Ok, these guys have had long enough to comply; I've had my SAR information through but I cannot find any copies of correspondence re. default or being passed on to RW other than in the control codes on the account. Certainly no letters. I'll be writing to Capone in the morning requesting they send me copies of default notices, notification that the debt had been sold to RW etc.
  4. Wow, this took some waiting for... I've just made copies of the evidence mentioned above. I will be writing with a complaint to Capone tomorrow, cc'ing FOS and OFT. I'll let you know what happens.
  5. We've had our Sky+ service for just over a year now, and have been with Sky for several years. We're on to our fourth Sky+ box and this one has just gone faulty. Luckily last time they extended the warranty for us and we're still within that period. I've no confidence in the standard Sky+ box now, and I was hoping to wangle a free upgrade to Sky HD. Anyone managed this? It'd be nice to get a discount on the HD fee (Virgin is offering HD for half what Sky is, could this be used as a bargaining tool)? Is there a best time to phone them? Cheers

  7. I suggest starting at 25% of the debt. IIRC some creditors have actually been known to accept that! A couple of years ago I settled two credit cards at 40% and 45% of the balances, and I got both my overdrafts (accounts closed by this time, just held as debts) down by 50%; I'd just won an unlawful fees claim and the bank sent me a cheque which specified the account number it must be paid into. So I phoned them first, negotiated a full and final offer on both accounts before mentioning method of payment. I then phoned them back and told them my dad was paying them off for me but had given me one cheque for the full amount. So the person on the phone kindly arranged it for me so the cheque would go into one account, they'd transfer the balance over to the second account. So instead of the bank getting things their way, giving me the means to pay off only one account and leave me with a fairly sizeable overdraft to pay them back, both debts were settled. There was actually a slight overpayment and they sent me the balance back as a refund lol Clear case of one hand not knowing what the other was up to. Ok I did lie to them a bit but there you go...
  8. I say 'no', you don't need to let them in. IIRC a bailiff can only seize goods if you have failed to meet your obligations under a CCJ, and the creditor has been back to court to enforce? I'm sure someone will clarify it shortly.

  10. OOH... I've just opened envelope #3, Mrs Lunar's other SAR response. Same letter from Ellie as I mentioned, but on the statements there *is* PPI, on the first two months the account was running, so Mrs Lunar obviously cancelled it at some point. And lo, Mrs Lunar ticked the box on the application form saying 'no PPI'... Capone really couldn't find their arse with both hands, could they?
  11. Heh yeah, it's exactly the same as the covering letters on Mrs Lunar's SAR responses... Is this a big oops for Capone, just out of interest? It'd be nice to menace them a bit.

  14. Capone's response to our SAR requests arrived today. I've been going through Mrs Lunar's account which was sold to Robinson Way, and while there are copies of letters from Lee Powell and the lovely Ellie Renshaw, there is no sign of any letters telling us about defaults, or that the debt has been assigned to Robinson Way. The only indication is on screenshots of their system showing chargoff bad debt. I can't see anything in the system notes, or any suggestion of automated letters being sent, although could this be held as a code or a flag? It's not obvious if it is, and I can't see reference to 'DEF NOT' (Default Notice, according to their supplied notes key) in the notes anywhere. So, what's the current situation with regards faulty NOA's and Default Notices? There is also some bullsh*t on the notes, for example 'Disclaimer read to cardholder and agent xxxxx accessed account, at 2am recently. Err, no, neither Mrs Lunar or I spoke to Capone at this time. There is a 'Capone Classic' on my own SAR response, I'll post a thread shortly about that one...
  15. Indeed. Where I work you'd be looking at disciplinary action if you claimed movies, excessive drinks etc. through travel expenses. Not that you'd be able to because they scrutinise each invoice you submit and query all that stuff. But that's the private sector. It seems the public sector is a free-for-all? Edit: That said, at the company I worked for before this one, expenses were a joke. Staying in a hotel you could claim what you wanted because no-one at the company saw the invoice as it was all handled through a booking agency, who paid for it and submitted one big bill to my former employer every so often, so your inflated claims were always missed. One of my colleagues ran up a £400 hotel bill over a two night stay; bearing in mind the room rate was £80 per night that's a fair few drinks... So maybe no-one was checking?
  16. I know what you mean, I was plodding along on reduced payments for a couple of years until Capone got funny over one of Mrs Lunar's credit cards and flogged one of them to Robinson Way. Since I'd not delt with a DCA before I googled to find out what to expect and ended up here. As a result we've ceased payment on over half of our alleged debt due to either non-recept or faulty CCA's. This includes two more Capone cards. So if Capone hadn't decided to be arsey they'd still be getting paid on the other two cards. And if Barclaycard and NatWest are reading; blame Capone for us not paying you (as well as yourselves lol)
  17. Already have, and that the account remains in dispute... Their letter (including the items mentioned) arrived a couple of months ago, and they've sent a couple of random T&C's since. No reminders about missed payments yet, other than they mentioned it in passing in the letter in their latest mailing. I guess the 'pay up or else' letters will come later,
  18. Skyline, best to start your own thread, it'll help you and people helping not get confused First off, what is the debt for; credit card, loan, overdraft? Kick a thread off and include this info plus anything else you can, and you'll be in control of the situation in no time

In response to my CCA Barclaycard sent me a letter saying basically: 'we have enclosed: 1. a copy of your application form 2. a copy of the T&C's at the time you applied' Totally not enforceable. Only they keep sending my T&C's. I had their latest a couple of weeks ago. This morning they sent a copy of the T&C's at the time Mrs. Lunar (for it is her card) took out the card again. Only it's in a different format to what they sent initially. What are Barclaycard doing? Screwing up somehow? Or is their some method in their apparent madness???
