Hi Toymaker thankyou for your kind wishes in a strange way i find it quite amusing they dont read the letters and still send the same unreadable rubbish!! i also like putting the phone up to the tv when they think its ok to phone when ive asked many a time ,response in writing only please hehe its all fun

  4. Hi send them something like this Dear Sir/Madam Thank you for your letter dated the xxxxxxx the contents of which have been noted. You have failed to respond to my legal request to supply me a true copy of the original Consumer Credit Agreement for the above account. On the xxxxxxxx I wrote to you requesting a copy of the credit agreement under the Consumer Credit Act 1974 (Sections 77-79). On xxxx of a member of your staff signed for delivery of my written request and I have an electronic proof of delivery showing their signature and the date. To date you have failed to comply with my requests These documents I requested should be readily available as proof of your legal right to collect this account under the Consumer Credit Act 1974. In my letter of the 19/11/08 I made a formal request for a copy of the signed, executed credit agreement for the above account under section 77(1) of the Consumer Credit Act 1974. In addition a full statement of this account should have been sent to me detailing all debits and credits to the account. Furthermore You are aware that the Consumer Credit Act allows 12 working days for a request for a true copy of a credit agreement to be carried out before your client enters into a default situation. These limits have expired. As you are no doubt aware section 77(6) states: If the creditor fails to comply with Subsection (1) (a) He is not entitled , while the default continues, to enforce the agreement. Therefore this account has become unenforceable at law. As you have Failed to comply with a lawful request for a true, signed copy of the said agreement and other relevant documents mentioned in it, Failed to send a full statement of the account and Failed to provide any of the documentation requested. Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS. Furthermore I shall counterclaim that any such action constitutes unlawful harassment. Please note you may also consider this letter as a statutory notice under section 10 of the Data Protection Act to cease processing any data in relation to this account with immediate effect. This means you must remove all information regarding this account from your own internal records and from my records with any credit reference agencies. Should you refuse to comply, you must within 21 days provide me with a detailed breakdown of your reasoning behind continuing to process my data. It is not sufficient to simply state that you have a ‘legal right’; You must outline your reasoning in this matter and state upon which legislation this reasoning depends. Should you not respond within 14 days I expect that this means you agree to remove all such data. Furthermore you should be aware that a creditor is not permitted to take ANY Action against an account whilst it remains in dispute. The lack of a credit agreement is a very clear dispute and as such the following applies. * You may not demand any payment on the account, nor am I obliged to offer any payment to you. * You may not add further interest or any charges to the account. * You may not pass the account to a third party. * You may not register any information in respect of the account with any credit reference agency. * You may not issue a default notice related to the account. I reserve the right to report your actions to any such regulatory authorities as I see fit. You have 14 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint. I would appreciate your due diligence in this matter. I look forward to hearing from you in writing. Yours faithfully print no sign

Hi ukmp3 well i got a response today another copy of an unreadable loan agreement with a folded line down the middle so you cant see any of the figures!! this is the 3rd time they have sent this so im guessing thats all they have dispite me sending them a letter informing them its unreadable!! sorry for hijacking your post Sarah
  6. Ok so any ideas how we should proceed now? the car still exsists it was trading in with a dealer we just want the money back on a brand new tax disk which was purchased a few days before the old car was traded
  7. Hi well im guessing the first letter they sent they belived my husband still had the car now we have sent the 2nd letter to prove it was part exchanged i havent a clue why they cant refund

Hi everyone need some advice this is the letter my hubby sent to the dvla Dear Sir/Madam Im writing to you regarding the letter sent to me on the 10/02/09 saying you have rejected my vehicle tax refund. The car reg was ************** Vauhall Astra 16v bertone auto. I have since re-visited your offices to discuss this issue and they informed me you couldn’t refund me as the car is still registered in my name and your rule changes that applied on 01/01/09. I have been informed if I send you proof of my issue you should be able to sort out the problem. I have enclosed a copy of the receipt that the car was taken in part exchange by a motor trader on the 10/12/08 And a member of your staff agrees the rules did change on the 01/01/09 but my refund was received at your offices with receipt on the 17/12/08. The receipt is also enclosed. thats the general gist it will be three weeks next tuesday since they got this 2nd letter and we have had no response any ideas how he should proceed? the tax disk was brand new so i cant see why the wont just refund thanks for looking Sarah

  10. They will say anything to get money from you some threaten charging orders on property , court etc lies lies lies it means nothing trust me dont play their game your be so much stronger when you have read more posts take care

  12. Please be aware of the latest credit card [problem] :- This one is pretty slick since they provide Y O U with all the information, except the one piece they want. Note, the callers do not ask for your card number; they already have it. This information is worth reading. By understanding how the VISA & MasterCard Telephone Credit Card [problem] works, you'll be better prepared to protect yourself. One of our employees was called on Wednesday from "VISA", and I was called on Thursday from "MasterCard". The [problem] works like this: Person calling says, "This is (name), and I'm calling from the Security and Fraud Department at VISA. My badge number is 12460. Your card has been flagged for an unusual purchase pattern, and I'm calling to verify. This would be on your VISA card which was issued by (name of bank) did you purchase an Anti-Telemarketing Device for £497.99 from a Marketing company based in London ?" When you say "No", the caller continues with, "Then we will be issuing a credit to your account. This is a company we have been watching and the charges range from £297 to £497, just under the £500 purchase pattern that flags most cards. Before your next statement, the credit will be sent to (gives you your address), is that correct?" You say "yes". The caller continues - "I will be starting a fraud investigation. If you have any questions, you should call the 0800 number listed on the back of your card (0800-VISA) and ask for Security. You will need to refer to this Control Number.. The caller then gives you a 6 digit number. "Do you need me to read it again?" Here's the IMPORTANT part on how the [problem] works the caller then says, "I need to verify you are in possession of your card." He'll ask you to "turn your card over and look for some numbers." There are 7 numbers; the first 4 are part of your card number, the next 3 are the security numbers that verify you are the possessor of the card. These are the numbers you sometimes use to make Internet purchases to prove you have the card. The caller will ask you to read the 3 numbers to him. After you tell the caller the 3 numbers, he'll say, "That is correct, I just needed to verify that the card has not been lost or stolen, and that you still have your card. Do you have any other questions?" After you say, "No," the caller then thanks you and states, "Don't hesitate to call back if you do", and hangs up. You actually say very little, and they never ask for or tell you the Card number. But after we were called on Wednesday, we called back within 20 minutes to ask a question. Are we glad we did! The REAL VISA Security Department told us it was a [problem] and in the last 15 minutes a new purchase of £497.99 was charged to our card. Long story - short - we made a real fraud report and closed the VISA account. VISA is reissuing us a new number. What the [problematic] want is the 3-digit PIN number on the back of the card.. Don't give it to them. Instead, tell them you'll call VISA or MasterCard directly for verification of their conversation. The real VISA told us that they will never ask for anything on the card as they already know the information since they issued the card! If you give the [problematic] your 3 Digit PIN Number, you think you're receiving a credit. However, by the time you get your statement you'll see charges for purchases you didn't make, and by then it's almost too late and/or more difficult to actually file a fraud report. What makes this more remarkable is that on Thursday, I got a call from a "Jason Richardson of MasterCard" with a word-for-word repeat of the VISA [problem]. This time I didn't let him finish. I hung up! We filed a police report, as instructed by VISA. The police20said they are taking several of these reports daily! They also urged us to tell everybody we know that this [problem] is happening . Please pass this on to all your family and friends. By informing each other, we protect each other. i was emailed this a minute ago so i thought i would share it with you lot , feel free to copy and paste this to everyone you care about

  15. Hi they couldnt provide a halifax credit agreement for my husbands credit card and a readable copy of his loan so we stopped paying them , they still add charges and phone but thats it dont panic

Hiya i bought coloured contact lenses from an online shop mine are prescription and i have dark eyes the comments on there were the same that their amazing change your eye colour etc did nothing i phoned up they agreed that it was misleading on their part and i sent them back even the opened open ones got a refund and postage back i reckon the best thing to do is copy and paste the comments and put them in an email and say you wouldnt of bought them if these things hadnt been mentioned and you feel you have been mislead how did you pay ?
  17. Thankyou its always nice to have a bit of support my husband gets a bit worried that we will lose the house etc even tho we pay priorty debts and theres no equity in the house i know their just blaggers hence why they would rather phone then write

Hi underdog i asked my husband and hes not sure if he took out ppi just went thu all the sar stuff and the letter that went with it says they havent got copies of his bank account yet so i cant check how much went in when he got the loan. i dont mind you being nosey ask away im just going to send them a letter stating the agreement is unreadable and see what delights they come up with next

Hi Angel yes ive sar and cca them i will look thru the sar and see what amout was credited when he took the loan out , looking further into it it looks like the extra was for insurance not sure how that works!! they have tried to back it up with a statement with figures of the same amount as the copy paste job Sarah
  20. hiya i cant answer all your questions my husbands having trouble with his halifax too!! i will tell you something they think their above the law and are in dispute with his account and will do whatever they want ie phone or default ,threaten etc... there not aloud too but that doesnt stop them i think what you have paid you cant claim you can only claim illegal charges back i believe
