now. Thank you for letting us know.
  14. I agree with Elpulpo, don't resign. There's plenty to look at here, the DDA [Disability Discrimination Act], the fact that you're possibly being victimised for submitting a grievance. And probably others, once we've had a think. Has she put any of this in writing, about not believing you? I doubt if she has had medical training, so you just have a headache do you, according to her? Do you have phone bills that prove you've [or your OH] rung the office? I would have thought one way around this would be for you to see their Occupational Health doctor if they have one. Hopefully some other caggers will be along later. You're not alone in seeing this sort of treatment, try not to worry too much for now. My best, HB
  15. Hi, that's a good result. I didn't even know hospitals had lawyers! Well done, that's one in the eye for your employer. Are you going to tell your colleagues?
  16. Hello. How can they prove he wasn't there until 5pm, do you know? Or can he prove that he was? Does he still work for the firm?
  17. I agree that the company that you were acting for when you were injured should be paying you. At least they did the Accident Book thing right. Have they said anything, or have you asked them, so far? Elpulpo, what do you think? I am a bit confused though, can you help me here Herbert? Company A is your main job and you're an employee. They're paying SSP. Company B is an extra job you have and you were injured cleaning for them. They haven't contacted you since the accident, or paid you anything. Are you self-employed there or an employee? Have I got this right, or is it the other way round?
  18. Hello again. I think it might be worth you starting another thread on the Employment forum to get some views on that aspect of your friend's problem. See you there, HB
  19. So they admitted they were in the wrong, if I can put it like that, and now they're making his life difficult? This doesn't seem right. I don't understand what you say about the employer putting words into his doctor's mouth. Are you able to say more about that please?
  20. Hello there. Is this accident connected with work or outside? And would your friend be covered by the Disability Discrimination Act [DDA?]. I leave it to people who know more about benefits to comment more.
  21. Hello Mags. This cropped up the other day and the thread might interest you. I stand to be corrected, but I think the upshot was that people thought a 'civil' type offence either wouldn't show up or would be accepted without problems. For instance, speeding or parking fines are ignored by employers. I hope more people will be along soon. In the meantime, try not to worry too much. This is the thread CRB check will it show up any of these?
  22. Don't go insane, this rat isn't worth it. I would hope that as he's invented lots of other things, any reasonable independent person would find it hard to believe much of what he's said. Anyone?
  23. Hi MsJ. I can see it's hard to prove, but do you have a payslip dated around the time you started work there, or does the paper trail start at the end of the month after you joined, if you see what I mean? I don't suppose he could supply a copy payslip from the beginning of your employment. Do you have the letter offering you the job? A bit of a long shot, but does it mention pay dates at all? From memory, you don't have any written terms of employment?
  24. I don't know what the others think, but I would have thought it was important to point out how your line manager treated you in the meeting and the 'omissions' from the minutes.
