  1. A Council can use alternative methods of collection should a person not be able to pay. These powers are not widely used but can include : 1 - Attachment to earnings 2 - An order which stops people using their bank accounts until the debt is paid 3 - A type of Charging Order on your property
  2. One month loan and Cash Genie are operated by the same people so it is rather irresponsible of them to allow you one each. I had an arrangement with Jamie at One month loan of £30 per month but he cleared my account out and too his debt that way. Far from ideal but I suppose I owed it them. Moral of the story - never give them your card details as that is all they are after when setting up plans.
  3. They will not take you to Court. If you pay them it is a bonus. Make a full and final offer to them, which should be them amount you owe them, not including their interest, but stick to it. Keep your offer recorded somewhere. Chances are they will not respond, if they don't and in the unlikey event of a Court action being taken you can demonstrate to the Court that you served on them an offer that was not replied to. If they do respond I would suggest payment is made and the matter is closed.
  4. They have offered me a settlement on a £9000 debt for £4000. They are closing all branches and centralising and not loaning any more. At last the end is nigh.
  5. Before a Court Bailiff can be instructed a CCJ has to be made. However, some Payday loan companies now instruct private Bailiffs to serve letters - they threaten things but, without a Court Order they cannot do anything. I would enter into a payment plan otherwise you run the risk of a CCJ when they can request an attachment of earnings order.
