  3. Can't remember exactly; 2004 maybe? If the CC company supplies a valid agreement then I'll pay them, as one already has done. But these are hard times and I have to feed and clothe my family; if some organisation can't do something as simple as keep their paperwork in order then that's their own fault as far as I am concerned, and I'll use that if I can.
  4. ah yeah, I never considered the bulk signing thing. It's the first time I've seen that message on the Royal Mail tracking. Dunno if I'll be using Special Delivery for my letters; for what they cost I might as well just pay my creditors lol
  5. Indeed. My aim here is to nip in the bud any phone calls or letters RW might consider. I've had three months making no payments, with virtually no contact from RW. I don't want them thinking I've rolled over, and hassling me when I fail to make payment in March.
  6. Cap One sent me this. It's valid under the CCA as it has the prescribed terms, and my details are omitted as permitted under the Act. However, it's dodgy IMHO because there are no spaces for my name, address etc. unless the white space at the bottom is where all my personal details and signature etc. were held, which I highly doubt. I've SAR'd them to see what they've *really* got. If this is no good then I'll just make a request under Civil Procedure Rules 31.16 (pre-action protocols) and request a copy of the original, and see them try to wiggle out of *that* one.
  7. Yeah, it seems a bit thin to me; I wouldn't fancy going to court on that alone. Looks like I'll be paying this one. I'd read on here a few times Egg were good with their agreements, so I was prepared for this TBH. Shame, because this is my largest debt lol
  8. I was on a DMP with CCCS as some of you know. The full story is here: http://www.consumeractiongroup.co.uk/forum/barclaycard/180374-lunar-jim-barclaycard.html I've now parted company with CCCS but unfortunately I cannot stop them sending out their latest payment to Robinson Way, who I've managed to avoid paying for the last three months. It appears CCCS have written to RW telling them payments will be coming, as I received a 'We have accepted your offer of payment from your Money Advisor' teller. Bit of a PITA. I guess this means I need to contact RW and tell them the account is still in dispute despite this rogue payment. Does anyone have any advice as what to put in the letter please?

It does seem to contain prescribed terms, but could someone please check and let me know. I also need to understand why, if it *is* unenforceable. Thanks

  14. Yeah, this is basically the route I'm going down. Payments to all those in default of my CCA requests are stopped until I receive a valid CCA. Ironically, Cap One did send me a technically valid CCA so I've SAR'd them to get all they hold, but I'm paying them in the meantime. What turns up in the SAR bundle will steer my next course of action with them, but the 40 day deadline is some way off yet.
  15. 1 Churchill Place. Previous letter (CCA request) was received ok there. I'm going to resend anyway, just wondering if I should consider my payments stopped from now, or from when the next letter is received by them.

I sent a 'the account is now in dispute' letter to BC a week ago and it has not arrived with them (Royal Mail says it's reached the Post Office I sent it from and gone no further), two other letters I sent at the same time have been delivered. Am I right in thinking that this letter is just a courtesy; because they defaulted back on the 12th then I should still refrain from making a payment to them, and resend the letter?
  17. The brown stuff will probably invade the airconditioning when the first round of payments are missed! Most of my creditors are already in default of CCA requests, the exceptions being the Student Loans Company (make that Thesis now, I just had their letter a couple of days back) and Cap One, who I SAR'd (they sent me a technically valid CCA, but it definately wasn't the one I signed). Not to worry; plenty of advice on here. I just wonder whether they will actually notice I'm not with the CCCS any more? Payments from CCCS are in a bulk, and the only people who have hassled me over getting updated DMP budgets are the Student Loans Company who I'll still be paying.
