  1. okay the only reason i lost was because i was told that i exaggerated my first post I had said: Hi, My car was clamped while on my property (rear driveway) - private property. The clamper knocked on my door and demanded payment. I jumped into another family member's car and blocked the driveway so he could not remove my *company* car - which was owned by a company but registered in my name. He then jumped in his truck and reversed onto my drive, blocking the entire pavement, forcing pedestrians to walk on on the road. I have pictures. In doing so, he damaged my neighbors wall. I then brought my dog out to say hello - he said while holding his ground on my land, that he was calling the police and would have them kill my dog. I then called the police myself who arrived about 30mins later. I said that the driver had trespassed on my land and had clamped my car. I asked them to tell him to move off my property and stop blocking the road/pavement/driveway. My neighbor also came out and demanded he move his truck. The officers that had arrived clearly did not know the law. They asked the truck driver to clarify the law for them. They checked his ID and his paperwork and said he was within the law to carry out removal of my vehicle on my land (due to a parking ticket from god knows when). I said he could not take my car as it was a company car, that i needed it to earn money, and that I had read on the Citizens Advice Bureau website that they cannot take anything that would prevent you from earning. I was told that the CAB site was rubbish and that they would take my car regardless. I checked his ID and it was only a work ID card for the bailiff company. This did not have an expiry date, nor did it have a court stamp. He was a mere driver but was acting as if he was a certificated bailiff. The police upheld his rights and rubbished mine. That is illegal and I am making a complaint to the IPCC (I spoke to an Inspector who tried to say that the police were powerless in these situation). The fact that they had let a clamper act like a bailiff on my property is of huge concern. About an hour and a half later a certificated bailiff had arrived and started shouting like he was the law, that he was going to climb through my windows, that he was going to remove the other car at my cost, that my car was only worth £900 (it's actually quite rare and worth over £10,000). I asked the police what to do - they said I must pay or I may have both cars removed. I was then forced to pay over a grand for a £50 parking ticket issued by the Council. He then ran off with my credit card to his van - illegal too. He then gave me a piece of paper with his company and details of the charges - £155 + expenses + 34 credit card charge. He was about to drive off when I demanded a receipt, he then went to his van and wrote one out. Now: I'd like my grand+ back I'd like my neighbors wall repaired I'd like the police officers that arrived disciplined for not knowing the law and not knowing what a bailiff's ID card should look like. IPCC. I'd like the council to apologize - they hired cowboys. I'd like to the Bailiff's certification revoked as he did not follow procedure - and acted like a complete amateur, above the law in front of the police I'd like their contracts reviewed / canceled. Can anyone help advise on the best way forward? I am thinking about making a complaint about impersonating a bailiff - today. Regards Hazzinksi the bailiff changed his story so his times contracdicted mine truth is that when i made the post i had edited it later (upto the 7th April) , pushing the sentence "About an hour and a half later" down the page, i added the info and forgot to review & update the "About an hour and a half later" silly me sorry for the delay in providing this info, but it is key the perjury i had sent an email to cag admin to get the original versions but no response - if any CAG admins see this, can you please email me all versions of my original post - THANKS!
  2. hi shed, Let's get some stats, i reckon 80-99% of orders involving bailiffs and consumers at home are large corps or gov - terrorise me at my home if i am wrong! does anyone have any figures? if i owe £10 to the corner shop guy, he would not get litigious if i owed £10 to BT, Gas, water etc they would get very litigious then start selling the £10 debt until it was £100 - they are the reason why we have in our socety 'bulk' litigation centers - not for the people, but for the corps i think the can't or won't is irrelevant here - in fact i believe it is no one's business - right to privacy, right to peace at home etc it is simply paid or not paid the industry loves to extract lots of private info on people to determine this - cant vs. wont - i think it's none of their business - only perhaps someone good and honest like a bonafide debt counseller should be told if can't or won't by differentiating can't/won't they use different debt attack strategy - why? perhaps some people who can pay won't pay because they're ethically obliged not to be intimitated by threat and fear therefore making them into a can't pay this should be the theme tune for CAG - back to the 80's!   3. who do you mean by creditors? banks? councils? finance/hire purchase companies? if so, tell them that they should not lend so much next year - it might not all be paid back but they can't - as it will affect sales/growth projections for everything no credit no sales no xmas bonus it's a big bubble that they all pumped up too much without realising the consequences the industry would not implicate themselves in protecting the consumer (look how much they spent protecting bank charges) many have crossed the line - anyway, i have the eye of the tiger - thankfully it is the year of the tiger today
  4. excellent .... the court assigns a debt counsellor to perform a "pre-sentence report" - sorry - "debt assesment" which should recommend a fair agreement between debtor and creditor problem is... all of this is complete rollocks when parking tickets are taken into account. If i did not repay a loan, there is a contract that shows i agreed, and i may have failed - contract breach However, with parking tickets, i never entered into contract with the council. I paid road tax which allows me to drive, but this is not to do with the council - then why how can council send criminals to my door? then when i ask why they sent criminals to my door they respond by saying they act within the law who's to blame the law, or the council or the bailiff - or the police? all me thinks, shame it's easy for them to dig claws into us, but make it very difficult for us (by way of trial!) to gain justice against those that lie

I believe there is an old adage, somewhere that says.... don't gamble what you can't afford to lose... directed towards banks..... and... also don't spend more than you earn..... directed towards debtors simples!!!! I have lost hundreds if not thousands on lending to people - friends etc - money when they have not been able to borrow from the bank etc. i would not send a bailiff to them. Sometimes I get it back, sometimes I didn't. If I didn't get it back, I blamed myself (ouch) as I should have perhaps used better judgement. i.e. i lent someone some money perhaps on the chance that if i may one day be in need myself, I could ask someone to return the favour - makes for good society! unfortunately banks do not operate on this humane principle they are not your friend - the bailiff is. but again back to your question.... sorry - i don't do demands - unless of course you are a un-certificated bailiff supported by police officers who has clamped my car illegally and is prepared to claim that you are a bonafide court bailiff like Newlyn plc does!- sorry! what I will do is work with people on this forum collectively and collaborate to come to a CAG made alternative that allows creditors to be paid - or not! this may take time and many roads - but fwiw, i have about 5-6 viable alternatives that do not involve terrorising people in their homes if only someone starts a thread on this topic - this thread is not it... unless the OP agrees... ....Beat the Bailiff on TV started the fall from grace of the bailiff industry - to be replaced by common sense and decency!
  6. Bollocks!!!!!! In a medieval world yes, not in a forward looking civilised society. A forward looking civilised society would, in my eyes send a humble person - a female ideally!- (bailiff's are perversely men) - with bags of humility with a laptop to talk assess and HELP the person get back on track - only by providing the means to do more and EARN MORE. I.e. don't steal from debtors- instead educate and help those in debt to help society become richer - no one wants debt. The stress caused by debt may be as costly to the NHS as smoking????? If we have high debt, isn't the logical thing to help us get out of debt and not enforce and destroy the lives of vunerable people.... Debt is resolvable thru help. Bailiff action is a tsunami which will put people further back into poverty - vicious circles!. The day we stop tsunami'ing people in their homes the day we can all sleep better. The Newlyn plc MD said he was going to climb through my windows and take what ever he wanted - for a blinkin parking ticket. Bastard. No one should be allowed to take anything by intimidation or force- something HMCS inflicts on us everyday! If something is needed halfway, a bailiff should only ask a debtor what may be taken. He should then go to court and a judge (not bailiff!) makes a decision on what should be agreed to be taken - authorised by the debtor. Perhaps.... It should be law that someone's goods cannot be sold on. Only put into storage until the debt is paid.

Not according to Harrow Council, Newlyn plc and my experience - they have drivers operating as court bailiffs collecting parking fines and calling police for support - which has the full backing, trust and authorisation by the managing director himself AND hmcs. Sickening! We do not need bailiff's!!!!!!!!!!!!!!!!! in the same light that wilberforce helped explain to an ignorant government that we will be a better society without slaves, slavery and slavemasters (read Parking Attendents, Bailiff's and Councils) we need to be protected from these evils as for collecting unpaid monies, credit risk calculators & systems are some of the most advanced computer systems. Banks and lenders MUST be wholly responsible in their lending. They charge a huge premium for taking on that risk..... if they lend by calculation, they should not take by force, as the risk and cost of erroneous calculations should be bourne by the risk taker - after all that is what they are paid for!
  8. Okay, quick update... i have got some wheels turning (in a clamp free zone!) I feel newlyn have effectively shot themselves in the foot and mouth at the same time - and their industry i feel that the fat-fingered barrister is to considerably to blame for the outcome - he lied and lied and harrassed - effectively bringing his profession into disrepute alongside the parking industries - why lie and mislead the court? i'm gonna write to bbc topgear and jeremy clarkson - I KNOW they understand!

  12. Yano, our posts crossed - well said but it is what we have been saying all along! It is confusing!!!!! Problem is, you try explaining all this in a court of law! When told that i had to pay £750, I made it clear that if I had known that there was a possibility of me having to make a payment, I would not have complained. I asked if my complaint had any credit. I was told that it had and the court was glad that I had sent it. Shame that it cost me £750.
  13. Hi, Well said Kelcou, seanamarts, but I have heard that ignorance of the law... Yano you are confused as this is a form4 complaint not a 'case' as some people may believe. It shows that some of these people perhaps over the years have moved so close to each other they have forgotten that the first and most important aspect has been overlooked - ignored even: To uphold the rights of the man on the street. In this case, it was the man at home who had his rights trashed - then was ridiculed, shouted at, criticised, bellowed at and generally harangued from start to finish in court the told to pay £750 for the pleasure. The parking ticket bailiff is the court's axe wielder. This is a medieval esque way. Parking tickets are no longer suitable for collection by bailiffs. It's just not what we should be doing in a forward looking civilised society. Problem is the people in the parking industry say the sun will not rise if parking tickets are not forced. That there will be chaos. Shake shake rattle rattle. I am preparing some FOI requests which I hope can show that the current system is just not fit for purpose. More pain and suffering. Knocking on my door for £40 acting like a court bailiff - pathetic - I will come knocking on theirs - starting with the council. Sickened by what i have seen smelt and heard. Dishonesty has no place at my front door. The party which addresses this issue gets my vote. Shake shake rattle rattle.

If anyone is confused as to why I would start a post with: "Last name Ever, first name Greatest" Just a song I was listening to at the time - (very bad language) (cleaner version) plus, i joke that the Newlyn wanna be bailiff called police and said on par with "Last name Ever, First name Stupidest" plus Newlyn appears to class itself as 'a great collector' just in case!

Just read this on grounds for complaint: "The bailiff committed extortion or blackmail - He said you will have to pay a higher sum of money unless to pay him a lower sum of money according to a deadline" Hmmm he did say that i will have to pay before 3pm or the amount will go up (from screw the bailiff site)
  16. Vexatious Litigant? Ha Ha... That's the parking industry. Form 4 is not litigation so i do not think there is any chance of looking like the parking industry. Or is it litigation? Feels like litigation. Smells like litigation. Looks like litigation. Sounds like litigation.... but it is not, it is a complaint against someone the court should perhaps reconsider trusting. I had to give cause why the bailiff should not carry a cert. I understood it was for the bailiff to give cause.
  17. Sorry to everyone that I may have disappointed. First up, I have other issues I am dealing with - I do find myself in a rather large pit. I was not obliged to attend, but having attended, I was wholly obliged to be party to litigation. I was trapped. I was misled into submitting a form 4. I was not clear if the onus / or burden of proof was on me. I am not legal. The Judge was a nice although she did criticise me many times. She spoke a tad too quietly for me to hear clearly - facing away from me. Newlyn were just after costs. I cannot believe given the weight of evidence that went against Newlyn, particularly their own evidence, that the judge did not uphold my complaint. Key point was the the Judge said it would be too draconian to revoke his certificate as she... and i do not recall it exactly... could not inflict hardship or his right to earn a living away. The court is happy for Newlyn to inflict hardship and take by impersonating court officials from the hardup or troubled. Draconian was result. I have lots of explaining to do and am producing a document. If only Harrow, Newlyn, Segens and 7br and HMCS all looked at each other and thought... this cannot go on. We need to talk. We are wasting other peoples money.
  18. Thanx wonkinski, no beer in hand.... yet I find drinking alcohol and reading CAG are a tad dangerous! What i think CAG really needs to build up is a wiki to summarise all the key posts and points to enable faster location of key points - and a state of the problem summary - with removal of the rants dribble and irrelevant entries to make CAG usability better. I read fast but i have to read too much!
