Wissa, don`t panic, this is all standard stuff, if it was a day late it doesn`t matter, the court will still accept it, you need to fill in the AQ form, and send it to your local court with the £100 fee (unless you or your partner are on oncome support and are claiming exemption)

Send a letter back to Co**etts about the cpr pt 18 being unsuitable etc. you`ll get an AQ form next, that goes to your local court after you fill it in.

AQ came today, filled in and handing it in to the local court tomorrow.

I think you can`t set a precedent in a small claims court anyway.

I`ve emailed the court just to make sure it`s on the way, wouldn`t like to slip up at this stage.

I got my defence and cpr pt 18 yesterday, one day over the 28 days, I replied with the appropriate letter. I expect the AQ form will come soon, I think that`s the next stage.

Right I`m confused now, the chap at the court emailed to say that as a defence had been lodged (slightly late), I will now have to complete the AQ and send it to the court with a fee. But all I got through the post, from Cobbetts, is the defence and a CPR pt18 request. No forms that say AQ on them, am I missing something....? Any advice welcome, thanks.

More like 28 days, they leave it right until the last second. I got their defence today, on day 29, so I might be lucky there, I`ve asked for a default judgment, have to wait and see.

I put both acc no and sort code on my form and I got a similair defence from them today. So I don`t think it matters.

Just been to MCOL, it allowed me to claim a judgement by default, after all the CPR Pt 18 request did not reach me until after the full 28 days.

CPR Pt 18 request came today, do I reply or ignore...? It actually came outside the 28 days. And do I reply just to them or to the court too....?

That sounds OK, are you going to email it....? I wouldn`t bother about the additional costs bit, that`s the least of their worries, and I`m sure they know that anyway.

I`m in this situation, 28 days up today, so I`ll wait untill tomorrow and see what happens. I would think you should remind them that it`s gone to judgement by default, if trhey don`t then pay up then send in the bailiffs (and contact the local rag)

A CIFAS is similair to a default. Something the banks apparently cannot do while an account is in dispute, you need to remind them of this fact.
