  2. many thanks for the kind message Audreygreeneyes capital one had until today to reply, so havent heard anything from the court so far, so how long should we wait to hear something from the courts
  3. feel a little scared and happy tooo just hope i have done the right thing, cost me £108.00 of my hard earned money for this, wife gone mad at me, telling me we cannot possibly win this
  4. letter received from the court today claimed issued on 12 November 2008 sent to defendant by first class post on 12 November 2008 deemed as served on 14 November 2008 defendant has until 28 November 2008 to reply whooppeeeeeeeeee

  9. right, for all those who have been following this thread. I could really do with a final answer on this now, are my POC 100% correct for this I have received this today, and will need to file my action N1 on tuesday at the latest now. comments and observations appreciated please

  12. cheers right when i asked for the CCA request last year, this is what i got in return. 3 pieces of paper in total now there is this page too, but it if you look closely you cannot see the fold marks on it like the one above. I have read somewhere that capital one do this quite a lot, trying to make the document look like they were back to back agreements. I would welcome peoples thoughts. when i pressed them to see an enforecable agreement at an earlier date they send me last scanned one before suddenly finding this one. Not realy sure what this means, think they may be trying to pull some kind of fast one., will attach that one too. this
  13. would i be right in thinking in that that although i am supposed to have signed a credit agreement, doesnt it have to be signed by both myself and captial one. cannot work out how to to post a scan image into this thread
  14. they only thing i ever signed was the piece of paper that said application form, so i guess its not enforceable, so i could go for both ppi and charges nowplease confirm this is correct

  21. £2976.87just found it on court website, £85.00 if under £3000.00does that mean claim and court costs together, as if i add both mine together it brings it over the £3000.00
