  1. Excellent idea ....also the default that has been placed on my file, is it Argos or Moorcroft that would have placed it there. I need to start the ball rolling to get it removed.

In your letter you make reference to requiring my signed authorisation before you can comply. I draw your attention to the fact that the Consumer Credit Act 1974 does not require that I supply you with a copy of my signature before you comply with my S78 request. Therefore, please state your reasons behind this request. If this is for Data Protection purposes then I can happily supply you with documentation to substantiate my identity to you. However please note that to date you have happily sent statements and correspondence to this address so I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this? My request for a true copy of my credit agreement under section 78 was made on xx/xx/2007 and the 12 working days + the additional 30 days for your compliance expired on xx/xx/2007 I look forward to receiving the documentation that I have requested.   3. I really need that default removing and considering that they have failed to send me my cca and the data protection mess up, I think they owe it to me if you know what I mean. Its me thats suffering and not them!
  4. I will call them on Monday morning.... Any advice on this default on my file, can I not get them to remove it as they are in breach of my CCA request and have broke the Data protection laws?

  6. Received a letter from Finance company..... We are extremely concerned that you have failed to respond to our previous correspondence( I haven't had any since I sent my letter of proposal). Therefore, if you do not respond to this letter in the next 7 days, the next form of correspondence you will receive regarding the account will be from our solicitors. This will include a statutory demand for bankruptcy and a county court judgement. Need some help on this as I have wrote to them offering my proposals for repaying the arrears and haven't heard anything from them. Also this is an HP agreement for a car, so surely it would be a repossesion of the vehicle, not bankrupcy?

  9. Do I need to send Moorcroft a letter as they have now missed the 12+30 days? More phone calls from them today.....also what happens to the default that has been placed on my file?
  10. What should I do now then? They have broken the Data Protection laws and failed to send me my CCA within the legal timescale. But they still continue to chase for payment. They have even called me again this morning!!
  11. Just a thought, hasn't this guy broke data protection laws by not ensuring that I was who I said I was.....I even have the telephone conversation recorded!! The 12+30 days have now passed as well......

Can not believe the call from Moorcroft tonight...the guy asked for me and I said speaking, he then said my name is Dave phoning from Moorcroft Debt Recovery, its regarding your oustanding balance on your Argos card.(No security check!!!)....We are prepared to accept your offer of £1 per month....I said what offer, I haven't offered you anything!!. Oh, Just hang on whilst I check the notes, yeh you offered us a £1 per month well we can accept that from you. I said stop talking garbage, your company remains in breach of my legal request for my Consumer Credit agreement. Right Ok sir he replied thanks anyway and put the phone down
