  1. Now had a demand from yet another debt collection agent.Any advice?
  2. Any advice? I have received confirmation today that they have rolled my cc, overdraft and loan into one account. I have agreed to repay the loan and commenced payments. I strickly advised their solictors that I do not acknowledge any other debt with them. It has taken three months for them to confirm that they have rolled everything into one account. I am of the opinion that they have tried to get out of their obligations under my credit agreement request and attempted to conceal it within another account by rolling these into one.
  3. A court summonds arrived today.Any ideas on my defence?

  5. Went quiet for a while. Then I started receiving letters from Mercers again, then Calder Finance, then Debt Managers. Each time I have made a formal complaint, asking for a copy of their complaints procedures,they have upped the degree of threats and ignored my complaint. The most recent one was threatening action in Rotheram County Court. Whilst not holding my breath, I have written to the Oft, my local trading standards, Banking Code Compliance board and the Financial Ombudsman. Any other ideas?
  6. I have a number of debts and the way these companies and their debt collection agents work is unacceptable. I can't sleep at night, I hate coming home from work, as I know the post is waiting for me and my partner bearly speaks to me. I have attempted to pay back and sort things out. I haven't had any time off year and for a large part of the year I was doing three jobs. On one occasion I believed that I had sorted a payment agreement with Tesco Finance and I began to repay them. They suddenly started getting debt collection agents writing to me. I wrote back saying a mistake must have been made by Tesco as an offer of payment had been made and payments commenced. Within 6 weeks of this I received a court summons ordering me to pay. Even when I have written to the authories, complaining about the way these companies act, breaking the rules and law, they do not seem to want to know. Are they fit for purpose? I know that I am depressed alot of the time as I feel that whatever you do, the banks and lenders get away with murder and the called regulators look after their own:mad:
  7. I had a similar experience with Egg just over a year ago. I checked my balance before using my card. They then slapped on interest rate charges which took me over my limit. They then charged me £30 as I was over my limit. They made a number of calls, even spoke to a member of staff in my office as they answered my mobile. Did not do any security checks. I made the recommended payment told to me by them verbally and by there automated system to bring my account back into its limit. Guess what. They applied another charge for going over my limit during the month which placed me over my limit and another charge for going over the limit. This went on for a couple of months. I complained but Egg wrote back, ignored the contents of the complaint and said tough. Not a very nice company to deal with and they act a law unto themselves.
  8. Update. After passing the account to a debt collection agency, the debt collection agency has come back and said that the application form is the creidt agreement. They have stated that once the application form is signed, it becomes the credit agreement. Does not sound right. Anyone had any experience with this or could re lokk at the scan I have of the agreement?
  9. Surely if the account is in dispute, a default is not valid?
  10. They wrote and said that their reconstructed agreement of oct 08 is the valid agreement and they are allowed to do this. That's not true?
  11. I have a credit card with Sainsburys which I took out in 2004. I've gone through the following procedures and now need some urgent advice: 1) Subject Access Request- Sainsburys deny ever receiving my request. I wrote to the Information Commissioner and provided proof of postage. They wrote back and stated that it seems likely that they have broken this principle. 2) CCA Request- Made the request with the usual £1. Sainsburys went into default on the 1st July as no agreement was sent. They wrote on the 3rd July (received the 6th July) with a reconstructed agreement, no signiture dated Oct 08. (Agreement taken in 2004) Wrote to them stating that only a copy or the original would be accepted. Wrote back with a copy of my original application which does not confirm to the regs. To date, no copy of the original signed cca agreement, only demands for payment. I have written a number of occasions stating that I do not feel that my request is unreasonable for a copy of the orginal signed agreement. Now their solicitors are now threatening court action. Any advice? My next letter was going to be along the lines of. "As they have breached a number of my lawful requests and failed to produce a valid signed cca agreement, I will waiver any compensation claims against them in favour of reducing the balance to 0.
  12. At last I get a letter from Egg after ignoring my complaints. Guess what. They say they cannot find my complaint letter (Sent recorded delivery) Whats more, they state that their agreement is enforceable and that they will continue enforcement action. They have stated that as far as they are concerned, the complaint is closed and not in dispute. Everytime I get a response after making a complaint, they ignore everything about the complaint. Its strange that this letter only arrived after I sent a letter last week to a debt collection company after it closed its file. I sent them a 'after the debt collection agency has closed its file' letter.

Finally, they sent a copy of the original application form, not a fully compliant CCA in response to my original Subject Access Request on the 27th April (1st Oct received) This was after they regestered a default. I wrote to them stating that my CCA request under the consumer credit act was still outstanding and that they had not produced a document that fully coplies with this act. I advised them that I would take action and report them to the OFT, financial ombudsman and maybe court action as they had clearly broken OFT guidelines ect. Their response. To sell this to a third party who are now demanding payment. Any advice??
  14. No PPI. May have been an odd charge but nothing major.
  15. Sent the letter stating that is was unenforceable. Their response. To roll up the debt into one account and get their solicitors to start calling and writing demanding immediate repayment. I also had a loan with them. Offered a payment schedule and started paying. They've ignored this and roled this into the debt. The CC and overdraft are in dispute and this is the second party that they have now passed this onto. This surely is another breach?
  16. Now had Sainsburys solicitors write demanding payment. Sainsburys have ignored my letters and ignored that this is in dispute.
  17. The agreement that I received was dated October 2006, yet the account was taken out in 2004. I have pointed this out to sainsburys but they have ignored my complaints and have had their hounds 'Albion Collections' constantly call and mail me. Still unsure what I have to do next.
  18. After aknowleding my complaint and claim for compensation, over 10 weeks later I have not had a response. They have ignored my letters in between. After failing with one debt agency, they have know passed my details onto another including the telephone numbers they said they had removed. (I have been asking for these to be removed since feb 2008, long before this dispute started)
  19. Just received another threatening letter threatening to sell debt to a third party and to register a default.

After I sent Barclaycard another letter, stating that they had not sent me the orginal agreement using the pre court protocals, Mercers have dropped this and they have now passed this onto another debt collection agency. They are now making 2/3 calls aday, and leaving these meggases on bt's sms text messaging service. The phone keeps ringing as late as 9.30 at night.
  21. As an update, I sent MBNA a further letter complaining I have not received my CCA and a request under section 10 of the data protection act to remove my data and to stop calling me. Their response. An increase in calls and more threatening letters (The last one saying that from their checks, they have noted I am a homeowner and they may apply for a charge against the home) They have not replied to the contents of my letter, sent recorded delivery. They did send a templated letter today which suggested a partitial settlement may be considered, but no reference to my letter. I am not in the financial position to do this. I am very angry that they have ignored my lawful requests for a cca, removal of my information, they continue to charge interest whilst the account is in dispute and are continuing threats. I feel like counter proposing that I will not make complaints to the oft, ect ect and pursue costs/ compensation of their continual offenses in return for a zero balance. Anyone got any advice? I am getting a it fed up with sleepless nights.

  23. I have a Co-Op loan that has been running for a few years. I applied for a top up last year and they issued a new loan, consolidating the old one. I received a copy of my Loan agreements. It would appear the original one was unenforceable as it had defects on it. They have replaced this with an enforceable one. I am sure there is nothing I can do on this. Am I correct?? Secondly, I had an old loan with the Co-op which I repaid. At the time I was told I had to take the insurance as it was part of the agreement. At one point I wanted to cancel this part of the loan , but they said no. Since paid it off. Again, I assume there is nothing I can do about this as it was paid off about 3/ 4 years ago.
