A quick update..recieved a letter from the Ministry of Justice bailiff today demanding payment by 24/06/09 or they would seize goods.......N244 sent to the court today, special delivery, ...Northampton Bulk clearing centre confirmed over the phone that the original CCJ was served at her previous address, despite the creditor (and associated solicitors) knowing she no longer lived her (they sent default notice to her current address)...she had no chance to defend against the CCJ, thats the basis for the N244 application.....No reply to the cca request dtd 21/05/09 from Horwich Farrelly (have confirmed it was delivered and have electronic proof of delivery)...whats the next step?, and does anyone on the forum know whether or not the N244 might be successful??.....the original NEXT application card had no proscribed terms on it, and no credit agreement was signed (the account was opened in 2004)
  3. Ok, letters typed and mailed (recorded delivery)....I've cancelled D/D and Standing order, as I noticed that the template letters say they cant take payment whilst its in dispute...Have I done the write thing cancelling payments?
  4. Well done!!...great news!......a quick question,what were your charges?...were they charging you £12 a time, or more?
  5. also, if I send in the dispute letter, do I stop paying, or continue to pay until resolved one way or the other?
  6. I've got to send the whole lot of cca requests off again, thanks to the royal mail's incompetance, as they've lost the recorded delivery!!.....just as well I've saved them on my computer...oh well, another 12+2 days to wait!

I sent cca requests to both lowells and apex back on May21st regarding old loans which I've been paying to both lowell & apex....both companies have wriiten back to me stating that they are going to have to contact the original creditors to retrieve the original cca's and that it will take a lot longer than the 12+2 days to reply?.....What's my next step, and do I have any right to reply to this, as I was under the impression that they had to reply with 12+2 days?...any ideas thanks
  9. a quick update, despite sending 'request for cca' letters, I have had no reply from shop direct (they were send recorded delivery on May 21st)....any idea of my next step please?
  10. sorry, not a default notice, but a pre-escalation notice from NDR for one catalogue account...nothing for the other catalogues.....I'm going to offer them token payments in the interim.....cuurently we have 8 shop direct accounts....5 are up to date, no arrears, 3 are 3 months behind

  12. 3 of the accounts are in default (NDR Collections)... I'm going to attempt to upload the agreements!
  13. distant selling regulations?....regarding cca's, they sent me both my copy and their copy of the cca, i didnt send anything back....if they dont need that cca, then doesnt it seem pointless sending cca requests in?....I'm sat here by the computer with a bemused look on my face....can anyone clarify where I stand, and whether or not its worth persuing?

  15. Shop direct seem to have an abundance of mailing addresses!.....Which address should be used to the CCA requests??...... thanks!

I've been looking at her correspondance from horwich solicitors, the last letter she recieved from them requesting payment was dtd 23/6/08 at her current address (mine) so they already knew her new address, they have admitted on the phone that they submitted ccj papers at her old address even though they already knew she didnt live there!....is there any comeback on this?.....In the interim, she's requested a CCA from horwich, and a N244 to stop further action for the time being.....

  19. a quick update......apparently next sent my partner a simple card-form, requesting name, address, dob etc, she sent it back, unsigned, and they then opened up a credit account for her....nothing was ever signed, no even on the application card....she's done a bit of research on this this past hour or so, and 'next' seem to have a reputation of opening credit accounts for customers without any signed paperwork what so ever...jeez, what a minefield!

  21. the only communication she has is a letter from Horwich dtd 23/06/08 stating that she had defaulted on her payment arrangment....She's phoned the courts and they are sending out an N244 form to have the claim set aside and a form for low income families to have the £75 fee waivered....No credit agreement was signed so is this debt still enforcable?......she didnt know it was going to court....what she had hand delivered this morning was a 'Request for re-issue of warrant'
