  1. A couple of late payments initially about 18 months ago, payed about a week late..They then put on a late payment charge, that had the knock on effect of me exceeding my credit limit, thus another charge for exceeding the credit limit...I've been paying by D/D since, but the problem is, is that the 'minimum payment' isnt enough to over the interest charge, so the net result is that the balance increases each month, thus every month they slap on a 'credit limit exceeded' charge...

I sent Vanquis a CCA request around 2 weeks ago, recieved their reply today, and have attached it to this post...To my untrained eye, all they've sent is a photocopy of their general credit card T&C's....Is my next step simply the 'account in dispute' letter?....Also, over the last few months, they've also put on my account over £300 worth of charges, should I include that in the 'account in dispute' letter or in a seperate letter?... I'm not actually challenging the credit agreement, as it was an online application in 2007 which I believe doesnt require a signed CA, rather I'm trying to get their penalty charges refunded......A quick bump on this thread, as having recieved their 'get stuffed' letter, I really dont know what my next course of action should be....can anyone please help??.....Is court action my only hope now?....Just the thought of court sends shivers down my spine!

  5. Morning everyone, I'm after some advice. I've incurred numerous charges over the few months from Shop direct regarding 3 catalogues, so I sent off the standard letter for refunding the charges using one of the template spreadsheets shown in the attached letter. ....I recieved 3 letters back today, which I will quote below... "Dear Mr xxxxxxx I am receipt of your request for adinistration charges on your account to be cancelled. These charges were applied as the minimum payment, shown on your statements, has not been made every 28 days as required. I am therefore unable to cancel the charge It is in your best interests to ensure that the correct payment is made on a regular basis to avoid further charges being made Details of the application of administration charges can be found in your catalogue Yours Sincerely C North Collections Department" So basically they've told me to get stuffed! Any advice on my next course of action, as the amount of charges that have been put on my accounts equals half the balances! Please help! cag shop direct refund letter.doc

  8. a quick update, I've made arrangments to pay for 2 out of the 3 accounts that are in arrears, am waiting to hear back from empire......They all keep on sending me letters (2 a month) adding on £12 charges...Can these charges be re-claimed?....has anyone had success re-claiming charges from Shop Direct?

Hi, I've fallen 3 months in arrears on my welcome finance loan (taken out nov 07 - payments £200 per month) due to long term injuries which are hampering my income potential as I'm self employed)...Anyway, a chap phoned up saying that he was from their collection team (OFB Branch) demanding payment...I mentioned that my income was down, but dont want to default any further. He then said I'd have to have the load re-written, lower interest but over a longer time period, thus a lower monthly payment....I managed to make a token payment of £65 last month, but am unable to pay the same this month...Is it best then to have the loan re-written?.....are there any other avenues I can persue?
  10. God, these apex muppets are doing my head in...despite the account being in dispute, as they havent provided a CA so far, they are still bombarding my house with calls, and now another letter recieved offering a reduced settlement figure...whats the next step?..complaint to OFT?
  11. quality post...lol.....I've had the same 'closing our file' letter from lowells for first direct & barclaycard, am now a very relieved chappy after the years of hassling phonecalls & threatening letters
  12. quick update, the hearing for setting the judgement/warrant aside has been granted and is in 3 weeks time..CCA'd horwich farrelly/robinson way a month ago but no reply...is it time to SAR them?......now this morning recieved a letter from robinson way offering 'an opportunity to discuss ways of how to pay this account' and such like....Seems very odd there writing now, knowing full well that there's a court hearing in a few weeks...Are they allowed to do this?...reading between the lines, I'm starting to wonder if there getting a bit worried!
  13. aye.....they phoned me up a couple of weeks ago, caught me on a bad day, demanding payment and such like...told them the account was in dispute..The rude caller ended up admitting they own the debt now, so I basically told them not to phone anymore, and contact in writing only,and basically to 'put up, or shut up'....vultures!
  14. good news on the Lowell issues...I've had a letter back from re. barclaycard, also stating they cant get a CA from barclaycard thus have closed the file and not pursuing for payment! ....That 2-0 to me over Lowells!! However, APEX seem to be totally ignoring the 'account in dispute' letter I sent a month ago......recieved a letter a month ago in reply to CCA request stating that they were liasing with OC for the original CA, then nothing until this morning when I recieved the letter below ....Should I just ignore this letter?...or if not, what's my next step?...Are they allowed to ignore the 'account in dispute' letter??
  15. a quick question...I've prepared a list of charges & excess fees, am ready to send the letter, but am wondering, whats the correct amount for the court fees to put in the letter, and what interest rate for the charges should I apply??....thanks in advance
  16. Just phoned them....jeez, what an arrogant bunch they are....they refused to give me the info required and said 'the client' will be in contact in the next few working days.....OC was littlewoods, then passed to phoenix recoveries....shall I just CCA requestthe pair of them?
  17. I sent off a cca request for an old pre 2004 littlewoods catologue...The debt was originally passed to phoenix and then to BCW...Got the following letter from BCW this morning...Whats the next step, CCA request to littlewoods or Phoenix recoveries?
  18. Woohoo!....its nice to stick two thumbs up to the 'bar-stewards' after all the threatening calls/letters over the years! If the debt is sold on to another DCA, isnt there somekind of legal procedure with the courts to get the debt struck off if its been proved there's no credit agreement?

TBH, I'm not denying the catalogue debts, just checking to see if they are legal, so with that in mind, I've re-submitted the CCA requests, and have made arrangements to pay over 12 months to clear the balances on the presumption that the CCA's are 'cosher'...'Do the right thing, because its the right to do'..and all that stuff!
  21. Thanks for the support ...draft order/witness statement/N244 sent to the court...Nervous, but hopefull it will be set aside, then we can mount a defence/counter-claim! A complaint has been lodged with the S.R.A......

I dont have £14 let alone 14,0000!....Can they enforce this? or is it scare tactics by them?.....I've been paying £45 a month to them for the past few years!...please help, thanks!
