  3. Thanks slick, am working on cobbling together several of the template letters into one, so that people who get these daft replies can send one letter instead of a few at once lol, will have something sorted out in the next couple of days i hope.

  5. i dont get why they are so stubborn haha in reply to my cpr request, they sent me the exact same document as posted above! I think im gonna cobble together a letter spelling it out em and disputing the account later, have to pop out now. Cant believe an organisation of this size doesnt understand the rules, regulations and laws under which it operates.
  6. Hi, sent a cca to barclaycard last monday, and in reply received a copy of t&c's. just working on a letter to politely tell them to bog off now lol. I guess thy send these because they dont have the original agreements anywhere?

  8. Dear sir/madam I write with regards to the above account with your organisation. I respectfully request that you provide me a copy by return of the credit agreement that bears my signature. I require this as I believe there may be discrepancies within the agreement which render it improperly executed. Obviously if the agreement is improperly executed, I would be entitled to ask a court to consider the agreement and make a declaration of the rights of the parties to the agreement. I must stress this is NOT made pursuant to section 78 consumer credit act 1974, but is made pursuant to civil procedure rules (pre action protocols part 31.16) and therefore an unsigned copy will not suffice. Please confirm you hold a copy of my agreement, and that you will provide me with this document. I do not view this as an unreasonable request given that by supplying the document I have asked for it will allow me to assess if my case has merit and will help resolve matters possibly without the need to involve the court, and will save costs on both sides. I look forward to your reply and would ask for a response by that look ok? i dont have any ppi probs, i always refused it I remember a program when i was about 14 about it then, and even that far back they said it was mostly a [problem] lol
  9. ok I have looked at this, does this mean if I take this route, i would eventually have to start proceedings? Or can I just get the information I need then stop short of making a claim? I would really prefer that they took the action tbh

Looks to me like just a normal typed up letter. Any advice on an appropriate reply to, they have the dispute letter was the last one i sent?
  13. i got my reply today, has left me a bit suprised, they havent even attempted to get a copy from microfiche! Will put copies up in a few once i sort the details out it is extremely clear and readable, i guess thats a plus haha

  18. I would reccomend while doing that, that you read some of the success threads, of which there are lots! After3-4 you start to realise just how weak they are, and it's fun, and will build your own confidence for your fight against them when you see just how willing people are to help on here
  19. While i think about it, can anyone point me to the rules/law governing reposession and offsetting? As i mentioned, the car was repossesed and sold on, but there was no offset, they demanded the full amount still. I know for sure this isn't right, as i have had long discussions with my finance company at the minute about this. They tell me if i sell my motorbike, i pass everything to them, and if theres any left owing, they stop the interest, and let me pay it as quickly as is reasonably possible.

  21. just confirmed it was 4-5 months, not 18, so that would have made it between 800-1k paid back.
  22. ok, total amount payable was 6.2k. over 18 months at the rate of payback, the amount paid back would be approx 3.5k. The reposession was agreed, however, the price the car was resold for was never taken off the total left, which it should have been i believe, they have always claimed he has to pay back the full amount, so in effect they were paid the full amount twice for the same item. figures are nearest approx, until i get a SAR. The firm in question were liquidated years ago i think, it was yes car credit.
  23. currently claiming 4.6k back still, bearing in mind its been being paid for the last 6 years, although at a reduced rate. Am i right in thinking though, that the APR is not a prescribed term? i was under the impression it had to be the correct interest rate.
  24. well barclays have not sent me one i requested. Incidentally, does anyone know if its easier to deal in this way with the original creditor or a dca? Just curious, as barclays cant pass the account on now it is in dispute.
  25. don't need to do page2, of the 2 pages they sent, as it's just the bank details for the direct debits, unless you need to see them. Will post the letter from aktiv in a few.
