  4. So they won't be subject to any 'bad' advice which may come from here, which is what 'smarterchick' was complaining about. There are many other avenues of advice which someone can take, CAB being one which springs immediately to mind. And yeah, I agree with your comment about regulation.

  6. But that's the point. People Google these days if they need help. They Google for help with cars, computers, neghbour disputes etc. etc. because they don't have the knowledge or experience themselves. So if someone finds this site, reads the posts, asks the questions and gains the knowledge to stand up for themselves then it's more power to them, and more power to the poeple offering that advice.
  7. Not being funny but if mr ton offers the experience he has gained by screwing his creditors here and helps 20, 30, 100 people who really are in need then it's a win, in my book.
  8. So IMHO the OP would be better off leaving them for now, not contact them, not make a token payment or otherwise acknowledge the debt and hope they drop completely off the radar.
  9. Just want to check something: those first three which are a couple of years old and have had no contact about... If they run another four years like that they will be statute barred and won't appear for credit checking etc.? But if the OP pays them off now then it'd be six years from now before they 'disappear'? If this is the case would it be worth taking a punt that, since no contact has been made for a couple of years this will be the status quo for the next four years? If during that time the OP is contacted then they could just go down the CCA route anyway. And if the limitations Act is amended to three years as they are talking about then all the better.

  11. Hi Noomill! No sign on PPI on the statements as far as I can see, though I was already on a DMP when the balance transferred to BC so I guess they wouldn't have added it on? Not sure about MS though, I guess I'd have to SAR them to find out.
  12. Ah, I've only just sent off the initial CCA letter a couple of days ago. I'm a bit further on with a Capital One card, I thought I'd use them to test the water. I wish I'd just done them all in one go TBH

  14. Nah, unless you've something better to do then stay on the phone with them. Be polite and courteous but continue to refuse to play ball. Keep smiling while you talk to them, it'll help your demenour. Keep them on the phone as long as possible, and make *them* hang up in frustration. Why? 1. It's fun, especially if you remain calm while they lose all sanity on the other end. It may help you feel empowered and in control while they scrabble around 2. It's costing them money to phone you 3. While they are wasting their time with you they aren't hassling some other poor bugger If you *do* have something better to do, tell them you just need to answer the door (lie, like they do to you...), put the phone down next to the TV and get on with your life. Check your phone's call log if it has one and see how long they actually waited for you before hanging up.
  15. I don't think this should be in the DCA forum. Although the Government sold the debt off, the debtors may not be delinquant. It was more like the Government outsourcing the administration and collection of existing student loans IMHO. And not at all a quick way fror the Government to get some money back into the coffers. Oh no But I reckon this should remain in the Student Loans forum unless it is passed on to e.g. Lovetts or something
  16. No problem at all. History on it is that the first one (to Robinson Way) was put on hold on 12th December and yeah, CCCS gave me a bit of a grilling as to why I wanted to do it. The second two, which I did today for Cap1, the guy I spoke to was really good. I told him I already had one on hold, needed two more putting on hold due to being in dispute, and that I was about to write to my remaining creditors requesting CCA. He said 'no problem', immediately put the Cap1 payments on hold, discussed a few things with me around corresponding with creditors and DCA's (e.g. adding 'cc Trading Standards' to my correspondance), and even went as far as sending me a letter template for requesting CCA (similar style to what we see on here, bit less wordy maybe lol). I don't know whether this is a new CCCS thing, or whether he was a clued up employee offering his own advice, or maybe experience? Maybe CCCS are getting more calls about this sort of thing? I guess I'll find out next time I call CCCS to put a payment on hold lol. Also, the payments to RW really are *not* being sent; my two latest statements from CCCS show 'Payment This Month' and 'Payments To Date' to RW as £0.00 But yeah, I'll post my experiences with this on the forum, hopefully others will find it useful.

  18. Sorry yes, they are on hold with the CCCS. The first one went on hold back in early December. For that one they did quiz me a bit but it was ok. I put the other two on hold today; I just explained that they hadn't fulfilled their obligation under the CCA and CCCS just did it straight away. Just explain why you want to do it, and they should be fine with it, after all if there is any problem they can just release the funds so it shouldn't be any skin off their noses I don't think

  21. Would it be worth stopping the payments and see who complains? You never know, if no-one has moaned when their monthly payments were reduced then they might not contact you this time either. Contact the CCCS and ask them to put the payment for this one on hold. What they will do is keep taking the payment from you as normal, but the payment to this particular creditor is suspended and held in trust. So if someone writes to you saying 'where's my payment???' then you just tell them it must be an oversight or something, phone the CCCS and instruct them to release the payment. They will then send all they are holding in trust to that creditor and all is fine. If no-one contacts them in three months, then everything they hold in trust is spread amongst your other creditors and this particular debt is removed from your debt management plan. If they don't contact you then it's their loss I guess and you never know, you might even end up with a statute barred debt! If they contact you outside of the three months then just CCA them and go from there. I've got three creditors on hold at the moment due to accounts being in dispute due to poor CCA responses...
  22. My wife and I have three Barclaycards between us. One was taken out over 15 years ago. The other two previously belonged to Goldfish, and belonged to Morgan Stanley before that. I've just CCA's them today. What are the chances of them actually holding a valid agreement?
