  1. If they are not a registered business then i would guess they will have a lot of explaining to do once official bodies get involved as well as the tax man etc . They host thier own website and also advertise on ebay and have links with several major players such as Exchange and Mart . A big business to fold over 3 grand !
  2. Lawter said recorded delivery is a bad idea because they will guess what it is and can refuse to accept it . Next day delivery on the other hand looks no different from normal mail and is tracked and must be signed for . Thanks for suggesting Trading Standards though . It has just occured to me that as a refund most definately is my statutory right then if delivery takes place , days after cancellation , and the keys are posted , i could suggest to a court that the car might be considered a gift . Wishful thinking i know but wouldn't it be lovely to see these rogue traders actually punished for what they do .
  3. On Sunday my bf bought a car online by instant bank transfer . On Tuesday my bf called and emailed to cancel the sale . The garage "KARHOUSE" absolutely refused to cancel the sale point blank . C.A.B say the contract was made from my home and therefore we have a right to cancel . A lawyer said distance seller laws apply hence a 7 day cooling off period gives me the right to cancel . I have followed instructions given by both C.A.B and lawyer , putting the cancellation in writing demanding a full refund and stating my rights as a consumer . The letter will not arrive until tomorrow but i understand this is the first step towards a small claims court . At 5pm today i recieved an email from KARHOUSE stating the vehicle will be delivered Friday and if nobody is around to accept it the keys will be posted through my letter box and it will be filmed for evidence . As far as i can tell having researched online i cannot stop them entering my garden or posting the keys in any legal way . I feel it is VERY likely any attempt at delivery will result in violence and i sincerely hope somebody on here can tell me how do i prevent this ?
  4. Beware i got my loan and PPI from Welcome finance and wasted an entire year exhausting thier complaints procedure . Getting no response i contacted the ombudsman who ordered Welcome to issue a final response . The response stated i must direct my complaint to Bluesky Personal Finance and to this day i have no idea why ? something to do with broker ? Bluesky Personal Finance Tintern House William Brown Close Liantarnam Industrial Park Cwmbran Gwent NP44 3AB Anyway i wasted a year writing to Welcome , then another year writing to Bluesky , then another year writing to the Ombudsman , and this week i lodged a complaint against the financial ombudsman service because i am convinced the director actually owns both bluesky and welcome and so it is he whom ripped me off to begin with . Its been a total waste of time for me but i wish you luck .
  5. Ombudsman agreed 2 years ago i was miss sold PPI but its October 2011 now and i still haven't recieved a refund .
  6. July 2009 I started my complaint about Welcome Finance - last week October 2011 i lodged a complaint against the financial ombudsman service because as yet nothing has been done . The ombudsman today admitted my original complaint against Welcome has been deleted but the follow on complaint against Bluesky (whom it later turned out was the real firm behind Welcome) was still active . The ombudsman also apologised because my original complaint was not correctly dealt with leaving me misinformed . Hence i will one day recieve a PPI refund BUT must start a new complaint if i want to recover the £2500 charges and interest added to a £5000 loan without my knowledge . So i paid Welcome or Bluesky £5000 to borrow £5000 and must repay £10,000 plus interest . As it has taken over 3 years by due process to reclaim £2500 of illegal charges i simply dont see the point in trying to claim back the other £2500 . 6 years grief over a 5 year loan - i dont think so !
  7. My daughter and myself both work in the same capacity (minimum wage employees) for a very large national company yet i have been threatened with court for not paying wages . My daughter brought her friend to work for a week (i was on holiday that week) so each could work 4 hours of my daughters contracted 8 hours daily . obviously then sharing the pay . As my daughter is paid monthly and this was the first week of the month the friend was aware her pay would be delayed and happy to wait . Shortly after they had an argument , probably about boys or something stupid , but it was never suggested the friend would not recieve her pay . On payday my daughter contacted the girl asking what to do about national insurance and tax contributions . It was agreed that my daughter would pay two thirds and the rest should be deducted from her friends earnings . My daughter paid the girl and the following day i recieved a legal letter threatening court and costs if i did not pay the girl myself ! I am not and never have been an employer , i have nothing to do with wages or the companys management . I am inclined to ignore the letter and let the girl and her family proceed to court incurring costs they can never hope to recover . I am named as the accused and i am quite certain a court will instantly accept that i have no authority and therefore no connection with regards to this matter . I would gratefully appreciate any advice on this matter and can only add that despite my not being religiously minded i am praying my daughter paid the girl by bank transfer and not cash ! Might i regret not replying to the solicitors that threaten me ?

Stupidly falling foul to sales patter I paid Gregory Pennington Financial Mangement Company £3700 over a number of years to clear less than £3000 of debt DESPITE being perfectly uptodate with my numerous creditors and having an excellent credit rating . Eventually a friend learned of my arrangement and insisted i contact my original creditors directly . Then the nightmare began . The £3000 i owed had increased to around £20,000 , i had been defaulted by everyone and my credit rating was in tatters . I cancelled the agreement and spent the next 6 years in poverty paying off the debts (debts i had already overpaid) . 10 years later i still have a poor credit rating which resulted in my accepting a mortgage (the only one i could get) which barely falls short of criminal with regards to charges and interest rate . Ultimately my joining a financial management company whilst having an A1 credit rating has resulted in a lifetime of acumulated losses . Send them to prison !
  9. Thanks andie 303 , i have decided to send all letters by recorded delivery and each time i do i will include copies of all previous letters , i hope by doing this it will become obvious , even to welcome , as the pile gets heavier that i am compiling evidence for a lawyer to look at .

Letters sent - As yet I have received no reply to the letter below and so I will send it again - By Recorded Delivery on the 18th of September 2009 By Recorded Delivery on the 18th of August 2009   Dear sir/madam I purchased in connection with the loan referenced above Payment Protection Insurance (PPI) . I believe that I was miss-sold this policy for the reason(s) given below and request you investigate my complaint in accordance with the Financial Services Authority (FSA) Regulations . Despite it being explicitly required under the rules of the FSA - at no time did Welcome Finance ask about existing insurance cover . Welcome were at the time well aware that I am a mortgage holder and as a condition of mortgage I must remain insured against every possible eventuality , it seems reasonable that while acting as an insurance broker Welcome Finance should have questioned the need for PPI of their own accord thus preventing the sale of an entirely unsuitable insurance. At no time was it explained to me that the insurances were optional and I accepted them assuming that obtaining the loan relied on my acceptance . At no time did Welcome Finance explain to me the amount of interest that is payable on the premium as is required under disclosure rules . At no time did Welcome Finance explain or bring attention to the exclusions and limitations of the policy . It follows that I was unable to make an informed decision regarding the PPI as a direct result of Welcome Finance failing to act within the rules explicitly required by the FSA . I trust you will uphold my complaint and so refund all premiums paid including both statutory and compound interests and compensation in the prescribed manner within an acceptable timescale . (1 of 2) (1 of 2) Please note ; Though I would expect the loan agreement to be restructured to take into account these changes but any attempt rewrite the loan agreement will only convince me that I should look to resolve the matter either through the Courts or the Financial Ombudsman . Also I am advised as I dealt solely with Welcome Finance while purchasing PPI that Welcome take responsibility for any third parties involved . Welcomes Reply - I write further to your letter dated 21 August 2009 Having reviewed our records . it appears that we have not recieved the questionnaire requested in our original correspondence . As explained in our original letter , we are not yet in a position to accept your complaint, until the questionnaire has been completed and returned to us at the above address. Upon receipt of the aforementioned correspondence, i will investigate the matter thoroughly and issue a final response within the regulatory timescales allowed. Please note that if the questionnaire is not returned within the next four-week period, Welcome Financial Services Ltd (WFSL) shall close your complaint file . Signed Ian Brocklesby . My response not yet sent and i'd be happy to accept any suggestions or corrections . - By Recorded Delivery on the 25th of September 2009 Dear Sirs Thank you for acknowledging my letter of complaint with your letter dated the 21st of September 2009 a copy of which is enclosed . Please note the questionnaire you describe was never received at this address and therefore cannot be returned . In that regard I can only suggest that you make enquiries with the Post Office . However as it is highly unlikely a questionnaire of any kind might alter the basis of my complaint or invalidate it . Therefore I must accept your letter as nothing more than a delaying tactic and thus further evidence of Welcome Finances contempt for the ethics codes and rules of good business practice . I am advised that if Welcome should close my complaint on such contemptible grounds it is reasonable to state that I have exhausted Welcome’s own complaints procedure . This allows me to seek the assistance of the Courts or the Ombudsman . As your letter states a reply must be received within four weeks if the complaint is to stay open I must insist on your reply to this letter within 21 days assuring that my original complaint will remain open and will be dealt with accordingly .

  14. Defaults recorded in accordance with the rules cannot be removed for 6 years .
  15. Well i haven't read every post but i'm assuming as you won that your difficulties were caused by the company that recorded the default and so the default should be void . I always forward details of debts paid in full or disputed etc to Experian and ask them to update records because we all know they only exist to make everyone look bad so they are easier to rip off . I have never had a problem having anything altered or removed once i send proof that the matter is settled .
  16. Send a copy of the Court ruling to Experian asking them to update your records and remove the default . It takes a while but they will pass on the info to all the rest .

I believe that I was miss-sold these policies for the reason(s) given below, and wish you to investigate my complaint according to your normal complaint procedures. -------------------------------------- Despite it being explicitly required under the rules of the Financial Services Authority (FSA) the following terms of service were not met :- 1, At no time did Welcome Finance ask about existing insurance cover . 2, At no time did Welcome Finance advise the PPI was optional . 3, Welcome Finance did not comply with disclosure rules as they did not disclose the amount of interest that is payable on the premium . 4, Welcome Finance failed to explain or bring attention to the exclusions and Limitations of the policy . ------------------------------------- I personally was not able to make an informed decision as a result of Welcome Finance failing to act within the rules explicitly required by the FSA . To further underline this I had at the time of application an existing insurance policy that offers far greater cover than your own , this policy is a requirement of my mortgage and it seems reasonable to assume that Welcome while acting as an insurance broker and being aware of the mortgage should have suspected this and questioned the need for PPI of their own accord . Of course I am now aware that your sales advisors receive commission upon the sale of insurance products and therefore their actions cannot be impartial. This should have been made clear to myself at the time of the insurance being sold. Please now investigate my complaint within the eight weeks allowed to you. I expect that you will uphold my complaint and refund all premiums paid plus both statutory and compound interest and compensation . I would expect the loan to be restructured to take into account these changes but will view any attempt to rewrite the loan as grounds to forward my complaint to the Ombudsman . I am advised because i dealt solely with Welcome Finance when the loan and insurance was approved that Welcome Finance is responsible for any third parties involved . If I have not received a satisfactory response within 8 weeks I will contact the ombudsman who is already dealing with an unrelated complaint (fsa number *****) on my behalf to discuss court proceedings . Do you think this letter covers everything or does it need altered again ? Comments please .
  18. Of course how stupid of me the interest would be calculated and projected forward to include the cost of PPI so remove the PPI from the start date and the interest would have to be recalculated . DOH!

Reputable mortgage company ? does such a thing exist ? . i was a victim of Gregory Pennington financial services , i paid GP in installments £5000 to settle £5000 worth of credit when i had an A1 credit rating . As a result i found myself at the end of the agreement nearly £20,000 in debt and defaulted on everything . It took me 7 years to get out of debt though my credit rating is still poor and the interest rate on my mortgage is terrible as a result .
  20. I'd have to think about restucture , if i continued to pay £280 monthly once PPI was removed the loan would be settled in 2.5 years rather than 5 years , surely this would allow me to avoid considerable interest ? I would need legal representation to go to court that doesn't come cheap !

  22. Thanks Tedmaul72 obviously the extra £100 a month i'm paying results from PPI so if i can get that removed and prove it was mis-sold i am likely to half my monthly payments . Woody thanks for the vote of confidence but i don't have £1500 to get it to court !
  23. Whoa they copy and paste signatures ! that is a criminal offence , surely consumer forums or somebody else could easily collect evidence of this and pass it on to the organised crime squad ? PS your scales are tipped .
  24. OK thank you andie i'd gladly tip your scales but i'm not exactly sure what that entails ? I think i will go back to the drawing board then because i actually have insurance cover or else i would not have a mortgage and it seems reasonable to assume that Welcome while acting as an insurance broker should have suspected this but it was never questioned so miss sold seems obvious .
  25. I get the feeling andie 303 knows what he is talking about but i am not sure i understand him ? (i left school at 14 several light years ago!) . Is he saying don't request refund but ask for compensation on interest ? I'd be grateful if someone could clarify .
