  1. Squirrel Don't see why it would be different... the card and terms are under UK law...difficult and expensive to redress from the UK. Inability to pay is the same wherever one resides, if hard times bite. The implications of this go further than I would care to express here. J2020
  2. Thanks Slick132 I have noted some of your previous posts with interest...(and charges lol). The card(s) was from time in the UK, am now in Australia. The S.A.R. is the next step...Should I wait, no CCA, refuse payment, trigger their demands, then send S.A.R., or get going now? I have the same situation with MBNA - same actions? Would love to know what the quickest route might be to come to a settlement with these 'people' - paying off the whole amount is not possible right now, however partial as F and F is...?   4. Hi The address in the UK is a physical one, and your friends, and as such is a convenient 'target' for Egg...and potentially annoying and embarassing for you and friends. A PO Box in Australia is cheap, get one, change Egg address, then that clears that up, IMHO... As for the debt, much reading here suggests: a - Consumer Credit debt not enforcable outide UK (if so, very rare and expensive in Aus b - the debt is yours, not your friends c - they (Egg) don't have much of a leg to stand on...WRITE to them, explain, use the templates here and suggest partial settlement or write-off of the debt...?   5. Hi All, Tomorrow brings up day 14 after my CCA request to MBNA and another. These were sent and tracked by a co-combatant in the UK, however my MBNA address is in Australia. Does the 12 +2 apply regardless of international circumstances? Am I also correct after much reading here that I am being too kind, and could simply ignore the remainder of the (1K debt )(am now on full interest and years of occasional charges)??? Perhaps offer them a settlement? Next payment is due 22 Jan, I will allow this time for the CCA to appear...any recommended next step? Also, this agreement is 7-8 years old - does this have any relevance? Many many thanks, J2020

  7. Sandy, you probably CAN be responsible. As suggested by 42man, (list all debts that you can, determine the latest owner and address) send CCA and wait. This equals a fight back, fire with fire-style...you may not need to go down the bankruptcy route, although as mentioned that may not be an option unless you return to the UK to be present for at least some of the Bankruptcy process. You can however legally take them to task and request that they 'prove' the debt, and have answers to this within a short space of time. Immoral - or unethical - or dishonest??? Debt is debt, we take it out, pay it back...worth a mention here >!>?!? The degrees, methods whereby and extent to which we are charged, penalised, and personally harrassed I guess are where the ethical and moral questionableness arises in this forum...unless you 'morally' disagree with 'credit' as a function. Participating in a consumer credit forum to argue the morality of 'credit' per se is redundant, I think... Announcing one's views on debt-evasion is no doubt an individually respected right...'preaching' those views I think becomes somewhat abusive of the right, within the context of the forum. Yes, it's law in the end, an ass, and/or what you can make of it. Preaching my views on preaching is outside the scope of this Thread, Topic and Forum...I'm off to Consumer Preaching Rights! J2020

  10. Hi exmbnatstaff Thanks for the info... Hey, why have mbna decided to annoy, and potentially default, a lot of people by whacking up their minimum payments beyond the old 5% level? Also, are you implying that it might be useful to get beyond 90 days, in order to make a settlement offer at a reduced 'f and f settlement' figure? Many thanks J2020

CCA is Credit Card Agreement - the original credit issuers need to have in their posession an original of your signed CCA - search these forums for the right details of this! It is part of the 'fight' that they provide a copy of this to you upon paid request.   16. Hi Nicoblue A bit of info I found out - Not to suggest you should neglect your UK affairs, but the current Credit Reference agencies are separate in the UK and Australia. As they need to pay to search files overseas, they don't currently seem to do this, for certain individual matters at least. So your current 'predicament' in the UK will not stop you obtaining credit, or your status, in Australia... Keep going with the token payments, etc, and hope to offer them a payout at some stage. As above, I am not an expert in Law, but have experience with this info above. Hope this helps a bit. J2020
  17. LOL "they only accept minimum payments over the phone"... I'm sure this is for 'security reasons' or some such? A very handy way of stopping you paying them more, as well... It's a strange way to run a company, that's for sure! The 'flat fee' is news to me, would be interested to hear how widespread it has become - and the rationale - that's supposing there is any intelligence behind these moves?!??!? ATB J2020
  18. Hi Greatwonder First, 34.9%!?!?!? Wow. Hell! Holy shmoley! I thought Monument was King of the Disgraceful Rate. A-mazing! I've had many cards, but never a 'fixed' payment until now, always a % min of the balance. I think your logic is right there as to why... Would love to discover just what the 'people' in charge of Marketing or the Company think they might achieve through all of this? Angry customers, a bad (worse?) reputation - fantastic marketing move guys! BTW, I guess you know, you can pay off as much as you like beyond the minimum payment, this WILL reduce your balance. If it were me, I would pay the WHOLE amount and not let them apply their loathsome % rate at all. Regards J2020
  19. Hi All MBNA have just upped my MMPayment from £7-ish to a flat £25! Phone call revealed it was 'in the interests of our customers, when after coming from promotional rates, the £5 plus interest was (basically)stretching out their debt period'...I laughingly complimented the 'spin' - lead balloon comes to mind.. Anyhow, I asked for lenience, no deal, cried broke - no deal, asked for a payment deal - I had to default on two payments (£12 x 2 thanks) before a deal was offered ... Has anyone else just received this news, or am I the lucky one? And what to do? (BTW, I had advised them, with two other CC companies several months ago that I was in dire straights, but have maintained my payments to MBNA...maybe they were upset at being 'left out' :-?) J2020
  20. Great, great forum, very glad to have discovered you all! I lived in the UK for 15+ yrs, am now in Sydney for a while, but still battling along paying UK Credit Card debts from the last few years. Not huge, enough to bring on the despondency that this level of debt is notorious for encouraging... Have battled with Halifax recently, they have whacked me more than a few times after buggering up my internet access, for checking statements, etc, whilst overseas. Got behind - £12 thanx! Late a day? - errr, £12...Oh, that's a purchase, you now have purchase interest on that... Are Halifax THE most hard-headed to deal with? They refused a 'full and final settlement' enquiry I made over the phone in the last call to them - along with refusing to refund any of the charges applied. So it's gloves off! Great forum and resources, can't wait to kick 'em in the b...s The posts relating tales of success are very inspiring! Jaystar2020
