  1. Yes , current T&C on the reverse and the leaflet they refer to enclosed. All added to my file. No response needed, it's not our problem.
  2. Dear Sir/Madam, Your Ref : xxxxx Your Client : XXXX I refer to your letter of xx/xx/2008, which was received today. Frankly, I am surprised of the need to remind a firm of solicitors about the terms and conditions surrounding my Consumer Credit Agreement request (Consumer Credit Act, 1974); received by XX DCA XX on xx/xx. I can only assume therefore that they failed to inform you. Should your client now persist with threats of legal action as stated in your letter, I will welcome the opportunity for a judge to look at several offences committed by XXX DCA XX under The Consumer Credit Act, 1974, as well as your client’s non-compliance with and total disregard for the law on this occasion. Yours faithfully,
  3. Yes but someone might receive this and be tipped over the edge - this is an evil tactic.
  4. I would send the telephone harrasment letter too - in the same envelope.
  5. I always include this paragraph in any CCA request. 'I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. Take note this payment is not to be credited to the alleged account and is to be used only as said fee.' They may still ignore it but they can't pretend they were ignorant of the request and the purpose of the payment.
  6. This is what Kays came back to me with. http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/135338-nice-letter-kays.html then I got another demand for payment so I wrote back making a formal complaint, with a letter before action sticker on it; no response yet but no more calls either. Looks like we're on the same road with these people!
  7. I think this will be statute barred but as none of mine are (yet:)) I'm not the one to advise as I have not dealt with this, calm down, have a cup of tea and someone will be along to help you VERY soon. Zazen x
  8. You need to send them this letter with a £1.00 PO, type signiture do not sign. You have found your way to the right place and will find lots of help here. Dear Sir/Madam Re:- Account/Reference Number 4563210025897412 With reference to the above agreement, we would be grateful if you would send us a copy of this credit agreement. We understand that under the Consumer Credit Act 1974 (Sections 77-79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. We understand a copy of our credit agreement should be supplied within 12 working days.
